HomeMy WebLinkAbout1984-2091 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 84-209 RESOLUTION OF THE CITY OF SAN BERNARDINO DETERMINING THE MOUNT OF PROPERTY TAX REVENUES TO BE EXCHANGED BETWEEN THE COUNTY F SAN BERNARDINO AND THE CITY OF SAN BERNARDINO RESULTING FROM HE JURISDICTIONAL CHANGE DESCRIBED BY LAFC NO. 2260B (HIGHLAND). BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The Mayor and Common Council of the City of San Bernardino hereby find and determine that: A. Pursuant to Section 99 of the Revenue and Taxation Code, prior to the issuance of a certificate of filing by the Local Agency Formation Commission Executive Officer, the governing bodies of all local agencies whose service area or service responsibilities will be altered by a proposed jurisdictional change shall negotiate and determine by resolution the amount of property tax revenues to be exchanged among such local agencies. B. Except as provided in Section 99.1 of the Revenue and Taxation Code, in the event that a jurisdictional change would affect the service area or service responsibility of one or more special districts, the Board of Supervisors shall, on behalf of the district or districts, negotiate any exchange of property tax ,revenues. C. The Board of Supervisors of the County of San Bernardino and the Mayor and Common Council of the City of San Bernardino have determined the amount,of property tax revenues to be exchanged as a result of the following jurisdictional change(s): Annexation by the City of San Bernardino of the following unincorporated areas: Approximately 10,240 acres, generally referred to as the Highland Area, located northerly of Norton Air Force Base, west and south of the United States Forest Service boundary, and east of Waterman Avenue; and approximately 450 acres, generally referred to as 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Arrowhead Suburban Farms, located north of 40th Street, west of Electric Avenue, south of Hill Drive, and east of Orange Drive. D. The affected jurisdictions reserve the right to amend I this resolution regarding the amount transferred if warranted by !studies in progress or the availability of more detailed financial data. This reservation is based upon the need to conduct a thorough analysis of each jurisdictional change in the interest of fairness and equity. Such amendment shall not reduce the amount stated in Section 2A and shall be adopted within 60 days of the date of this resolution. SECTION 2. Implementation. A. The negotiated exchange of property tax revenues between the County of San Bernardino and the City of San Bernardino resulting from the above -described jurisdictional change(s), is approved and accepted as follows: The City of San Bernardino shall not receive less than: 1) ,the amount of property tax revenues generated by those portions of ,the affected special districts being annexed to the City of San Bernardino, plus (2) the amount of property tax revenues which the County of San Bernardino would have transferred to a new city comprising the area proposed for annexation pursuant to the formula in Government Code Section 54790.3. B. The annual tax increment generated in the area subject to the jurisdictional change and attributable to the local agencies whose service area or service responsibilities will be altered by the proposed jurisdictional change shall be allocated in future years pursuant to the provisions of Section 98 of the Revenue and Taxation Code. -2- 2 3 4 5 6 7 8 9 10 13 14 15 16 17 18 19 20 21 23 24 25 26 27 28 SECTION 3. The City Clerk is hereby directed to certify to the passage of this resolution and to cause a certified copy to be sent to the Executive Officer of the Local Agency Formation Commission of the County of San Bernardino.
