A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO PROPOSING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY HERE- INAFTER DESIGNATED AS THE 206TH ANNEXATION DISTRICT OF THE CITY OF SAN BERNARDINO. (LAFC NO. 608) WHEREAS, and heretofore, there has been presented to the Mayor and Common Council of the City of San Bernardino a written petition containing a description of certain territory which is hereinafter more specifically described, and said petition requested that said territory be annexed to and included in the City of San Bernardino in accordance with the provisions of the "Annexation of Uninhabited Territory Act of 1939", as contained in Government Code, Section 35300, et seq.; and WHEREAS, the Common Council has made a complete investigation and report in reference thereto. NOW, THEREFORE, BE AND IT IS HEREBY RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION ONE: That a written petition containing a description of certain uninhabited territory hereinafter more specifically described has been presented to the Common Council of the City of San Bernardino. SECTION TWO: That said petition contains a description of certain uninhabited territory sought to be included in the City of San Bernardino, and that a petition is signed by the owners of not less than one-fourth of the land in the territory, by area and by assessed value, as shown on the last preceding equalized assessment roll of the County of San Bernardino, in which said County the City of San Bernardino is situated. SECTION THREE: That notice is therefore hereby given of the proposed annexation to the City of San Bernardino of the uninhabited territory contiguous to the City of San Bernardino, the boundaries of which are particularly described as follows, to wit: That portion of Tract No. 3996 as per plat thereof recorded in Book 52 of Maps, page 64, Records of the County Recorder of San Bernardino County, State of California, described as follows: Beginning at a point on the present corporate limits of the City of San Bernardino, said point being the intersection of 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 the center line of Highland Avenue and the Southerly prolon- gation of the East line of Lot 3, Block 7, West Highlands as per plat thereof recorded in Book 5 of Maps, page 77, records of the County Recorder of said County, said point also being 148.69 feet more or less, West of the intersection of the center lines of Highland Avenue and Valeria Drive; thence Westerly along said City Limit Line and along the center line of said Highland Avenue a distance of 20.62 feet, more or less, to the intersection of the Northerly prolongation of the East line of Block 2 of said West Highlands; thence Southerly along said City Limit Line and along said Northerly prolongation and the East line of said Block 2 a distance of 220.06 feet, more or less to its intersection with the Westerly prolongation of the center line of a 20.00 foot wide East-West alley as delineated on the map of said Tract 3996 and being adjacent to and Southerly of Lots 1 and 93 of said Tract 3996; thence leaving said City Limit Line and East along the said prolongation and the center line of said alley a distance of 404.34 feet, more or less, to its intersection with the East line of said Tract 3996; thence North along the East line of said Tract 3996 and its Northerly prolongation a distance of 219.94 feet, more or less to the center line of Highland Avenue; thence West along the center line of Highland Avenue to the point of beginning. Containing 2.04 acres, more or less. That there are less than twelve qualified electors residing in said territory and that said territory is uninhabited as defined by said Act; and That the aforementioned uninhabited territory included in the proposed annexation shall hereafter be generally known and identified as Annexation District No. 206. SECTION FOUR: That upon the completion of said annexation of said territory, all of the property included in said Annexation District No. 206 shall be taxed equally with the other property within the City of San Bernardino to pay the bonded indebtedness and any and all general indebtedness of the City of San Bernardino contracted prior to or existing or outstanding at the time of the aforesaid proposed annexation of said described property as provided in said Act. SECTION FIVE: Notice is hereby given that Tuesday, the It-,%Z7k day of_�_ , 1968, at the hour of of said day in the Council Chambers of the City Hall in the City of San Bernardino, California, is the time and place designated at which time any person owning real property within the said territory may appear before the Mayor and Common Council of the City of San Bernardino and show cause why - 2 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 said territory should not be annexed to said City. Further notice is hereby given that any property owner within said territory desiring to protest against said annexation must make such protest in writing and file it with the City Clerk of the City of San Bernardino not later than ` �d (�` //��• on the day of 1968. Such protest shall state the name or names of the owner or owners of the property affected hereby, and the description and area of such property in general terms. SECTION SIX: The City Clerk is hereby authorized and directed to cause a copy of this resolution to be published at least twice, but not oftener than once a week, in the San Bernardino Free Press, a newspaper of general circulation published in the City of San Bernardino, the City to which it is proposed to annex the aforesaid territory, and also in the Highland Messenger, a newspaper of general circulation published outside the City of San Bernardino, but in the County of San Bernardino, the County in which is located the territory proposed to be annexed to the City of San Bernardino, said publication to be complete at least twenty (20) days prior to the date set for hearing; And the said City Clerk is further authorized and directed to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed in the last equalized county assessment roll available on the date the above said proceedings were initiated, at the addresses shown on said assessment roll or known to said Clerk, and to any person who has filed his name and address and the designation of lands in which he has an interest, either legal or equitable, with said Clerk, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation; And in the event any land within the territory proposed to be annexed is owned by a County, the said City Clerk is directed to cause written notice of such proposed annexation to be mailed to the Board of Supervisors of such County, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation; - 3 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 1 32 1 And in the event there is upon the land proposed to be annexed a structural improvement owned, being acquired or leased by a county fire protection district, the said City Clerk is directed to cause written notice of such proposed annexation to be mailed to the governing body of such district, such notice to be sent not less than ten (10) days before the first public hearing upon such proposed annexation; And the said City Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto, in the manner required by law.
