HomeMy WebLinkAbout07-03-1996 Minutes MINUTES MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO ADJOURNED REGULAR MEETING JULY 3, 1996 COUNCIL CHAMBERS This is the time and place meeting of the Mayor and Common Bernardino from the regular meeting 1, 1996, in the Council Chambers Street, San Bernardino, California. set for an adj ourned regular Council of the City of San held at 8:00 a.m., Monday, July of City Hall, 300 North "D" The City Clerk has caused to be posted the order of adjournment of said meeting held on Monday, July 1, 1996, and has on file in the Office of the City Clerk an affidavit of said posting together with a copy of said order which was posted at 8:15 a.m., Tuesday, July 2, 1996, on the door of the place at which said meeting was held. The adjourned regular meeting of the Mayor and Common Council of the City of San Bernardino was called to order by Mayor Pro Tem Arias at 10:03 a.m., Wednesday, July 3, 1996, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. ROLL CALL Roll call was taken by City Clerk Rachel Clark with the following being present: Mayor Pro Tem Arias; Council Members Negrete, Arias, Devlin, Anderson, Miller; City Attorney Penman; City Clerk Rachel Clark; City Administrator Shauna Clark. Absent: Mayor Minor, Council Members Curlin, Oberhelman. CLOSED SESSION (1) The Mayor and Common Council did not recess to closed session during this meeting. RECONSIDER - RES. 96-188 - RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO ESTABLISHING BUSINESS REGISTRATION AND PERMIT FEES. (Continued from July 1, 1996) (2) City Clerk Rachel Clark explained that there were typographical errors and changes made within said resolution. Council Member Miller made a motion, seconded by Council Member Negrete, that the Mayor and Common Council reconsider the previous action taken for the adoption of Resolution No. 96-188; and that said resolution be ratified as revised. 1 7/3/1996 The motion carried and Resolution No. 96-188 was ratified by the following vote: Ayes: Council Members Negrete, Arias, Devlin, Anderson, Miller. Nays: None. Absent: Council Members Curlin, Oberhelman. DISCUSS & TAKE ACTION - BUDGET DELIBERATIONS - FISCAL YEAR 1996/97 (Continued from July 1, 1996) (3) Fred Wilson, Assistant City Administrator, reiterated the actions taken at the Mayor and Council meeting of July 1, 1996, explained that the remaining deficit is $10,700 and recommended that the Booking Fee Trust Fund be reduced by an additional $50,000. COUNCIL MEMBER DEVLIN EXCUSED At 10:08 a.m., Council Member Devlin left the Council meeting. Council Member Anderson made a motion, seconded by Council Member Negrete, and unanimously carried, that the Booking Fee Trust Fund be reduced by $100,000 rather than $50,000. Mayor Pro Tem Arias thanked staff for providing the budget- balancing recommendations. COUNCIL MEMBER DEVLIN RETURNED At 10:10 a.m., Council Member Devlin returned to the Council meeting and took his place at the council table. AUTHORIZE APPROPRIATION OF FUNDS $8,400 OPEN & OPERATE CAL STATE POOLS - SUMMER PUBLIC SWIMMING PROGRAM COUNCIL MEMBER DEVLIN (Continued from July 1, 1996) (4) Council Member Miller made a motion, seconded by Council Member Devlin, that $8,400 be appropriated to operate a summer public swimming program at Cal State University. (Note: There was no vote taken and the motion was subsequently amended.) Council Member Devlin stated that he spoke to a representative from the school board who indicated that they would be amenable to allowing the City free use of Cajon High School. However, the board asks that the City open and close the pool and provide maintenance and lifeguard services. Mr. Devlin explained that the public would have to pay for parking at the university and therefore prefers the facilities available at Cajon High School. Annie Ramos, Director of Parks, Recreation and Community Services, answered questions regarding the allocation of funds and the commencement of operations at both centers. 