ROLL CALL Roll call was taken by city Clerk Rachel Clark with the following being present: Mayor Minor; Council Members Negrete, Curlin, Oberhelman, Devlin, Miller; city Attorney Penman, city Clerk Rachel Clark, City Administrator Wilson. Absent: Council Members Arias, Anderson. CLOSED SESSION ANNOUNCEMENT - (Discussed earlier in the meeting - page 1) (1) City Attorney Penman announced that in closed session, in the matter of Greq Ward vs. City of San Bernardino - WCAB Case No. AHM 0041590, the Mayor and Council voted to approve a settlement of $40,000. PUBLIC COMMENTS - RUBEN LOPEZ (5) Ruben Lopez, 631 W. 16th Street, San Bernardino, CA, expressed concern regarding the comments being made about City Attorney Penman and Council Member Arias. PUBLIC COMMENTS - SUSAN ROGERS (5) Susan Rogers, a resident of San Bernardino, urged the city to establish a 4/10 workweek. PUBLIC COMMENTS - SHIRLEY THIEDI GOODWIN (5) Shirley Thiedi Goodwin, a resident of San Bernardino, expressed concern regarding the actions of personnel with the police and animal control departments in that she alleges that they wrongfully entered her home. Mayor Minor informed Ms. Goodwin that if she wished to put her concerns in writing, staff would investigate the matter. WAIVE FULL READING OF RESOLUTIONS & ORDINANCES (6) Council Member Curlin made a motion, seconded by Council Member Oberhelman, and unanimously carried, that full reading of the resolutions and ordinances on the regular and supplemental agendas of the Mayor and Common Council be waived. COUNCIL MINUTES (7) 4 8/4/1997 council Member Curlin made a motion, seconded by Council Member Oberhelman, and unanimously carried, that the minutes of the following meeting of the Mayor and Common Council of the City of San Bernardino be approved as submitted in typewritten form: June 25, 1997. CLAIMS & PAYROLL (8) Council Member Curlin made a motion, seconded by Council Member Oberhelman, and unanimously carried, that the claims and payroll and the authorization to issue warrants as listed on the memorandum dated July 30, 1997, from the Director of Finance be approved. PERSONNEL ACTIONS (9) Council Member Curlin made a motion, seconded by Council Member Oberhelman, and unanimously carried, that the personnel actions as submitted by the Chief Examiner dated July 24, 1997, in accordance with civil service rules and Personnel policies adopted by the Mayor and Common Council of the City of San Bernardino be approved and ratified. AN ORDINANCE OF THE CITY OF SAN BERNARDINO AUTHORIZING AN AMENDMENT TO THE CONTRACT BETWEEN THE BOARD OF ADMINISTRATION OF THE PUBLIC EMPLOYEES' RETIREMENT SYSTEM AND THE CITY OF SAN BERNARDINO. Final (13) Council Member Oberhelman made a motion, seconded by Council Member Curlin, and unanimously carried, that the matter be continued to the Mayor and Council meeting of August 18, 1997. RES. 97-235 - RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING COSTS OF ABATEMENT OF PUBLIC NUISANCES AND IMPOSING LIENS ON CERTAIN REAL PROPERTY LOCATED WITHIN THE CITY OF SAN BERNARDINO FOR THE COSTS OF THE ABATEMENT. (10) Susan Rogers, a resident of San Bernardino, expressed concern regarding the abatement process. Council Member Oberhelman made a motion, seconded by Council Member Negrete, that said resolution be adopted. Ayes: Nays: 5 8/4/1997 RES. 97-236 - RESOLUTION OF THE CITY OF SAN BERNARDINO URGING THE STATE BOARD OF EQUALIZATION TO ALLOCATE REVENUES FROM SALES TAX ON AIRCRAFT FUEL TO THE CITIES WHERE THE SALES ORIGINATE. (11) Council Member Oberhelman made a motion, seconded by Council Member Devlin, that said resolution be adopted. AUTHORIZE APPLICATION & ADMINISTRATION FEDERAL EMERGENCY MANAGEMENT AGENCY GRANT - $50,000 - EMERGENCY FOOD & SHELTER NATIONAL PROGRAM - FEMA XVI - WESTS I DE COMMUNITY SERVICE CENTER (12) Annie Ramos, Director of Parks, Recreation and community services, submitted a staff Report dated July 15, 1997, concerning the emergency food and shelter program administered at the Westside Community Service Center. Susan Rogers, a resident of San Bernardino, voiced support for approval of the matter. Council