HomeMy WebLinkAbout9319RESOLUTION NO.Tr' A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION TO ORDER THE VACATION OF A PORTION OF KING STREET BETWEEN MT. VIEW AVENUE AND SIERRA WAY AND THOSE CERTAIN NORTH -SOUTH AND EAST -WEST ALLEYS LOCATED BETWEEN RIALTO AVENUE AND SECOND STREET AND BETWEEN MT. VIEW AVENUE AND SIERRA WAY. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That the Mayor and Common Council of the City of San Bernardino hereby declares its intention to order the vacation of a portion of King. Street between Mt. View Avenue and Sierra Way and those certain North -South and East-West Alleys located between Rialto Avenue and Second Street and between Mt„ View Avenue and Sierra Way, in said City, which said portion more particularly is described as follows: King Street, delineated as Bridge Street, on the Map of Bedford Bros. Subdivision as per plat thereof recorded in Book 3 of Maps, Page 84, records of the County Recorder of San Bernardino County, lying be- tween the East line of Mt. View Avenue and the West line of Sierra Way; those certain East-West and North -South alleys lying within Block I as delineated on the map of said Bedford Bros, Subdivision, lying between the East line of said Mt. View Avenue and the West line of said Sierra Way and between the North line of Rialto Avenue and the South line of said King Street; those certain East-West and North - South alleys lying within Block 2 as delineated on said Bedford Bros. Subdivision lying between the East line of said Mt. View Avenue and the West line of said Sierra Way and between the South line of Second Street and the North line of King Street. SECTION 2. That the Mayor and Common Council of the City of San Bernardino, in vacating the above described portion of said Streets and Alleys, elects to proceed under and in accordance with the provisions of the "Street Vacation Act of 1941", being Division 9, Part 3, of the Streets and Highways Code of the State of California. SECTION 3. That the hour of 9:30 A.M., on the 19th day of August, 1968, in the Council.Chamber of the City Hall, San Bernardino, California, be, and the same hereby is fixed as the time and place when and where all persons interested in or objecting to the proposed vacation may appear before the said Mayor and Common Council and offer evidence in relation thereto. For further particulars as to the proposed vacation of the hereinbefore described portion of said Streets and Alleys, reference is made to that certain map marked "Plan No. 3770" approved March 25, 1968, on file in the office of the City Clerk of said City. SECTION 4. The Mayor and Common Council hereby determine that the public convenience and necessity require the reservation of temporary rights to maintain sanitary sewers and storm drains and appurtenant structures, in, upon, over and across any and all parts of streets and alleys proposed to be vacated and pursuant to any existing franchises or renewals thereof or, otherwise, to main- tain lines of pipe, conduits, cables, wires, poles and other con- venient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines and for the transporta- tion or distribution of electric energy, water and incidental pur- poses, as enumerated in Section 8330 of the Streets and Highways Code of the State of California, located on or under the above described streets and alleys. These rights are reserved for an interim period which period shall commence immediately following the vacation of the above described streets and alleys by the City of San Bernardino and shall cease when said lines, pipes, structures and facilities have been relocated or when services provided by said lines, structures and facilities have been discontinued. -2- SECTION 5, That the City Engineer of the City of San Bernardino hereby is directed to cause Notices of Street Vacation to be posted as required by the Street Vacation Act of 1941.
