HomeMy WebLinkAbout01-31-1990 Minutes City of San Bernardino, California January 31, 1990 This is the time and place set for an Adjourned Regular Meeting of the Mayor and Common Council at the joint Adjourned Regular Meeting of the Mayor and Common Council and Community Development Commission held at 9:07 a.m., on January 29, 1990, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. The City Clerk has caused to be posted the Order of Adjournment of said meeting held on January 29, 1990, and has on file in the office of the City Clerk an affidavit of said posting together with a copy of said Order which was posted at 3:00 p.m., Monday, January 29, 1990, on the door of the place at which said meeting was held. The Adjourned Regular Meeting was called to order at 3:10, Wednesday, January 31, 1990, at the Highland Conference Center in the City of Beaumont, California. ROLL CALL Roll call was taken by City Clerk Clark with the following being present: Mayor Holcomb; Council Members Estrada, Flores, Maudsley, Miller; Assistant City Attorney Brue, City Clerk Clark, City Administrator Julian. Absent: Council Members Reilly, Minor, Pope-Ludlam. OVERVIEW OF WORKSHOP Mayor Holcomb gave an overview of the topics to be discussed at the workshop and explained what he liked about a workshop format. (2) 1990-91 BUDGET PREPARATION PROCESS Finance Director Andy Green distributed a 1990-91 budget calendar and recommended that the Mayor and Council set aside Saturdays, June 2 and June 9, 1990, for the budget sessions. Mayor Holcomb spoke regarding the need for agreement on the priorities for expenditure of proceeds from the bond refunding and set forth his priorities as cleaning up the community and revitalization of downtown. 1 1/31/90 REFUSE RECYCLING CALIFORNIA INTEGRATED WASTE MANAGEMENT ACT - AB 939 Manuel Moreno, Jr., Superintendent of Public Services, stated that AB 939, the California Integrated Waste Management Act, has mandated that on or before July 1, 1991, each city shall prepare, adopt, and submit to the county in which the city is located a source reduction and recycling element which includes the following components: (4) 1. Waste characterization 2. Source reduction 3. Recycling 4. Composting 5. Solid waste facility capacity 6. Education and public information 7. Funding 8. Special waste 9. Household hazardous waste Mr. Moreno explained each component in detail and stated by the year 2000, the City must have reduced the disposal of refuse by 50%. He explained the economics of recycling and the fluctuations in the market. As each community enters into the recycling market, the supply of materials will rise and the price will drop. The value of recycled materials is also affected by the retail industry. As demand goes down, the materials are less valuable and it costs each community more money to carry out a recycling program because there is no profit. The Mayor urged the Superintendent of Public Services and the City Administrator to find a site for a transfer station. City Administrator Julian spoke regarding the County's negotiations with Norcal for refuse recycling and composting. The City Administrator also pointed out that the City of Highland does not have mandatory refuse pickup. AGENDA PROCESS City Administrator Julian spoke regarding the agenda process and some of the problems of getting a complete agenda before the Mayor and Council. (5) Members of the Council expressed concerns about the lack of time they have to review the agenda, the lack of complete staff reports, and the lack of historical information in staff reports. The Mayor suggested a procedure that would allow resolutions to be adopted conditional upon the approval of the City Attorney. The Mayor and Council discussed changing the council meeting day from Monday to Tuesday. 2 1/31/90 BEAUTIFICATION PROJECTS AND CODE ENFORCEMENT Mayor Holcomb spoke regarding his desire to fund beautification programs for the city. Some of his priorities include the street tree master plan, sidewalk replacement, landscaping of properties vacant for six months, matching funds for improvements, and aggressive code enforcement. (6, 7) CODE ENFORCEMENT OFFICERS - TASKS AND OPERATIONS Larry Reed, Director of Planning and Building Services, gave a presentation on his department and "A Day in the Life of a Code Enforcement Officer". (6) Mr. Reed presented a chart which explains the proposed reorganization of Planning and Building and Safety and set forth the priority system for response to code complaints. The Director of Planning and Building Services answered questions of the Mayor and Council. RECESS MEETING At 6:15 p.m. the meeting was recessed to 9:00 a.m., Thursday, February 1, 1990, at the Highland Springs Conference Center in the City of Beaumont, California. RECONVENE MEETING At 9:00 a.m., Thursday, February 1, 1990, the Adjourned Regular Meeting of the Mayor and Common Council reconvened at the Highland Springs Conference Center in the City of Beaumont, California. ROLL CALL Roll call was taken by City Clerk Clark with the following being present: Mayor Holcomb; Council Members Estrada, Reilly, Flores, Maudsley, Pope-Ludlam, Miller; Sr. Assistant City Attorney Barlow, City Clerk Clark, City Administrator Julian. Absent: Council Member Minor. REDEVELOPMENT SEMINAR JIM IVERSON This is the redevelopment to be Delafield and Wood Municipals, Inc. - PRESENTATION BY TIM SABO AND time and place set for a seminar on conducted by Tim Sabo of the firm of Hawkins, and by Jim Iverson of Miller and Schroeder (8) Timothy J. Sabo, Charles R. Green and Andre de Bortnowski of Hawkins, Delafield and Wood, Suite 400, 6320 Canoga Avenue, Woodland Hills, were present and distributed a booklet for the seminar. 