ROLL CALL Roll call was taken by Deputy City Clerk Medina with the following being present: Mayor Minor; Council Members Negrete, Curlin, Oberhelman, Devlin, Anderson, Miller; City Attorney Penman; Deputy City Clerk Medina; Assistant City Administrator Wilson. Absent: Council Member Arias. READING OF RESOLUTIONS & ORDINANCES Deputy City Clerk Cordova read the titles of all the resolutions and ordinances on the regular and supplemental agendas of the Mayor and Common Council and the regular and supplemental agendas of the Community Development Commission/San Bernardino Joint Powers Financing Authority/San Bernardino Park Acquisition Joint Powers Financing Authority and Mayor and Common Council while the Mayor and Common Council and Community Development Commission were in closed session. RECONVENE MEETING At 9:02 a.m., Mayor Minor reconvened the joint regular meeting of the Mayor and Common Council and Community Development Commission of the City of San Bernardino. ROLL CALL Roll call was taken by Deputy City Clerk Medina with the following being present: Mayor Minor; Council Members Negrete, Oberhelman, Devlin, Anderson, Miller; City Attorney Penman; Deputy City Clerk Medina; Assistant City Administrator Wilson. Absent: Council Members Curlin, Arias. INVOCATION The invocation was given by Reverend Paul Reinhard, Calvary Baptist Church. PLEDGE OF ALLEGIANCE The pledge of allegiance was led by Council Member Oberhelman. COUNCIL MEMBER CURLIN RETURNED At 9:06 a.m., Council Member Curlin meeting and took his place at the council returned to the Council table. APPOINTMENTS (2) There were no appointments made at this meeting. 3 9/16/1996 PROCLAMATION - GOOD NEIGHBOR DAY - SEPTEMBER 27, 1996 - R & R FLORAL (3) J. Lorraine Velarde, Executive Assistant to the Mayor, read a resolution proclaiming September 27, 1996, as Good Neighbor Day in the City of San Bernardino. Rick and Rudy from R & R Floral accepted the proclamation. PROCLAMATION - POLLUTION PREVENTION WEEK - SEPTEMBER 16- 22, 1996 - COUNTY OF SAN BERNARDINO (3) J. Lorraine Velarde, Executive Assistant to the Mayor, read a resolution proclaiming the week of September 16 -22, 1996, as Pollution Prevention Week in the City of San Bernardino. The proclamation will be mailed to Greg Beech, Hazardous Controls Field Representative, County of San Bernardino. ANNOUNCEMENTS - COUNCIL MEMBER MILLER (4) Council Member Miller expressed her pleasure in attending the opening night of the San Bernardino Symphony at the California Theater, which premiered a Russian concert. 5 9/16/1996 ANNOUNCEMENTS - COUNCIL MEMBER ANDERSON (4) Council Member Anderson congratulated the 4000+ teachers, administrators, and school personnel for having a very smooth school opening and encouraged the students to practice safe habits while travelling to and from school. ANNOUNCEMENTS - COUNCIL MEMBER CURLIN (4) Council Member Curlin expressed his desire to see the Mayor's salary increased to the level of the highest paid subordinate and the Council's compensation to reflect a percentage of the Mayor's salary. ANNOUNCEMENTS - COUNCIL MEMBER NEGRETE (4) Council Member Negrete announced that he attended the Mexican Independence Day Celebration and congratulated the citizens who brought the event to fruition. San Bernardino ANNOUNCEMENTS - MAYOR MINOR (4) Mayor Minor stated that while on Virginia, stopped at the Amboy Cafe memorabilia. vacation, he and his wife, and brought back Route 66 PUBLIC COMMENTS - PAULINE DEY (5) Pauline Dey, 1378 Gould Street, concern regarding the quality of instructed Ms. Dey to meet with his Velarde. San Bernardino, CA, expressed Gould Street. Mayor Minor Executive Assistant, Lorraine PUBLIC COMMENTS - RUBEN LOPEZ (5) Ruben Lopez, 631 W. 16th Street, San Bernardino, CA, voiced support for a City-operated emergency-medical transport service and stated that an investigation should be conducted on the property located at 137 South "G" Street to determine if they are in compliance with the Development Code. 6 9/16/1996 PUBLIC COMMENTS - DONNA CONANT (5) Donna Conant, 26245 E. Base Line, Highland, CA, stated that more funds should be allocated to assist the youth. PUBLIC COMMENTS - BILL CASAGA (5) Bill Casaga encouraged the public to volunteer for the citizens patrol. If anyone is interested in supporting the Police Department and making the city a better place to live, please call 384-5715. WAIVE FULL READING OF RESOLUTIONS & ORDINANCES (6) Council Member Curlin made a motion, seconded by Council Member Negrete, and unanimously carried, that full reading of the resolutions and ordinances on the regular and supplemental agendas of the Mayor and Common Council be waived. COUNCIL MINUTES (7) Council Member Curlin made a motion, seconded by Council Member Negrete, and unanimously carried, that the minutes of the following meetings of the Mayor and Common Council of the City of San Bernardino be approved as submitted in typewritten form: July 15, 1996; August 5, 1996; August 26, 1996. RECEIVE & FILE - TRI-CENTENNIAL