HomeMy WebLinkAbout02-21-1990 Minutes City of San Bernardino, California February 21, 1990 This is the time and place set for a joint Adjourned Regular Meeting of the Mayor and Common Council and Planning Commission of the City of San Bernardino at their regular meeting held at 8:34 a.m., on Monday, February 19, 1990, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. The City Clerk has caused to be posted the order of adjournment of said meeting held on February 19, 1990, and has on file in the office of the City Clerk an affidavit of said posting together with a copy of said order which was posted at 9:00 a.m., Tuesday, February 20, 1990, on the door of the place at which said meeting was held. The joint Adjourned Regular Meeting of the Mayor and Common Council and Planning Commission of the City of San Bernardino was called to order by Mayor Pro Tempore Flores at 1:35 p.m., Wednesday, February 21, 1990, in the Kellogg Room, Feldheym Library, 555 West Sixth Street, San Bernardino, California. ROLL CALL Roll call was taken by City Clerk Clark with the following being present: Mayor Pro Tempore Flores, Council Members Reilly, Flores, Maudsley, Minor, Pope-Ludlam, Miller; Deputy City Attorney Empeno, City Clerk Clark, City Administrator Julian. Absent: Mayor Holcomb, Council Member Estrada. PUBLIC COMMENTS There were no public comments. ( 1) COUNCIL MEMBER ESTRADA ARRIVED At 1:38 p.m., Council Member Estrada arrived at the Council Meeting. PRELIMINARY DRAFT DEVELOPMENT CODE PRESENTATION - Article I - General provisions John Montgomery, Principal Planner, gave a presentation of the City of San Bernardino Development Code Preliminary Draft. He stated that the purpose of the Development Code is to promote the public health, safety, general welfare and preserve and enhance the aesthetic quality of the City by providing regulations to ensure an appropriate mix of land uses in an orderly manner. The Development Code combines zoning and subdivision regulations of Title 18 and Title 19 of the San Bernardino Municipal Code into one document. (2 & 3) 1 2/21/90 John Montgomery gave a brief description of each of the four articles found in the preliminary draft Development Code. Development Review Committee (DRCl John Montgomery recommended that the urban design professional, a member of the Development Review Committee, be selected from city staff to comply with the guidelines set forth in the General Plan. MAYOR HOLCOMB ARRIVED At 1:42 p.m., Mayor Holcomb arrived at the Council Meeting and replaced Mayor Pro Tempore Flores. Environmental Review Committee Hearinq Officer The Mayor and Council discussed a environmental hearing officer in place review committee. vs. Environmental proposal of the for using an environmental Council Member Maudsley made a motion, seconded by Council Member Flores, that the environmental review committee remain the same. The motion carried by the following vote: Ayes: Council Members Reilly, Flores, Maudsley, Minor, Pope-Ludlam, Miller. Noes: None. Abstain: Council Member Estrada. Definitions Mr. Montgomery recommended that changes be definition section of the draft Development Code follows: made in the (19.02.050) as Page 1-7, Boarding House: " 5" be changed to "7". Certificate of Occupancy: "Building and Safety Department" be changed to read "Planning and Building Services Department". Page 1-9, Development Code: "Code" be changed to read "Development Code". Page 1-13, Hotels: "All rooms" be changed to read "Most rooms II . Page 1-14 The numbers per square feet be changed to reflect lot averaging for "RL" designations. Page 1-15 Lot Averaging: that the following statement be added: "The density shall be in compliance with the Development Code and General Plan". 2 2/21/90 Page 1-18 Setback, Front Average: Average" be changed to read Rear Average". "Setback, Front "Setback, Front & The Council discussed the definition of manufactured homes. Mr. Montgomery stated that he will provide a better definition of manufactured homes. The Council discussed the definition of senior housing and the provision to allow individual private kitchens. Mr. Montgomery stated that the title "Senior Housing" will be changed to read "Senior Congregate Housing" on page 1-18 of the draft Development Code. John Montgomery stated that definitions needed to be added for Small Lot Subdivision on page 1-20, and Traffic Safety Site Area on page 1-21. Establishment of Land Use Districts Under the provisions of Section 19.02.060 the City of San Bernardino is divided into land use districts which consistently implements the General Plan. The following changes have been made to the list of land use districts: CR-4 (Commercial Regional - Auto Plaza has been removed and redesignated as CG-l (Commercial General District); The Public