Pursuant to Resolution No. 2002-65, the City Clerk or her designee shall appear in the Council Chambers at 8:00 a.m. on the first and third Mondays in the months of May, June, and July, 2002, and shall continue each Mayor and Common Council meeting to 1:30 p.m. that same day. The joint regular meeting of the Mayor and Common Council and Community Development Commission of the City of San Bernardino was called to order by Mayor/Chairman Valles at 1:46 p.m., Monday, May 6,2002, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. Appointment Harry Carson Member/Commissioner Anderson Bureau of Franchises Council (2A) Council Member/Commissioner McCammack made a motion, seconded by Council Member/Commissioner Anderson, that the appointment of Harry Carson to the Bureau of Franchises, as requested by Council Member/Commissioner Anderson, be approved. Proclamations & Presentations A proclamation designating the week of May 5-11, 2002, as "National Arson Awareness Week" was accepted by Fire Marshall Doug Dupree. A proclamation designating the week of May 12-18, 2002, as "National Nursing Home Week" was accepted by Steve Montelli, Administrator of Hacienda Health Care, Activities Director Patricia Webster, and Lillian Latian and her son, James Latian. Teri Rubi, Executive Assistant to the Mayor, read a proclamation designating May 15,2002, as "Retired and Senior Volunteers Day." Wendy Mattioli, Publisher of the Business Press; Maria DeVarenne, Editor of the Press Enterprise; and Brian Fike, Marketing Consultant for BELO Marketing Solutions, expressed thanks to the City of San Bernardino, and especially Mayor Valles, for her support and leadership in working to break down barriers and build a more inclusive community. Mayor Valles presented Ambassador of Goodwill Certificates to Len Cooper, Principal of Burbank Elementary School, and Brian Crowell, City firefighter and paramedic, for being chosen as part of a five-member team that will be going to Brazil for one month to participate in the Group Study Exchange sponsored by Rotary International. 5 05/06/2002 4. Announcements Mayor/Chairman Valles requested that a moment of silence be observed in memory of Clarence "Mac" McDonald and Floeta Strano, both longtime residents of San Bernardino, and Esther Pitzer, mother of Fire Chief Larry Pitzer. Announcements were made by Mayor Valles, members of the Common Council, elected officials, and the Chamber of Commerce regarding various civic, community, and chamber events/activities. Fred Wilson, City Administrator, provided an update on the City's public works projects. 5. Waive Full Reading of Resolutions & Ordinances Council Member/Commissioner Anderson made a motion, seconded by Council Member/Commissioner Suarez, that full reading of the resolutions and ordinances on the regular agenda of the Mayor and Common Council/Community Development Commission, be waived. Council Minutes Council Member/Commissioner Anderson made a motion, seconded by Council Member/Commissioner Suarez, that the minutes of the following meetings of the Mayor and Common Council/Community Development Commission of the City of San Bernardino, be approved as submitted in typewritten form: February 4, 2002; March 18, 2002; and April 1, 2002. Claims & Payroll Council Member/Commissioner Anderson made a motion, seconded by Council Member/Commissioner Suarez, that the claims and payroll and the authorization to issue warrants as listed on the memorandum dated April 24, 2002 from Barbara Pachon, Director of Finance, be approved. Personnel Actions Council Member/Commissioner Anderson made a motion, seconded by Council Member/Commissioner Suarez, that the personnel actions as submitted by the Chief Examiner dated May 1, 2002, in accordance with Civil Service rules and Personnel policies adopted by the Mayor and Common Council of the City of San Bernardino, be approved and ratified. RES. 2002-123 - Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the execution of a Professional Services Agreement between Lewis, D' Amato, Brisbois & Bisgaard and the City of San Bernardino to represent the City in litigatiou against the CYSA-South San Bernardino Soccer Foundation, et al. Council Member/Commissioner Anderson made a motion, seconded by Council