CELEBRATION REPORT (10) Rachel Clark, city Clerk, submitted a Staff Report dated August 28, 1996, concerning the receipt and filing of the minutes of the Bicentennial Commission's meeting of July 2, 1996. Council Member Curlin made a motion, seconded by Council Member Negrete, and unanimously carried, that the Mayor and Common Council receive and file the letter dated August 23, 1996, from Thelma Press, former Bicentennial Executive Director for the City of San Bernardino, providing minutes of the July 2, 1996, meeting of members of the 1976 Bicentennial Commission who donated funds for the Tri-Centennial Celebration. AUTHORIZE APPLICATION & ADMINISTRATION $50,000 OF EMERGENCY FOOD AND SHELTER PROGRAM FUNDS (FEMA XV) WESTS IDE COMMUNITY SERVICE CENTER - PARKS, RECREATION AND COMMUNITY SERVICES (12) Annie Ramos, Director of Parks, Recreation and Community Services, submitted a Staff Report dated September 5, 1996, requesting authorization to apply for and administer $50,000 of Emergency Food and Shelter Program funds (FEMA Xv) to service the Westside Community Service Center. 7 9/16/1996 Council Member Curlin made a motion, seconded by Council Member Negrete, and unanimously carried, that the Director of Parks, Recreation and Community Services Department be authorized to apply for and administer $50,000 of emergency food and shelter funds under the provision of the Emergency Food and Shelter National Program (FEMA XV) . ORD. Me-98l - ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING CHAPTER 12.90 OF THE SAN BERNARDINO MUNICIPAL CODE PERTAINING TO REGULATIONS FOR PUBLIC PROPERTY, PUBLIC PLACES AND PUBLIC IMPROVEMENTS WITHIN ASSESSMENT DISTRICTS. Final (14) Council Member Curlin made a mction, seconded by Council Member Negrete, that said ordinance be adopted. Ordinance No. MC-981 was adopted by the following vote: Ayes: Council Members Negrete, Curlin, Oberhelman, Devlin, Anderson, Miller. Nays: None. Absent: Council Member Arias. CLAIMS AND PAYROLL (15) Council Member Curlin made a motion, seconded by Council Member Negrete, and unanimously carried, that the claims and payroll and authorization to issue warrants as listed on the memorandum dated August 28, 1996, from the Director of Finance, be approved. ORD. MC-982 - AN ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING CHAPTER 15.12 OF THE SAN BERNARDINO MUNICIPAL CODE AMENDING SECTION 15.12.040 AND ADDING SECTIONS 15.12.100,15.12.110,15.12.120,15.12.130, AND 15.12,140 TO THE SAN BERNARDINO MUNICIPAL CODE RELATING TO EXTENDING THE COMPLIANCE DATES FOR UNREINFORCED MASONRY BUILDINGS AND SIGN POSTING. Final (8) A discussion was held concerning the current standards for unreinforced masonry buildings and the proposed extension said ordinance would grant for the rehabilitation of such. Council Member Devlin made a motion, seconded by Council Member Oberhelman, that said ordinance be adopted. Ordinance No. MC-982 was adopted by the following vote: Ayes: Council Members Negrete, Curlin, Oberhelman, Devlin, Anderson. Nays: Council Member Miller. Absent: Council Member Arias. RES. 96-278 - RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING COST OF ABATEMENTS AND IMPOSING LIENS ON CERTAIN PARCELS OF REAL PROPERTY LOCATED WITHIN THE CITY OF SAN BERNARDINO FOR THE COSTS OF THE ABATEMENT OF PUBLIC NUISANCES. (BUILDING ABATEMENTS) (9) 8 9/16/1996 Discussion ensued regarding the need to aggressively pursue the collection of funds prior to liening and whether or not there is a cap placed on the amount of funds which can be expended. It was noted that an excess of $150,000 in city funds has already been spent. Council Member Oberhelman made a motion, seconded by Council Member Anderson, that said resolution be adopted; and that the City Clerk be directed to administratively remove any properties from Exhibit A which have been paid. The motion carried and Resolution the following vote: Ayes: Council Oberhelman, Devlin, Anderson, Miller, Council Member Arias. No. 96-278 was adopted by Members Negrete, Curlin, Nays: None. Absent: RES. 96-279 - RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO APPROVING THE EXECUTION OF AN AMENDMENT TO AGREEMENT FOR PROFESSIONAL SERVICES WITH RITA CORONADO FOR MENTORING COORDINATOR SERVICES. (11) Council Member Curlin made a motion, seconded by Council Member Anderson, that said resolution be adopted. Resolution Ayes: Council Anderson, Miller. No. 96-279 was adopted by the following vote: Members Negrete, Curlin, Oberhelman, Devlin, Nays: None. Absent: Council Member Arias. ESTABLISH POSITION - LITERACY SITE MANAGER ELEMENTARY SCHOOL - GRANT FUNDS - LIBRARY - later in the meeting - page 10) - EMMERTON (Discussed (13) Barbara Dillon, Director of Personnel, submitted a Staff Report dated August 28, 1996, requesting the establishment of a Literacy Site Manager position for the Emmerton Healthy Start Project located at Emmerton Elementary School. Council Member Oberhelman made a motion, seconded by Council Member Negrete, that one (1) Literacy Site Manager position, grant funded at $9.00 per hour, be established; and that the Personnel Department be directed to update Resolution No. 6413, Section 13, to reflect this particular action. (Note: There was no vote taken at this time.) Concern was expressed regarding the need for the Literacy Site Manager position and the necessary qualifications in comparison to the compensation. It was the consensus of the Mayor and Common Council that the matter be discussed later in the meeting. 