Flood Control (PFC), Public Recreational (PCR), and Public Parks (PP) all have been combined into one district called Open Space; and the Central City South District has been deleted. A discussion ensued regarding the reason for redesignating CR-4 (Auto Plaza) auto related uses, to CG-l Commercial General. Larry Reed, Director of Planning and Building Services, stated that his department misinterpreted the direction of this particular land use district. He stated that clear direction is needed in order to keep the auto plaza area as an auto related use. Mayor Holcomb stated that there is a deed restriction already in place concerning the Auto Plaza area. He explained how the deed restriction prohibits any other type use in the Auto Plaza area. Larry Reed questioned the possibility of using the Auto Plaza zone designation for other locations in the city. Members of the Planning Commission pointed out that during the General Plan deliberations, the designation of CR-4 was established strictly for the Auto Plaza area. 3 2/21/90 Council Member Maudsley made a motion, Member Pope-Ludlam and unanimously carried, designations for the Auto Plaza area remain General Plan (CR-4). seconded by Council that the land use the same as in the A discussion ensued regarding the Central City South land use designation being removed from the land use district list. Council Member Maudsley made a motion, seconded by Council Member Pope-Ludlam and unanimously carried, that the land use designations remain the same as in the General Plan, and that the Central City South land use designation be excluded from the land use district list. Rules ApplyinG to Uncertain Boundaries on Land Use District Map Section 19.02.060 Paragraph 3 provides the rules that apply in determining uncertain boundaries of a district as shown on the official Land Use District Map. Principal Planner Montgomery stated that pre-zoning language will be added concerning land in the City's Sphere of Influence but not in the City limits. ARTICLE II - LAND USE DISTRICTS Article II. Chapter 19.04 sets forth the purpose of residential districts and describes the reserved neighborhood areas for residential living with a broad range of dwelling unit densities. John Montgomery recommended that 19.04.010 item 2 "top of page 11-2" be changed to read "The purpose of the individual commercial zone land use districts is as follows": RE (Residential Estate) District John Montgomery stated that the language will be changed to reflect that the Verdemont Area Plan standards have been incorporated into the development code. RM (Residential Medium 1 District John Lightburn of Lightburn & Associates, spoke regarding the minimum lot size for RM (residential medium district). He requested, on behalf of his client, that the minimum lot size under the RM designation be lowered to 13,400 square feet in order that a six unit project can be built. 4 2/21/90 Permitted. Planned Development Permitted and Conditionally Permitted Uses John Montgomery stated that Section 19.04.020 represents those uses in the residential districts which are permitted (P); subject to a planned development permit(D), a conditional use permit (C); or prohibited (X). Residential Uses - 19.04.020 - ParaGraph 1 Mr. Montgomery recommended that changes be made to the following categories to indicate that residential uses can be applied in the zones as listed: Single Family Dwellings - that a planned development permit be required for all residential districts (RE, RL, RS, RU, RM, RMH, RH). "Granny" Housing - that a planned development permit be required for all residential districts (RE, RL, RS, RU, RM, RMH, RH). Second Dwelling Unit - that a planned development permit be required for all residential districts (RE, RL, RS, RU, RM, RMH, RH). Manufactured Housing - that a planned development permit be required for all residential districts (RE, RL, RS, RU, RM, RMH, RH). A discussion ensued regarding the definition of manufactured homes and mobile homes. Larry Reed, Director of Planning and Building Services, provided a definition for manufactured housing. Sandy Paulsen, Senior Planner, explained why a planned permit is required for manufactured housing. Deputy City Attorney Empeno answered questions regarding definitions for mobile home parks and manufactured housing. Mobile Home required for RMH, RH). Parks that a conditional use permit be all residential districts (RE, RL, RS, RU, RM Condominium - that a conditional use permit be required for all residential districts (RE, RL, RS, RU, RM, RMH, RH). Affordable Housing that a conditional use permit be required for all residential districts (RE, RL, RS, RU, RM, RMH, RH). 