3 1/31/90 Andre de Bortnowski presented the first part of the seminar which pertained to the redevelopment plan adoption process and presented a tentative action schedule for proceedings relating to a redevelopment plan adoption. Tim Sabo and Charles Green answered questions regarding redevelopment law and the clamp down by the legislature on the creation of redevelopment project areas. Tim Sabo explained in detail why redevelopment agencies need to create debt for each project area in order to protect tax increment proceeds. He explained why local school districts want their funding to come from tax increment revenues instead of tax proceeds and explained the importance of the project area's annual statement of indebtedness. Mr. Sabo illustrated the usefulness of city general fund to redevelopment agency loans and of subordinating developer agreements to other project area debt. He also explained how findings could be made to support the use of tax increment or bond proceeds for areas near a project area. Mr. Sabo agreed with the Mayor's statement that the best way to finance infrastructure would be to have the developer put it in and have the agency pay back the loan which is subordinated to all other debt. He also illustrated how a downtown parking structure could be financed by a developer in exchange for other benefits to the developer's project in another project area. Jim Iverson, Vice President of Miller and Schroeder Municipals, Inc., spoke regarding tax increment backed bonds and gave a history of how San Bernardino helped pioneer this approach to financing. Mr. Iverson answered questions of the Mayor and Council regarding redevelopment financing. Tim Sabo answered questions of the Mayor regarding developer agreements. He discouraged entering into a limited partnership with a developer and recommended the use of owner participation agreements. RECONVENE MEETING At 2:00 p.m., the joint Adjourned Regular Meeting of the Mayor and Common Council/Community Development of the City of San Bernardino reconvened at Highland Springs Conference Center, Beaumont, California. REDEVELOPMENT SEMINAR Andre de Bortnowski gave a presentation on low and moderate income housing set aside provisions in Health and Safety Code Section 33334.2 which require that every redevelopment agency set aside 20% of all tax increment revenues generated from a redevelopment project area for the purposes of increasing and improving the community's supply of low and moderate income housing. Agencies are also authorized to use the funds to preserve the supply of low and moderate income housing. ( 8) Presently, $8.9 million is available in the 20% set aside account. The median income for San Bernardino is $21,200 per year for one and $30,300 for a family of four. The low income range is 80% of median; moderate is 120% of the median. Andre de Bortnowski answered questions of the Council and spoke regarding affordability requirements, excess surplus, and replacement of dwelling units. Charles Green gaye a presentation on Article 34 of the State Constitution. Article 34 requires voter approval of certain types of low income housing projects. He explained what actions a public body may take without triggering Article 34 and answered questions of the council. Jim Iverson, Vice President, Miller and Municipals, Inc., gave a presentation on redevelopment and federal tax restrictions. Schroeder financing Mr. Iverson explained how the federal tax law restrictions will apply to the $30 to $40 million available to the City. Tim Sabo and Jim Iverson answered questions regarding the Verdemont infrastructure financing district. Tim Sabo answered questions regarding the lease of parking spaces within a public structure to a private party. 5 1/31/90 Mayor Holcomb spoke regarding his priorities for the use of the 20% set aside. He asked staff to look into an infill housing incentive plan for the area bounded by Highland Avenue, Mill Street, Waterman Avenue and the freeway. RECESS MEETING - CLOSED SESSION Council Member Miller made a motion, seconded by Council Member Estrada and unanimously carried, that the meeting recess to closed session to give instruction to the City's/Commission's negotiator on the purchase of property pursuant to Government Code Section 54956.8. Mr. Green explained pre- litigation proceedings, litigation and possession of the property.
