RESOLUTION NO. 84-206
A RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION
TO ORDER THE VACATION OF A PORTION OF NINTH STREET, WEST OF PENNSYLVANIA
AVENUE, AND RESERVING A STORM DRAIN EASEMENT IN A PORTION THEREOF.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1. -1 "hat the Mayor and Common Council of the City of San
Bernardino hereby declares its intention to order the vacation of a portion
of Ninth Street, West of Pennsylvania Avenue, in said City, Which said
portion more particularly is described as follows:
That portion of 9th Street lying between the West line of the
Rancho San Bernardino, as per plat thereof recorded in Book 7 of
Maps, page 2, records of the County Recorder of San Bernardino
County, State of California, and the Easterly line of Terrace
Road as delineated on the Map of Tract 10043, as per plat thereof
recorded in Book 157 of Maps, pages 47 and 48, records of the
County Recorder of said County.
SECTION 2. That the Mayor and Common Council of the City of San
Bernardino, in vacating the above described portion of said street, elects
to proceed under and in accordance with the provisions of the "Public
Streets, Highways and Services Vacation Law", being Division 9, Part 3, of
The Streets and Highways Code of the State of California.
SECTION 3. That the hour of 9:00 a.m. on the 18th day of June,
1984, in the Council Chamber of the City Hall, San Bernardino, California,
be and the same hereby is fixed as the time and place when and where all
persons interested in or objecting to the proposed vacation may appear
before the said Mayor and Common Council and offer evidence in relation
thereto. For further particulars as to the proposed vacation of the herein -
before described portion of said street, reference is made to that certain
map marked "Plan No. 6486" approved May 21, 1984, on file in the office
of the City Clerk of said City.
SECTION 4. There is hereby reserved to the City of San Bernardino'
I for future use, an easement for drainage purposes and appurtenant facilities,
2 in, over, under and across that portion of the real proporty herein described
3 lying between Terrace Road, easterly to the San Bernardino County Flood
4 Channel, and to use, maintain, repair, replace or renew such facilities.
5 I SECTION 5. That the City Engineer of the City of San Bernardino
6 hereby is directed to cause Notices of Street Vacation to be posted as
7 required by the "Public Streets, Highways and Services Vacation Law".
8 SECTION 6. That the City Clerk shall certify to the adoption of
9 this Resolution of Intention and shall cause the same to be published for 2
10 days in The Sun, a newspaper published and circulated in the City of
11 San Bernardino, prior to the date of the above public hearing.
12 I HEREBY CERTIFY that the foregoing resolution was duly adopted by
13 the Miiayor and Common Council of the City of San Bernardino at a
14 regular meeting thereof held on the 21st
15 day of May 1984, by the following vote, to -wit:
16 AYES: Councilmen Castanecl.a, Reilly, Marks, �.

18 NOES: None
19 ABSENT: Council Plemher Hernandez