5 2/21/90 A discussion ensued regarding why developers are not requesting density bonuses. Convalescent Homes that a conditional use permit be required only for RU residential district. RECESS MEETING At 3:10 p.m., recess. - FIFTEEN MINUTE BREAK Mayor Holcomb called for a fifteen-minute RECONVENE MEETING At 3:30 p.m., the joint Adjourned Regular Meeting of the Mayor and Common Council and Planning Commission reconvened in the Kellogg Room, Feldheym Library, 555 West Sixth Street, San Bernardino, California. ROLL CALL Roll call was taken with the following being present: Mayor Holcomb, Council Members Estrada, Reilly, Flores, Maudsley, Minor, Pope-Ludlam, Miller; Deputy City Attorney Empeno, City Clerk Clark, City Administrator Julian. Absent: None. Residential Uses - Discussed Earlier in the Meeting John Montgomery recommended that community care facilities be permitted in all residential districts (RE, RL, RS, RU, RM, RMH, RH). Deputy City Attorney Empeno answered questions regarding the possibility of the City imposing restrictions on community care facilities. Day Care Facility - that the number of children required for a day care facility be changed from "7-12 children, 13 + children" to "7 + children"; and that a conditional use permit be required only for RE residential district. Dormitories - that a conditional use permit be required for residential districts RM, RMH, RH. Equestrian Uses - 19.04.020 - ParaGraph 2 The Mayor and Council discussed where animals would be kept if unincorporated areas were annexed into the Ci ty. Mayor Holcomb suggested that a provision be made to allow animals in all zones. Larry Reed suggested that the word "rented" be deleted from the definition for "Stable Commercial", on page 1-20 of the draft Development Code. 6 2/21/90 Principal Planner Montgomery recommended that the title "Stables, Commercial" be changed to read "Boarded for Compensation" and that a conditional use permit be required for all residential districts (RE, RL, RS, RU, RM RMH, RH). Mr. Montgomery further stated that the Development Code will contain references to Chapters 6 and 8 of the Municipal Code concerning other types of animals. MAYOR HOLCOMB EXCUSED At 4:00 p.m, Mayor Holcomb left duties of Mayor Pro Tempore were Flores. the Council Meeting and the assumed by Council Member AGricultural Uses - 19.04.020 - ParaGraph 3 A discussion ensued regarding the definition of agricultural uses and the types of animals allowed in the various residential districts. CITY CLERK CLARK EXCUSED At 4:05 p.m, City Clerk Clark left the Council Meeting and was replaced by Deputy City Clerk Copeland. Recreational Uses - 19.04.020 - Paragraph 4 Mr. Montgomery recommended that spas be included in the category with swimming pools as a permitted use for residential districts RE, RL, RS, RU and that a planned development permit be required for RM, RMH, RH residential districts. Accessory Uses - 19.04.020 - ParaGra~h 5 John Montgomery recommended that changes be made to the following categories: Antennae, vertical - that a planned development permit be required for all residential districts (RE, RL, RS, RU, RM, RMH, RH). Garage - that a planned development permit be required for residential districts RE, RL, RS. Patio - that gazebos be included in the category for patios, and that a planned development permit be required for residential districts RE, RL, RS. Satellite Dish Antennae - that a planned development permit be required for all residential districts (RE, RL, RS, RU, RM, RMH, RH). Larry Reed explained why he requested that a conditional use permit be required for a satellite dish antennae. 7 2/21/90 Deputy City Attorney Empeno provided information on other cities that require a permit for satellite dish antennae. Storage - that a planned development RE, RL, RS and that a definition portable storage containers. permit be required for be added to include TV Antennae - that a category for TV antennae be added and that a planned development permit be required for all residential districts (RE, RL, RS, RU, RM, RMH, RH). Other - 19.04.020 - ParaGraph 6 John Montgomery recommended that a category be added for Private Schools and that a conditional use permit be required for all residential districts (RE, RL, RS, RU, RM, RMH, RH). Temporarv Uses - 19.04.020 - ParaGraph 8 John Montgomery stated that a section entitled "Emergency Public Health and Safety'" will be added under the category of temporary uses. He further stated that a full description of short-term activities permitted in the City, are located in Chapter 19.32, page IV-8 of the draft development code. ADJOURNMENT At 4:26 p.m., Council Member Flores made a motion, seconded by Council Member Reilly and unanimously carried, that the meeting be adjourned to Wednesday, February 28, 1990, at 1:30 p.m., at the Feldheym Library, 555 West Sixth Street, San Bernardino, California.