2 7/3/1996 City Administrator Shauna Clark answered questions regarding the effect the proposed action would have on the fiscal year 1996/97 budget. A discussion was held concerning the fiscal year 1996/97 budget and the possibility of eliminating all pool services or rotating the pools open within the City. Council Member Miller amended her motion, seconded by Council Member Devlin, and unanimously carried, that $10,000 be appropriated for a summer public swimming program at the Mill Center and Cajon High School, not to exceed $5,000 for each location. RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO SUBMITTING TO THE ELECTORS A MEASURE TO ADOPT AND LEVY A SPECIAL TAX TO PAY FOR ADDITIONAL POLICE OFFICERS, EQUIPMENT AND ATTENDANT EXPENSES AND REQUESTING THAT SUCH SPECIAL MUNICIPAL ELECTION BE CONSOLIDATED WITH THE GENERAL ELECTION CONDUCTED BY THE COUNTY OF SAN BERNARDINO ON NOVEMBER 5, 1996. (Continued from July 1, 1996) (SA) City Administrator Shauna Clark stated that staff is recommending that the election be rescheduled to March 1997 as there is a possibility that the proposed "Right to Vote on Taxes Act" initiative may be approved on the November 5, 1996, ballot. City Clerk Rachel Clark stated that the estimated cost of the election is $112,000. The following individuals expressed support for a March 1997 election: David Schultz, East Inland Empire Association of Realtors, 1798 North "D" Street, San Bernardino, CA. Ann Commerce I Atkinson, President, San Bernardino Area 1355 South "E" Street, San Bernardino, CA. Chamber of City Attorney Penman stated that the City was hoping to place the matter on the November 5, 1996, ballot; however, because of the proposed initiative, it would be prudent to hold the election after the November 5, 1996 election. Council Member Negrete made a motion, seconded by Council Member Anderson, and unanimously carried, that the proposed parcel tax election for police services, pr"eliminarily scheduled for November 1996, be rescheduled to the first available election date in March 1997, due to the uncertain and possible exigent circumstances generated by the "Right to Vote on Taxes Act" initiative which will appear on the November 1996 ballot; and that 3 7 /3/1996 the City Attorney be directed to follow up with the necessary documentation for Council action at the appropriate time. City Attorney Penman explained how tax dollars and staff can be utilized in preparing a measure for the ballot. He stated that the City cannot express any support or opposition, and individuals wishing to support or oppose the measure would have to obtain funds from private sources or citizen groups. RATIFY DIRECTION FROM MAYOR HIRING OF LAW FIRM NEILSEN, MERKSAMER, PARRINELLO, MUELLER & NAYLOR PROVIDE INTERPRETATION FOR PROPOSED NOVEMBER 5, 1996 BALLOT MEASURE - "RIGHT TO VOTE ON TAXES ACT" (NB1) Council Member Devlin made a motion, seconded by Council Member Anderson, and unanimously carried, that the matter arose subsequent to the posting of the agenda. Council Member Devlin made a motion, seconded by Council Member Anderson, and unanimously carried, that the direction given by Mayor Minor to hire the law firm of Neilsen, Merksamer, Parrinello, Mueller and Naylor to advise the City relative to the proposed initiative "Right to Vote on Taxes Act" for the November 1996 ballot, be ratified; and that payment be authorized. AN ORDINANCE OF THE CITY OF SAN BERNARDINO PROPOSING THE ADOPTION AND AUTHORIZATION OF THE LEVY OF SPECIAL TAXES TO PAY FOR ADDITIONAL POLICE OFFICERS, EQUIPMENT AND ATTENDANT EXPENSES, CALLING A SPECIAL ELECTION ON SUCH PROPOSITION FOR NOVEMBER 5, 1996, AND PROVIDING FOR THE CONSOLIDATION OF THAT SPECIAL ELECTION WITH THE STATEWIDE GENERAL ELECTION TO BE HELD ON THAT DATE. (Continued from July 1, 1996) (SB) Council Member Miller made a motion, seconded by Council Member Negrete, and unanimously carried, that the matter be tabled. ADJOURNMENT (6) At 10:46 a.m., the adjourned regular meeting adjourned.