Member Oberhelman made a motion, seconded by Council Member Curlin, and unanimously carried, that the Parks, Recreation and Community Services Department Director be authorized to apply for and administer $50,000 of emergency food and shelter funds provided under the provision of the Emergency Food and Shelter National Program (FEMA XVI). RES. 97-237 - RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF FIRST AMENDMENT TO AGREEMENT WITH NATIONAL PLANT SERVICES, INC., FOR PROFESSIONAL SERVICES RELATIVE TO PROVIDING SPECIAL MAINTENANCE SERVICES FOR THE CITY'S SEWAGE SYSTEM. (14) Roger Hardgrave, Director of Public Works/City Engineer, answered questions concerning the request for bids, the project estimate and whether or not the services could be provided in- house. Council Member Curlin made a motion, seconded by Council Member Oberhelman, that said resolution be adopted. Ayes: Nays: Resolution No. 97-237 was adopted by the following vote: Council Members Negrete, Curlin, Oberhelman, Devlin, Miller. None. Absent: Council Members Arias, Anderson. 6 8/4/1997 RES. 97-238 - RESOLUTION OF THE CITY OF SAN BERNARDINO AMENDING RESOLUTION NO. 8234 ENTITLED, IN PART, "A RESOLUTION... ESTABLISHING PARKING TIME LIMITATIONS UPON CERTAIN DESIGNATED STREETS OR ALLEYS, OR PORTIONS THEREOF. . . ;" AND AUTHORIZING THE REMOVAL OF THE TWO-HOUR PARKING LIMITATION ON THE WEST SIDE OF "E" STREET BETWEEN BASE LINE STREET AND THIRTEENTH STREET. (15) Council Member Oberhelman made a motion, seconded by Council Member Devlin, that said resolution be adopted. Resolution No. 97-238 was adopted by the following vote: Ayes: Council Members Negrete, curlin, Oberhelman, Devlin, Miller. Nays: None. Absent: Council Members Arias, Anderson. AUTHORIZE MAYOR MINOR - SUBMIT BALLOT MEASURE ARGUMENT IN FAVOR - .5% INCREASE & EXTENSION TO THE CURRENT 8% - UTILITY USERS TAX (SERVICE USERS TAX) - NOVEMBER 4, 1997 ELECTION (16) Fred Wilson, City Administrator, submitted a Staff Report dated July 23, 1997, requesting authorization for Mayor Minor to submit the ballot measure argument in favor of the .5 percent (.5%) increase and extension to the established 8 percent (8%) service users tax. Council Member Negrete made a motion, seconded by Council Member Oberhelman, and unanimously carried, that Mayor Minor be authorized to submit a ballot argument in favor of the measure being submitted to the voters on November 4, 1997. related to whether or not the expiration date of June 30, 1998 be eliminated from Ordinance No. MC-820 so as to permit the City of San Bernardino to continue to collect and use the increased 0.5 percent (0.5%) service users tax beyond that date, and permit the Mayor to add additional co-authors to the argument as he deems appropriate. AN ORDINANCE OF THE CITY OF SAN BERNARDINO, CALIFORNIA, ADDING CHAPTER 3.80 TO THE CITY OF SAN BERNARDINO MUNICIPAL CODE ESTABLISHING A COST RECOVERY SYSTEM FOR BOOKING FEE COLLECTIONS. First (17A) RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING AN AGREEMENT WITH GC SERVICES LIMITED PARTNERSHIP TO COLLECT CRIMINAL JUSTICE ADMINISTRATION FEES FROM ARRESTED AND CONVICTED PERSONS ON BEHALF OF THE CITY OF SAN BERNARDINO. (17B) Council inquired about the cost for services and the term of the agreement. City Administrator Wilson explained that the contract was negotiated through a committee comprised of various cities within 7 8/4/1997 the County of calculated via rate. Concern was expressed relative to Item No 10 within said agreement concerning reevaluation of accounts. Council Member Curlin made a motion, seconded by Council Member Devlin, and unanimously carried, that the matter be continued to the Mayor and Council meeting of August 18, 1997. AUTHORIZE FUNDING - CIVIC & PROMOTIONAL FUND - $18,000 - SAN BERNARDINO WESTERN REGIONAL LITTLE LEAGUE BASEBALL ASSOCIATION - 1997 PLAYOFF GAMES - AUGUST 6-15, 1997 (18) Fred wilson, City Administrator, submitted a staff Report dated July 28, 1997, concerning a request for funding in the amount of $18,000 from the Western Regional Little League Baseball Association. Barbara Pachon, Director of