9 9/16/1996 PERSONNEL ACTIONS - page 17) (Discussed later in the meeting - (16) Council Member Negrete made a motion, seconded by Council Member Miller, that the personnel actions submitted by the Chief Examiner dated September 5, 1996, in accordance with Civil Service rules and Personnel policies adopted by the Mayor and Common Council of the City of San Bernardino, be approved and ratified. Barbara Pachon, Director of Finance, answered questions concerning the need for the accountant position. Council Member Oberhelman made a substitute motion that the personnel actions submitted by the Chief Examiner dated September 5, 1996, in accordance with Civil Service rules and Personnel policies adopted by the Mayor and Common Council of the City of San Bernardino, be approved and ratified with the deletion of Item No. One on the unclassified list and Item No. Four on the classified list. The substitute motion failed for lack of a second. Council Member Curlin made a substitute motion, seconded by Council Member Anderson, and unanimously carried, that the personnel actions submitted by the Chief Examiner dated September 5, 1996, in accordance with Civil Service rules and Personnel policies adopted by the Mayor and Common Council of the City of San Bernardino, be approved and ratified with the deletion of Item No. One on the unclassified list. RIALTO AVENUE MASTRO PAOLO - (Continued from September 3, 1996) ORDER PAUL (18) Paul Mastropaolo, P. O. Box 1613, Huntington Beach, CA, submitted a letter dated September 16, 1996, concerning his property located at 1239-1241 1/2 W. Rialto Avenue and 103-105 S. Giovanola Street. Mayor Minor opened the hearing. Joseph Lease, Inspection Services Supervisor, Planning and Building Services, provided a synopsis of the action taken relative to the property located at 1239-1241 1/2 W. Rialto Avenue. Paul Mastropaolo referred to California legislation relative to housing and requested that the building be allowed to remain as built since it was built in compliance with applicable state law. Discussion ensued regarding the current building code standards. Joseph Mastropaolo, 1629 Magellan Lane, Huntington Beach, CA, reiterated the statements made by Paul Mastropaolo. Joseph Lease explained that the standards by which the city mandates compliance are within the Uniform Housing Code which also adheres to state law and is part of the Health and Safety Code. Paul Mastropaolo answered questions regarding the improvements made to the property. Council Member Oberhelman made a motion, seconded by Council Member Devlin, and unanimously carried, that the hearing be closed, Council Member Devlin made a motion, seconded by Council Member Anderson, and unanimously carried, that the Mayor and Common Council uphold Order No. 3302 of the Board of Building commissioners and deny the appeal. APPEAL HEARING - BOARD OF BUILDING COMMISSIONERS' ORDER NO. 3303 - 103-105 S. GIOVANOLA STREET - PAUL MASTRO PAOLO (Continued from September 3, 1996) (19) Mayor Minor opened the hearing. Joseph Lease, Inspection Services Supervisor, Planning and Building Services, provided a synopsis of the action taken relative to the property located at 103-105 S. Giovanola Street. 11 9/16/1996 Paul Mastropaolo answered improvements made to the property violating his civil rights. questions concerning the and stated that the city is Joseph Mastropaolo reiterated the statements made by Paul Mastropaolo. Joseph Lease explained the conditions at said property which are a risk to health and safety. Council Member Oberhelman made a motion, seconded by Council Member Devlin, and unanimously carried, that the hearing be closed. Council Member Devlin made a motion, seconded by Council Member Oberhelman, and unanimously carried, that the Mayor and Common Council uphold Order No. 3303 of the Board of Building Commissioners and deny the appeal. RECESS MEETING At 11:05 a.m., Mayor Minor declared a five-minute recess. RECONVENE MEETING At 11:11 a.m., Mayor Minor reconvened the joint regular meeting of the Mayor and Common Council and Community Development Commission of the City of San Bernardino. Absent: Council Member Arias. PRESENTATION R.G. CANNING YOUTH TRAVEL PARTICIPANTS OF THE 1996 SOAP BOX DERBY AWARDS (2) Mike Redd, R.G. RES. 96-280 - RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A CONTRACT TO COR-NOR CONSTRUCTION, INC., FOR TREE PLANTING ON SIXTH STREET, FROM "H" STREET TO "E" STREET. (R3) Council Member Oberhelman made a ~otion, seconded by Council Member Miller, that said resolution be adopted.