Member/Commissioner Suarez, that said resolution be adopted. Set dinner workshop - May 20,2002 - 5 p.m. - Economic Development Agency (EDA) Boardroom - presentation by City Staff, Stantec and Psomas - Draft FY 2002/03 - FY 2006/07 Capital Improvement Program, Pavement Management System, & Sewer Master Plan Council Member/Commissioner Anderson made a motion, seconded by Council Member/Commissioner Suarez, that the Mayor and Common Council set a dinner workshop for Monday, May 20, 2002, at 5 p.m. in the Economic Development Agency (EDA) Boardroom to hear a presentation by City Staff, Stantec, and Psomas relative to the draft FY 2002/03 - FY 2006/07 Capital Improvement Program (CIP), Pavement Management System, and Sewer Master Plan. RES. 2002-130 - Resolution of the City of San Bernardino authorizing the Mayor to execute Amendment No.4 to the agreement with Milford Wayne Donaldson, FAIA Inc. for bidding assistance/construction observation for the renovation and retrofit of the San Bernardino Santa Fe Depot. 7 05/06/2002 Council Member/Commissioner McCammack made a motion, seconded by Council Member/Commissioner Anderson, that said resolution be adopted. RES. 2002-124 - Resolution of the City of San Bernardino declaring its intention to order the vacation of a portion of Juniper Drive, northerly of Willow Drive, and a portion of Willow Drive, easterly of Juniper Drive. Council Member/Commissioner Anderson made a motion, seconded by Council Member/Commissioner Suarez, that said resolution be adopted; and that the Director of Finance be authorized to amend the FY 2001/02 budget and appropriate $5,300 from Account No. 243-000-3405-000 (Unallocated Fund Balance - Parks Construction Fund) to Account No. 243-363-5505 (Perris Hill Senior Center Expansion Design). RES. 2002-126 - Resolution of the City of San Bernardino authorizing the execution of a cooperative agreement between the City of San Bernardino and the City of Highland for construction of street improvements on Boulder Avenue between Atlantic Avenue and Baseline Street. Approve - Contract Change Order No. One - Silvia Construction, Inc. - $97,319.00 - extending the limits of the pavement rehabilitation on 40th Street to include the reach from east of Sierra Way to Electric Avenue - per Plan No. 10240 Council Member/Commissioner Estrada made a motion, seconded by Council Member/Commissioner Suarez, that the Mayor and Common Council authorize the execution of Change Order No. One in the amount of $97,319.00 to the contract with Silvia Construction, Inc. extending the limits of the pavement rehabilitation on 40th Street to include the reach from east of Sierra Way to Electric Avenue. The motion carried by the following vote: Ayes: Council Members/Commissioners Estrada, Lien, Derry, Suarez, Anderson, McCammack. Nays: None. Absent: Council Member/Commissioner McGinnis. 16. RES. 2002-131 - Resolution of the City of San Bernardino authorizing the Mayor to execute an Agreement with Fourth Street Rock Crusher, a California Corporation, for the design and construction of the Phase IB and III State Street improvements and the design and installation of a traffic signal at the intersection of State Street and Fifth Street. Council Member/Commissioner Estrada made a motion, seconded by Council Member/Commissioner Suarez, that the Mayor and Common Council authorize the Mayor to execute an agreement with Fourth Street Rock Crusher for the design and construction of the Phase IB and III State Street improvements between 5th Street and Arroyo Valley High School entrance and the design and installation of a traffic signal at the intersection of State Street and 5th Street; and that said resolution be adopted. The motion carried and Resolution No. 2002-131 was adopted by the following vote: Ayes: Council Members/Commissioners Estrada, Lien, Derry, Suarez, McCammack. Nays: None. Abstentions: Council Member/Commissioner Anderson. Absent: Council Member/Commissioner McGinnis. 17. RES. 2002-132 - Resolution of the City of San Bernardino authorizing the Mayor to execute Amendment No. 1 to the Agreement with Fourth Street Rock Crusher, a California Corporation, and the San Bernardino City Unified School District for the design and construction of the Phase 1 road improvements to State Street and the design and installation of a traffic signal at the intersection of State Street and Baseline Street. 