Finance, submitted a memorandum dated August 4, 1997, concerning the civic and promotional fund balance. Council Member Oberhelman made a motion, seconded by Council Member Devlin, and unanimously carried, that direct funding from the fiscal year 1997/98 Civic and Promotion Fund in the amount of $5,000 and indirect funding for departmental costs in an amount not-to-exceed $13,000, be authorized to assist the San Bernardino Western Regional Little League in the 1997 playoff games. RES. 97-239 - RESOLUTION OF THE CITY OF SAN BERNARDINO REQUESTING THE CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT SYSTEM EXTEND THE FUNDING PERIOD FOR CURRENT AND PRIOR SERVICE ACTUARIAL LIABILITIES. (19) Council Member Oberhelman made a motion, seconded by Council Member Devlin, that said resolution be adopted. Ayes: Nays: Resolution No. 97-239 was adopted by the following vote: Council Members Negrete, Curlin, Oberhelman, Devlin, Miller. None. Absent: Council Members Arias, Anderson. BAN SALE & DISCHARGE OF FIREWORKS - POLICY & PROCEDURES - (20) Mayor Minor submitted a Staff Report dated July 24, 1997, recommending that the sale and discharge of fireworks be banned. 8 8/4/1997 Rachel Clark, City Clerk, submitted a memorandum dated August 4, 1997, outlining the number of vendors within the city who sold fireworks during the 1997 season. Dennis C. Revell, Revell communications, 1121 "L" street, suite 806, Sacramento, CA, submitted a facsimile dated August 1, 1997, opposing the banning of the sale and discharge of fireworks. The following individuals voiced opposition to the banning of the sale and discharge of fireworks: Virginia Lamb, Del Rosa Federated Women, 108 W. cypress, Redlands, CA. Council Member Negrete made a motion that the matter be referred to the Ways and Means Committee to find funding for the various non-profit organizations; and, if funds are not available, do not change the ordinance. The motion failed for lack of a second. A discussion was held concerning the pros and cons of the use of fireworks. Council commended staff for the presentation of the Staff Report. Council Member DISCUSS IMPLEMENTATION - STRICTER GRAFFITI PENALTIES - REMEDIES - GRAFFITI ABATEMENT (21) council Member Negrete submitted a Staff Report dated July 29, 1997, recommending the implementation of stronger penalties for graffiti offenders. City Attorney Penman explained that the juvenile courts do not impose the stricter penalties imposed by the cities because by law they have to adhere to the Welfare Institutions Code. However, he was advised by the Judge Elect that they are currently ordering juveniles to participate in graffiti abatement programs if they are established by the city. A discussion was held concerning the state provisions for the abatement of graffiti and the steps being taken by the city to eliminate graffiti. Susan Rogers, a resident of San Bernardino, expressed concern regarding the relationship between the police department and the residents within the city. ~ counci 1 Member Negrete made a motion. (continued from July 21, 1997) (22A) RES. 97-241 - RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AUTHORIZING THE PURCHASE OF A CITY NETWORK UPGRADE FROM SPIRE TECHNOLOGIES, INC. (Continued from July 21, 1997) (22B) RES. 97-242 - RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AUTHORIZING THE MODIFICATION OF EXISTING PUBLIC SAFETY DISPATCH CONSOLES AND THE UPGRADING OF DISPATCH "READY RECALL RECORDERS." (Continued from July 21, 1997) (22C) 10 8/4/1997 RES. 97-243 - RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AUTHORIZING THE MOVEMENT AND UPGRADING OF THE POLICE DEPARTMENT'S SECURE CLETS (CALIFORNIA LAW ENFORCEMENT TELECOMMUNICATIONS SYSTEM) LINK FROM CITY HALL TO THE CENTRAL POLICE FACILITY. (continued from July 21, 1997) (220) City Administrator wilson provided a synopsis of the action taken for the city's computer system upgrade. Janis Ingels, Director of Management Information Services (MIS), provided an overview of the request for proposal process and answered questions concerning the allocation of funds. Council expressed concern regarding the 10-year