HomeMy WebLinkAbout07-03-2001 Minutes MINUTES MAYOR AND COMMON COUNCIL AND COMMUNITY DEVELOPMENT COMMISSION OF THE CITY OF SAN BERNARDINO JOINT ADJOURNED REGULAR MEETING JULY 3, 2001 ECONOMIC DEVELOPMENT AGENCY BOARDROOM This is the time and place set for a joint adjourned regular meeting of the Mayor and Common Council and Community Development Commission of the City of San Bernardino from the joint adjourned regular meeting held at 4: I3 p.m., Tuesday, June 26, 2001, in the Economic Development Agency Boardroom, 201 N. "E" Street, San Bernardino, California. At 10 a.m., a quorum was not present and Deputy City Clerk Hartzel announced that the meeting would commence at 12 noon. The joint adjourned regular meeting of the Mayor and Common Council and Community Development Commission was called to order by Mayor Valles at 12:19 p.m., Tuesday, July 3, 2001, in the Economic Development Agency Boardroom, 201 North "E" Street, San Bernardino, California. ROLL CALL Roll call was taken by City Clerk Clark with the following being present: Mayor Valles; Council Members Estrada, Lien, Schnetz, Suarez, McCarnmack; City Attorney Penman, City Clerk Clark, City Administrator Wilson. Absent: Council Members McGinnis, Anderson. City Attorney Penman armounced that the following pending cases would be discussed in closed session: Ezzat Soliman v. City of San Bernardino - United States District Court Case No. EDCV 00-301 V AP (RCx); City of San Bernardino Municipal Water Department v. United States Department of the Army - United States District Court Case No. CV 96-8867, consolidated with CV 96-5205. RECESS MEETING - CLOSED SESSION (1) At 12:19 p.m., the Mayor and Common Council and Community Development Commission recessed to closed session for the following: 1 7/3/2001 Pursuant to Government Code Section(s): A. Conference with legal counsel - existing litigation - pursuant to Government Code Section 54956.9(a). B. Conference with legal counsel - anticipated litigation - significant exposure to litigation - pursuant to subdivision (b) (1), (2), (3) (A-F) of Government Code Section 54956.9. C. Conference with legal counsel - anticipated litigation - initiation of litigation - pursuant to subdivision (c) of Government Code Section 54956.9. D. Closed Session - personnel - pursuant to Government Code Section 54957. E. Closed session with Chief of Police on matters posing a threat to the security of public buildings or threat to the public's right of access to public services or public facilities - pursuant to Government Code Section 54957. F. Conference with labor negotiator - pursuant to Government Code Section 54957.6. G. Conference with real property negotiator - pursuant to Government Code Section 54956.8. CLOSED SESSION At 12:20 p.m., Mayor Valles called the closed session to order in the Economic Development Agency Boardroom. ROLL CALL Roll call was taken by City Clerk Clark with the following being present: Mayor Valles; Council Members Estrada, Lien, Schnetz, Suarez, McCarnmack; City Attorney Penman, City Clerk Clark, City Administrator Wilson. Absent: Council Members McGinnis, Anderson. Also present: Senior Assistant City Attorney Carlyle, Deputy City Attorney Easland, and Administrative Operations Supervisor Anderson, City Attorney's Office; Executive Director Van Osdel, Director of Housing and Community Development Pacheco, and Special Counsel Sabo, Economic Development Agency; Bernard Kersey, General Manager, Water Department. 2 7/3/2001 COUNCIL MEMBER ANDERSON ARRIVED At 12:21 p.m., Council Member Anderson arrived at the closed session. ADJOURN CLOSED SESSION At 2:53 p.m., the closed session adjourned. RECONVENE MEETING At 2:53 p.m., Mayor Valles reconvened the joint adjourned regular meeting of the Mayor and Common Council and Community Development Commission. ROLL CALL Roll call was taken by City Clerk Clark with the following being present: Mayor Valles; Council Members Estrada, Lien, Schuetz, Suarez, Anderson, McCammack; City Attorney Penman, City Clerk Clark, City Administrator Wilson. Absent: Council Member McGinnis. CLOSED SESSION ANNOUNCEMENT (1) City Attorney Penman announced that the following action had been taken in closed session: The Mayor and Common Council unanimously voted to approve an agreement with Ezzat Soliman in the case of Soliman v. City of San Bernardino, which calls for the City to pay $80,000 within 30 days of execution of the agreement, and for Mr. Soliman to cease operation of his business on July 23, 2001; further, that no performances or concerts will be staged or conducted by Mr. Soliman or any of his business associates after July 23, 2001. The agreement also releases the City from any liability from a claim filed by Mr. Soliman on May 17,2001, arising from his arrest at the MasterDome by the San Bernardino Police Department on November 18, 2000. ADJOURNMENT (2) At 2:54 p.m, the meeting adjourned. The next joint regular meeting of the Mayor and Common Council and Community Development Commission will he held at 8 a.m., Monday, July 9, 2001, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California.