9 05/06/2002 Council Member/Commissioner Estrada made a motion, seconded by Council Member/Commissioner Suarez, that the Mayor and Common Council authorize the Finance Director to amend the Fiscal Year 2001/02 budget to reflect $81,000 in revenue (and associated expense) received from the San Bernardino Unified School District; and that said resolution be adopted. The motion carried and Resolution No. 2002-132 was adopted by the following vote: Ayes: Council Members/Commissioners Estrada, Lien, Derry, Suarez, McCammack. Nays: None. RES. 2002-133 - Resolution of the Mayor and Common Council of the City of San Bernardino amending Agreement No. 01-124 with the City of Inglewood relating to the processing of parking citations. Council Member/Commissioner Suarez made a motion, seconded by Council Member/Commissioner Anderson, that said resolution be adopted. Resolution of the Mayor and Common Council of the City of San Bernardino awarding Heisler Landscape and General Engineering & Dave Bang Associates, Inc. a purchase order for the installation of playground equipment and surfaciug at (11) park locations in accordance with Bid Specifications F-02-035, Anne Shirrells Park, Nicholson Park, Hudson Park, Kerwin Park, Speicher Park, Nunez Park, Mill Center Park, L}tle Creek Park, Encanto Park, Newberry Park, and Tom Gould Park. Council Member/Commissioner Anderson made a motion, seconded by Council Member/Commissioner McCammack, that the matter be tabled. RES. 2002-127 - Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the Mayor of the City of San Bernardino or her designee to apply for and administer a grant in the amount of $223,303.20 from California Department of Education for the administration of the Summer Food Service Program for Youth. RES. 2002-134 - Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the Mayor, or her designee, to sign a Memorandum of Understanding between the City and AFE-Pioneer Associates, L.P., for the provision of Police Department overtime patrol services in the area that includes Saint Bernardine's Plaza and Pioneer Plaza Retirement Homes through a New Approach Anti Drug (NAAD) Grant. Council Member/Commissioner Estrada made a motion, seconded by Council Member/Commissioner McCammack, that said resolution be adopted. Resolution No. 2002-134 was adopted by the following vote: Ayes: Council Members/Commissioners Estrada, Lien, Derry, Suarez, Anderson, McCammack. Nays: None. Absent: Council Member/Commissioner McGinnis. 22. Resolution of the City of San Bernardino authorizing the Chief of Police to file a Going Home - Serious and Violent Offender Reentry Initiative Grant application with the U.S. Departments of Justice, Labor, Health and Human Services, Education and Housing and Urban Development. City Attorney Penman stated that the application was incomplete and there were some areas that appeared to be inconsistent with some of the positions the City is presently taking in its legislative advocacy in Sacramento. He indicated that some statements were made at the Grant Committee meeting that the application could be contrary to the City's Municipal Code/Development Code. Council Member/Commissioner McCammack made a motion, seconded by Council Member Commissioner Anderson, that the resolution be adopted, subject to approval by the City Attorney. City Attorney Penman stated that because changes to the application could be substantive, he would prefer that the Council continue the matter to a date prior to the date it must be submitted, or May 15,2002. Council Member/Commissioner McCammack withdrew her motion and Council Member/Commissioner Anderson withdrew her second. Council Member/Commissioner Anderson made a motion, seconded by Council Member/Commissioner Estrada, that the matter be continued to a Council/Commission meeting on May 13,2002, at 3 p.m., in the Council Chambers of City Hall. 11 05/06/2002 The motion carried by the following vote: Ayes: Council Members/Commissioners Estrada, Lien, Derry, Suarez, Anderson, McCammack. Resolution of the Mayor and Common Council of the City of San Bernardino authorizing an increase to