financing plan and the need for upgraded equipment within the next 10 years. Council inquired if a non-DEC system had been considered and requested that the use of technology leases be pursued and annual payments be allocated. A discussion was held concerning an annual allocation of funds to meet the city's future technology needs. Director Ingels explained that a non-DEC system and leases were considered, however, both were more expensive; and answered questions relative to the leasing options that were considered. ~ A discussion ensued regarding the personnel required to meet the demands of the MIS Division. Council Member Negrete made a motion, seconded by Council Member Miller, that said resolutions be adopted; and that the adequacy of current MIS staffing levels to support the network upgrade project be referred to the Council Personnel Committee. The motion carried and Resolution Nos. 97-240, 97-241, 97-242 and 97-243 were adopted by the following vote: Ayes: Council Members Negrete, Curlin, Devlin, Miller. Nays: Council Member Oberhelman. Absent: Council Members Arias, Anderson. RESPONSE NORCAL PROPOSAL WASTE DISPOSAL PARTICIPATION & SERVICE AGREEMENT PUBLIC SERVICES DEPARTMENT - (Continued from July 21, 1997) (23) Mayor Minor submitted a Staff Report dated July 29, 1997, requesting that further negotiations with Norcal be discontinued. Council Member Devlin made a motion, seconded by Council Member Negrete, that the matter be continued to the Mayor and Council meeting of October 6, 1997. (Note: There was no vote taken. ) 11 8/4/1997 council Member Oberhelman made a substitute motion, seconded by Council Member Miller, that the matter be continued to the Mayor and Council meeting of September 2, 1997. The substitute motion carried by the following vote: Ayes: Council Members Negrete, Curlin, Oberhelman, Miller. Nays: Council Member Devlin. Absent: Council Members Arias, Anderson. RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AUTHORIZING AN AMENDMENT TO THE CONTRACT WITH DELOITTE & TOUCHE LLP FOR THE COMPLETION OF AN APPRAISAL OF THE CITY'S REFUSE OPERATION. (Sl) City Administrator wilson explained the circumstances leading to the increase in costs for the appraisal of the city's refuse operation. Due to the lack of a motion, no action was taken on this matter. City Administrator Wilson inquired about the action to be taken if Deloitte & Touche LLP does not supply the report without the additional funding. Mayor Minor directed city Administrator Wilson to bring the matter back for consideration by the Mayor and Council. ~ RES. 97-244 - RESOLUTION OF THE CITY OF SAN BERNARDINO ADDING AND DELETING VARIOUS CITY POSITIONS FOR THE PURPOSE OF CODIFYING PRIOR COUNCIL ACTIONS AND REPEALING RESOLUTIONS NO. 6433, SECTION FOUR, AND NO. 96-118. (S2) Council inquired about the allocation of funds from the Economic Development Agency for the Assistant to the Council position that should have been deleted from the city's list of authorized positions. Barbara Pachon, Director of Finance, stated that the position was to be deleted; however, Council is substituting said position with another one. Jorge Carlos, Executive Assistant to the Council, stated that the position was only to be deleted for the fiscal year 1997/98. Therefore, it will only remain vacant. Council Member Devlin made a motion, seconded by Council Member Oberhelman, that said resolution be adopted. Resolution No. 97-244 was adopted by the following vote: Council Members Negrete, curlin, Oberhelman, Devlin, Miller. None. Absent: Council Members Arias, Anderson. YEAKEL - (Continued from July 21, 1997) (24) Michael Hays, Director of Planning and Building Services, submitted a Staff Report dated July 22, 1997, concerning General Plan Amendment No. 97-02 to change the land use designation from RS, Residential Suburban, to RU-2, Residential Urban, on 23 parcels located between 16th and 17th Streets. ~ Mayor Minor opened the hearing. City Attorney Penman stated that written notice was given to the applicant, and city Clerk Rachel Clark announced that a phone call had been made to notify the