COUNCIL CHAMBERS
The joint regular meeting of the Mayor and Common Council and
Community Development Commission of the City of San Bernardino was
called to order by Mayor Minor at 8:06 a.m., Tuesday, September 2,
1997, in the Council Chambers of City Hall, 300 North "D" Street,
San Bernardino, California.
ROLL CALL
Roll call was taken by City Clerk Clark with the following

in the conference room of the Council Chambers of City Hall.

1997 - CHURCH OF JESUS CHRIST OF LATTER-DAY SAINTS (3)
Ernest Wilson, Affirmative Action Officer, Mayor's Office,
read a resolution proclaiming the month of September 1997 as San
Bernardino History Month within the City of San Bernardino.
George Stehmeier, Stake President, Church of Jesus Christ of
Latter-Day Saints, accepted the proclamation.

Council Member Anderson announced that on September 27, 1997,
at 8:00 a.m., a walkathon sponsored by various organizations would
be held to raise funds for diabetes and other worthwhile causes.

Council Member Oberhelman thanked the India Association for
their 50th year celebration of India. The event was well attended
and orchestrated.

19, 1997, she received word from City Clerk Rachel Clark that the
recall efforts against her had been suspended and thanked the
individuals and businesses who did not participate in the recall

Felix D'Amico, 2348 N. Sterling Avenue #206, San Bernardino,
CA, announced his candidacy for the Fourth Ward Council seat,
outlined his qualifications and expressed concern regarding crime,
blight and economics.

Gary Kirby, 1505 Yardley Street, San Bernardino, CA, commented
on the article which appeared in The Sun newspaper regarding the
proposed charter amendment committee and expressed his views
concerning the contemplated amendments.

Ruben Lopez, 631 W. 16th Street, San Bernardino, CA, voiced
concern regarding the elimination of Charter Section 186 and
cautioned the voters against supporting those candidates who are
backed by political action committees.

Robert Rego, 123 E. 11th Street, San Bernardino, CA, announced
his candidacy for the Second Ward Council seat and stated that he
had attended the meetings to amend the city charter and was
concerned when three representatives of the committee had expressed
concern that the information would be ,"elated to the public.

Evlyn Wilcox, 3096 Parks ide Drive, San Bernardino, CA, stated
that in her tenure as Mayor, she convened a charter amendment
committee who worked for two years to no avail. She expressed
concern regarding the amendments being proposed by the committee.

acknowledging those individuals responsible for having the Jackie
Robinson exhibit displayed within the City of San Bernardino.

Member Negrete, and unanimously carried, that full reading of the

Council Member Devlin made a motion, seconded by Council
Member Negrete, and unanimously carrLed, that the claims and
payroll and the authorization to issue warrants as listed on the
memorandum dated August 27, 1997, from the Director of Finance be
approved.

Council Member Devlin made a mo-::ion, seconded by Council
Member Negrete, and unanimously carried, that the personnel actions
as submitted by the Chief Examiner dated August 25, 1997, in
accordance with Civil Service rules and Personnel policies adopted
by the Mayor and Common Council of the City of San Bernardino be
approved and ratified.
AUTHORIZE ADDENDUM COOPERATION AGREEMENT UNITED

Lori Sassoon, Senior Administrative Analyst, City
Administrator's Office, submitted a Staff Report dated August 26,
1997, concerning an addendum to a cooperative agreement for the
watering of lawns at vacant homes.
Council Member Devlin made a motion, seconded by Council
Member Negrete, and unanimously carried, that the Mayor be
authorized to execute an addendum to the cooperation agreement.
RES. 97-256 - RESOLUTION OF THE CITY OF SAN BERNARDINO
ESTABLISHING THE APPROPRIATION LIMIT FOR THE FISCAL YEAR
1997-1998 FOR THE CITY OF SAN BERNARDINO IN ACCORDANCE

submitted a Staff Report dated August 20, 1997, concerning the
improvement of sewer systems at various locations throughout the
city.
Council Member Devlin made a mot ion, seconded by Council
Member Negrete, and unanimously carried, that the plans for cross-
connection of a 12-inch sewer to a 54-inch sewer, repair of sewer
siphon under Mission-Zanja Creek and raising two manhole covers to
grade, in accordance with Plan No. 9693, be approved; and that the
Director of Public Works/City Engineer be authorized to advertise
for bids.

AMENDING RESOLUTION 6413, SECTION THIRTEEN,

submitted a Staff Report dated August 20, 1997, concerning Sewer
Waiver No. 97-01.
Council Member Miller made a motion, seconded by Council
Member Devlin, and unanimously carried, that Sewer Waiver Request
No. 97-01, for construction of a single-family residence on an
existing lot of record located at 6060 N. Highway 18 (APN 270-051-
38) requesting a waiver of requirement to connect to the sewer
system, be approved.
RES. 97-268 - RESOLUTION OF THE CITY OF SAN BERNARDINO
TERMINATING CITYWIDE ASSESSMENT DISTRICT NO. 994 AND
RELEASING OF LIENS. (22)
Council Member Miller made a motion, seconded by Council
Member Anderson, that said resolution be adopted.

RES. 97-269 - RESOLUTION OF THE CITY OF SAN BERNARDINO
AUTHORIZING THE SUBMISSION OF A PROJECT APPLICATION AND
THE EXECUTION OF A CONTRACT BY AND BETWEEN SOUTH COAST
AIR QUALITY MANAGEMENT DISTRICT AND SAID CITY FOR THE
PURPOSE OF ACQUIRING A TWENTY PERCENT MATCH GRANT FOR
ACQUISITION OF AN ELECTRIC VEHICLE FOR USE AS A CITY OF
SAN BERNARDINO FLEET DIVISION POOc. CAR. (23)
Council inquired about the allocation of funds and the
intended use of the electric vehicle.

