HomeMy WebLinkAbout03-25-1996 Minutes MINUTES MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO ADJOURNED REGULAR MEETING MARCH 25, 1996 COUNCIL CHAMBERS This is the time and place set for an adjourned regular meeting of the Mayor and Common Council of the City of San Bernardino from the regular meeting held at 8:00 a.m., Monday, March 18, 1996, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. The City Clerk has caused to be posted the order of adjournment of said meeting held on Monday, March 18, 1996, and has on file in the Office of the City Clerk an affidavit of said posting together with a copy of said order which was posted at 8:15 a.m., Tuesday, March 19, 1996, on the door of the place at which said meeting was held. The adjourned regular meeting of the Mayor and Common Council of the City of San Bernardino was called to order by Mayor Minor at 10:02 a.m., Monday, March 25, 1996, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. ROLL CALL Roll call was taken by City Clerk Rachel Clark with the following being present: Mayor Minor; Council Members Negrete, Curlin, Arias, Oberhelman, Devlin, Anderson, Miller; City Attorney Penman; City Clerk Rachel Clark; Assistant City Administrator Wilson. Absent: None. CLOSED SESSION (l) Pursuant to Government Code Sections. 1. Conference with legal counsel existing litigation pursuant to Government Code Section 54956.9(a) Tomas Armendariz. et al. vs. James F. Penman. et al. United States Court of Appeals, Ninth Circuit No. 93- 55393; United States District Court Case No. CV 91-5757 CMB. Council Member Miller made a motion, seconded by Council Member Arias, and unanimously carried, that the matter be continued to April 1, 1996, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. 1 3/25/96 RES. 96-73 - RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO APPROVING A CERTAIN FINANCING BY THE SAN BERNARDINO INTERNATIONAL AIRPORT AUTHORITY AND ACKNOWLEDGING CERTAIN OBLIGATIONS INCURRED BY THE CITY OF SAN BERNARDINO PURSUANT TO A JOINT POWERS AGREEMENT ESTABLISHING THE SAN BERNARDINO INTERNATIONAL AIRPORT AUTHORITY. (Discussed later in the meeting) (2) City Clerk Rachel Clark read the title of the resolution. Concern was expressed resources the City has and the said resolution would have on regarding the limited financial contingent liability the adoption of City funds. A discussion was held relative to the provisions of the joint powers agreement and the financial obligation of the proposed issuance of tax-exempt notes to meet the operating deficit and the debt incurred by the San Bernardino International Airport Authority (SBIAA) . Economic Development Agency Special Counsel Sabo, speaking from the podium, explained the financial obligations of the SBIAA and answered questions regarding the financial commitment the City would incur if the Cities of Highland, Redlands, Loma Linda and Colton choose not to approve the issuance of the tax-exempt notes. RECESS MEETING At 10:31 a.m., Mayor Minor declared a five-minute recess. RECONVENE MEETING At 10:40 a.m., Mayor Minor reconvened the adjourned regular meeting of the Mayor and Common Council of the City of San Bernardino in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. ROLL CALL Roll call was taken by City Clerk Rachel Clark with the following being present: Mayor Minor; Council Members Negrete, Curlin, Arias, Oberhelman, Devlin, Anderson, Miller; City Attorney Penman; City Clerk Rachel Clark; Assistant City Administrator Wilson. Absent: None. RES. 96-73 - RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO APPROVING A CERTAIN FINANCING BY THE SAN BERNARDINO INTERNATIONAL AIRPORT AUTHORITY AND ACKNOWLEDGING CERTAIN OBLIGATIONS INCURRED BY THE CITY OF SAN BERNARDINO PURSUANT TO A JOINT POWERS AGREEMENT ESTABLISHING THE SAN BERNARDINO INTERNATIONAL AIRPORT AUTHORITY. (Discussed earlier in the meeting) (2) 2 3/25/96 Jim Monger, Airport Director, San Bernardino International Airport Authority, 201 North "E" Street, San Bernardino, CA, explained that funds would only be required if the SBIAA would incur a budget shortfall and answered questions regarding the current uses within the SBlAA. Council Member Devlin made a motion, seconded by Council Member Anderson, that full reading of the resolution be waived; and that said resolution be adopted. The motion carried and Resolution No. 96-73 was adopted by the following vote: Ayes: Council Members Negrete, Curlin, Arias, Oberhelman, Devlin, Anderson, Miller. Nays: None. Absent: None. Mayor Minor instructed Economic Development Agency Special Counsel Timothy Sabo to place the matter of providing a funding source through use of Economic Development Agency funds on the agenda of the meeting of April 1, 1996. ADJOURNMENT (3) At 10:48 a.m., the adjourned regular meeting adjourned. The next scheduled regular meeting will be held at 8:00 a.m., Monday, April 1, 1996, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California.