applicant. Council Member Oberhelman made a motion, seconded by Council Member Negrete, and unanimously carried, that the hearing be closed; and that the Mayor and Common Council adopt the findings of fact for denial of General Plan Amendment No. 97-02. NOTE: Community Development Commission items which require action by the Mayor and Common Council are denoted by the letter "R" and are reflected herein. Minutes of actions taken on Community Development Commission items are distributed separately by the Economic Development Agency. ANNOUNCEMENT - MAYOR MINOR (4) Mayor Minor announced that due to a family emergency, Council Member Miller would not be able to attend the afternoon portion of the meeting. ~ PUBLIC COMMENTS - ESTHER ESTRADA (5) Esther Estrada, a resident of San Bernardino, stated that Casa Ramona will be sponsoring an event called "Summer of 42" on August 16, 1997, at 7:00 p.m., 1524 West 7th street, in honor of the Hispanic veterans from World Wars I and II, and the Korean and vietnam wars. Names will be placed on a plaque to be housed in the new Casa Ramona building. If the public is aware of any individuals involved in said wars, please contact Lucy or Marina at 889-0011. WAIVE FULL READING OF RESOLUTIONS & ORDINANCES (R2) Council Member Oberhelman made a motion, seconded by Council Member Negrete, and unanimously carried, that full reading of the resolutions on the regular agenda of the Community Development Commission/ San Bernardino Joint Powers Financing Authority/San Bernardino Park Acquisition Joint Powers Financing Authority/San Bernardino Associated Communities Financing Authority and Mayor and Common Council, be waived. ARDEN-GUTHRIE REHABILITATION - 20 FOURPLEXES & 1 DAMAGED BUILDING ACQUISITION 20TH & GUTHRIE STREETS AND HIGHLAND & ARDEN AVENUES INITIATE GENERAL PLAN AMENDMENT (RS) 14 8/4/1997 Ronald Winkler, Development Director, Economic Development Agency, submitted a staff Report dated July 29, 1997, concerning the rehabilitation and acquisition of properties located within the Arden-Guthrie area. Keith Reno, 1400 Edgehill Road, San Bernardino, CA, expressed concern about the city acquiring said properties for the demolition of such and stated that he would like to be a part of future discussions relative to the land use. Agency Administrator Steinhaus answered questions regarding rent payments made through section 8 participants and explained that the city would be acquiring the property and renting such on a temporary basis. However, eventually the property will be disposed of. council Member Devlin made a motion, seconded by Council Oberhelman, that the Mayor and Common Council direct Planning & Building Services and Economic Development Agency staff to initiate a general plan amendment and evaluate alternate future land uses, including commercial and industrial for the area bounded by 20th street, Guthrie street, and Highland and Arden Avenues. The motion failed by the following vote: Ayes: Council Members Negrete, Oberhelman, Devlin. Nays: Council Member Curlin. Absent: Council Members Arias, Anderson, Miller. Mayor Minor directed staff to place the matter on the agenda for the meeting of August 18, 1997. ECONOMIC DEVELOPMENT AGENCY - FISCAL YEAR 1997/98 BUDGET - ADOPT (R9) RES. 97-245 - RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA, PERTAINING TO THE TRANSFER OF THE TELECOMMUNICATIONS DIVISION OF THE CITY OF SAN BERNARDINO TO THE COMMUNITY DEVELOPMENT COMMISSION AND DELETING CERTAIN CITY POSITIONS. (R9) Timothy Steinhaus, Agency Administrator, Economic Development Agency, submitted a Staff Report dated July 30, 1997, concerning the agency's fiscal year 1997/98 budget. Agency Administrator steinhaus provided an overview of the Economic Development Agency's fiscal year 1997/98 budget. Barbara Lindseth, Administrative Division Manager, Economic Development Agency, explained the compilation of the fiscal year 1997/98 budget. Agency Administrator steinhaus answered questions concerning the sources of revenue. 15 8/4/1997 council Member Negrete made a motion, seconded by Council Member Devlin, that said resolution be adopted.