City Administrator Wilson explained that the purchase of the
vehicle would demonstrate the city's conmitment to the improvement
of its air quality and answered questions regarding the number of
vehicles to be acquired within the fiscal year 1997/98 budget.
Council Member Anderson made a motion, seconded by Council
Member Oberhelman, that the appropriation of $7,800 from Account
No. 111-000-3405 (Transportation Fund Balance Account) to Account
No. 111-241-5803 (Lease Payments), be approved; and that said
resolution be adopted.
The motion carried and Resolution No. 97-269
the following vote: Ayes: Council Members Negrete,
Oberhelman, Devlin, Anderson, Miller. Nays: None.

RES. 97-270 - RESOLUTION OF THE CITY OF SAN BERNARDINO,
CALIFORNIA, SUPPORTING THE UNIVERSITY-CITY PACT TO
DECREASE TOBACCO ACCESS TO MINORS. (24)
Gwen Norton-Perry, California State University San Bernardino,
5500 University Parkway, San Bernardino, CA, stated that 14 cities
will be involved in the University-City PACT. Funds are
appropriated from Proposition 99. An analysis of the city's
smoking ordinance will be conducted; focus groups will be convened
and an aggressive educational campaign will be launched as part of
PACT's efforts to reduce tobacco access to minors.
Council inquired how the surveys would be conducted and was
informed that the surveys could be handled by ward.
Council Member Miller made a motion, seconded by Council
Member Anderson, that said resolution be adopted.

CROSSING GUARD PROGRAM - SCHOOL SITES

Council Member Anderson submitted" Staff Report dated August
25, 1997, requesting that action be taken to ensure crossing guards
at school sites.
A petition of 183 signatures was presented In support of the
crossing guard program.
Council voiced discontent over the behavior exhibited by the
school district in that they publicized that the city would not be
funding the crossing guard program. The Council acknowledged that
Mayor Minor acted in good faith and had notified the school
district that for fiscal year 1997/98, the city would only be able
to allocate half the funding. It was suggested that the County of
San Bernardino's GAIN Division (Greater Avenues for Independence)
be used to employ crossing guards within the city.

stated that they have an intersection located at 9th'and Meridia~
within the City of San Bernardino and lee was prepared to ask the
council if they would consider sharing the cost of providing a
crossing guard.
Dr. Elsa Valdez, Mexican American Political Association, 748
W. Dover Drive, San Bernardino, CA, agreed with the council that it
is the school board's responsibility to address the school safety
issues. She stated that she attempted to have the matter placed on
the school board's agenda; however, she received a letter from
Larry Niegel, President of the Board of Education, stating that it
was not the school district's responsibility and the matter should
be directed to the city. Ms. Valdez voiced her displeasure of the
school board's actions.
The following individuals commended the Mayor and Council for
their actions in providing safety to our children:

Mayor Minor stated that when the school district decided to
implement year-round attendance, the costs associated with the
crossing-guard program increased. He explained the actions taken
by the city to address the needs of the youth and expressed his
support to fund crossing guards located beyond 1,000 feet of the
schools.
Council Member Oberhelman made a motion, seconded by Council
Member Anderson, and unanimously carried, that staff and City
Attorney Penman refine the program between the GAIN Division of the
San Bernardino County, Job and Employment Services Department,
relative to providing crossing guards at school sites; and that it
be brought back to the Mayor and Council meeting of September 15,
1997.

Agency, submitted a Staff Report dated August 27, 1997, concerning
the Arden Guthrie fourplex acquisition/rehabilitation project.
Director Winkler provided a synopsis of previous action taken
relative to the improvement of the Arde:l/Guthrie area and answered
questions regarding the intent for the property to be acquired.
A discussion was held regarding the costs for the acquisition
of said property, the provisions of Section 8 housing and actions
taken to rehabilitate the area.
Council Member Devlin made a motion, seconded by Council
Member Miller, that the Mayor and Common Council establish
September 15, 1997, at 2:00 p.m., as the date and time for a public
hearing to solicit citizen comments on the first amendment to the

1997/1998 fiscal year Third Year Action Plan; and that the Mayor
and Common Council direct Planning and Building Services and
Economic Development Agency staff to initiate a general plan
amendment and evaluate alternate future land uses, including
commercial and industrial, for the area bounded by 20th Street,
Guthrie Street, Highland and Arden Avenues.

Todd Hooks, Office of Business Development Manager, Economic
Development Agency, submitted a Staff Report dated August 28, 1997,
concerning an owner participation and employment linkage program
agreement with Garner Holt Productions, Inc.
Office of Business Development Manager Hooks provided a
synopsis of the action taken to provide financial assistance in the
amount of $150,000 for Garner Holt Productions, Inc., and an
employment linkage package in the amount of $25,000.
Council Member Arias made a motion, seconded by Council Member
Negrete, and unanimously carried, that the Mayor and Common
Council/Community Development Commission approve an assistance
package not to exceed $150,000 and an Employment Linkage Program
Agreement in an amount not to exceed $25,000 to Garner Holt
Productions, Inc., in accordance with Lle terms and conditions set
forth in the Staff Report dated August 28, 1997, from Todd Hooks,
Office of Business Development Manager; further, recommend that the
Agency Administrator be authorized to execute an Owner
Participation Agreement with Garner Holt Productions, Inc., and all
other implementing documentation; and finally, that the agency
budget be increased accordingly.