the annual purchase orders to Matich Corporation and Vulcan Materials/Cal Mat Division to supply materials for roadway pavement repairs. Council Member/Commissioner Anderson made a motion, seconded by Council Member/Commissioner McCammack, that the matter be continued to the Council/Commission meeting of May 20, 2002. The motion carried by the following vote: Ayes: Council Members/Commissioners Lien, Derry, Suarez, Anderson, McCammack. Nays: None. Abstentions: Council Member/Commissioner Estrada. RES. 2002-128 - Resolution of the Mayor and Common Council of the City of San Bernardino authorizing an increase to a purchase order to Fairview Ford for two (2) additional 2002 mid-size 4-door sedans to be utilized by the Fire Department. Council Member/Commissioner Anderson made a motion, seconded by Council Member/Commissioner Suarez, that said resolution be adopted. TEFRA hearing - Housing Authority of the County of San Bernardino issuance of Multi-Family Revenue Bonds - Santiago Hillside Mobile Home Park and Santiago Orangewood Mobile Home Park RES. 2002-135 - Resolution of the Mayor and Common Council of the City of San Bernardino approving the issuance of Multi-Family Revenue Housing Bonds by the Housing Authority of the County of San Bernardino ("Authority") for the Santiago Hillside Mobile Home Park in the principal amount of $2.8 million and the Santiago Orangewood Mobile Home Park in the principal amount of $4 million. Mayor/Chairman Valles opened the hearing. Maggie Pacheco, Economic Development Agency Director of Housing and Conununity Development, provided background information. Council Member/Conunissioner Lien asked if the refinance would have any impact on the residents located in any of the parks in terms of rental space fees. Ms. Pacheco stated that she was not aware of any increases and that bonds were being issued predicated upon existing rents and existing cash flow coming in from the parks. 16 05/06/2002 Special Counsel Sabo stated that it was his understanding that no rent increases were being proposed, and he explained that any rent increases would have to go through the Mobile Home Board and they would have to provide notice to all the residents. Council Member/Conunissioner Suarez made a motion, seconded by Council Member/Conunissioner Estrada, that the hearing be closed; that said resolution be adopted; and that the Conununity Development Conunission accept certain loan repayments from the Santiago Hillside Mobile Home Park and Santiago Orangewood Mobile Home Park Corporations (the "Corporation") in the aggregate approximate amount of $896,000 and authorize the Redevelopment Agency of the City of San Bernardino ("Agency") to re-loan said funds to the Corporation in accordance with the refinancing plan discussed by the Conunission on January 8, 2001 and April 16, 2001. Magnolia Drive, San Bernardino, CA, stated that he attended a baseball game at the Arrowhead Credit Onion Park over the weekend, and they were giving away a bobblehead doll to the first 2000 attendees; however, the bobblehead doll that was advertised in the paper was not the doll that was given out. He felt this was a case of false advertising and asked the Council if they would look into the matter. Bob Neves, 2348 Sterling Avenue, #439, San Bernardino, CA, thanked the Council for holding evening meetings and for providing a better opportunity for members of the public to provide input. He asked if the Council was considering the approval of a grant to encourage people that park at the Metrolink parking lot to carpool. Mr. 17 05/06/2002 Neves stated that as a two-year user of Metrolink, he has to catch an earlier train because if he doesn't get there by 8 a.m., the parking lot is full. He stated that he hoped the City would provide more parking at the Metrolink parking lot, especially disabled access parking, to encourage more service there. Gus Prestridge, 1192 E. Sonora Street, San Bernardino, CA, stated that approximately 30 percent of the parking at the Metrolink parking lot is being used by vanpools. He indicated that unlike neighboring cities, the City of San Bernardino does not have a "park and ride" facility, so people are going to the only place they can park, which is at the Metrolink Station. 38.
