LAFC 2260B CONSISTING OF AREAS GENERALLY KNOWN AS THE UNINCORPORATED AREAS OF HIGHLAND/EAST HIGHLANDS AND ARROWHEAD SUBURBAN FARMS, AND SETTING HEARING. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Recitals. (a) An application for Municipal Reorganization No. LAFC 2260B was initiated.by Resolution No. 83-441 of the Mayor and Common Council of the City of San Bernardino adopted December 5, 1983, which was filed with the Executive Officer of the Local Agency Formation Commission in accordance with the Municipal Organization Act of 1977 (Govt. Code Section 35000, et seq.) (b) The short form designation assigned by the LAFC to the territory proposed to be annexed is LAFC 2260B. The area to be annexed is more particularly described in Exhibit "A" of LAFCO Resolution No. 1918, which resolution is attached hereto and incorporated herein as Exhibit "I". The area proposed to be annexed is inhabited territory. (c) The reasons for the proposed annexation are as follows: 1. The majority of the area has become developed and populated to an extent that municipal services are needed by the inhabitants. 2. There is presently a duplication of personnel and equipment costs which increases the expense of providing services to the area which now encompasses island areas partially surrounded by incorporated areas. 3. Differing levels of service and irregular boundaries create confusion, particularly during times of critical I lemergencies and have an adverse affect upon long-range planning 2 for development in the area. I 3 4. The terms and conditions of the proposed annexation 4 are set forth in Resolution No. 1918 adopted by the LAFC on I 5 iJune 13, 1984. A copy of said resolution is attached hereto as 6 Exhibit "I" and incorporated herein. 7 SECTION 2. Hearing and Notice. 8 (a) A hearing on the proposed annexation shall be held on 9 July 23, 1984 in the City Council Chambers at City Hall, 300 North 10 �"D" Street, in the City of San Bernardino, at 9:00 a.m. Any owner 11 �Iof land within the territory proposed to be annexed or any 12 registered voter residing within the territory may file a written 13 protest against the annexation with the City Clerk of the City of I 14 !,San Bernardino at any time prior to conclusion of the hearing on 15 July 23, 1984. ii i 16 (b) The City Clerk is hereby directed to give notice of the hearing on July 23, 1984, in accordance with applicable law and to mail a certified copy of this resolution to the Executive Director of the Local Agency Formation Commission of the County of San Bernardino. On motion of Commisssioner Schuiling, duly seconded by Commissioner Dondelinger, and carried, the Local Agency Formation Commission adopts the following resolution: WHEREAS, an application for the proposed municipal reorganization in the County of San Bernardino was heretofore filed with the Executive Officer of this Local Agency Formation Commission in accordance with the Municipal Organization Act of 1977 (Govt. Code Section 35000 et.:seq.), and said Executive Officer has examined said application and executed his certificate in accordance with law, determining and certifying that said filings were sufficient; and WHEREAS, at the times and in the form and manner provided by law, said Executive Officer has given notice of public hearing by this Commission upon said application; and WHEREAS, said Executive Officer has reviewed available information and pre- pared a report, including his recommendations thereon, said filings and report and related information having been presented to and considered by this Commis- sion; and WHEREAS, the public hearing by this Commission was held upon the date and at the time and place specified in said notice of public hearing and in any order or orders continuing such hearing; and WHEREAS, at such hearing this Commission heard and received all oral and written protests, all plans and proposed changes of organization and reorganiz- ation, objections and evidence which were made, presented, or filed, received evidence as to whether the territory is inhabited or uninhabited, improved or unimproved, and all persons present were given an opportunity to hear and be heard in respect to any matter relating to said application, in evidence pre- sented at the hearing; and WHEREAS, at such hearing this Commission in its review determined that the proposal should be amended to include annexation of approximately fifteen square miles, generally described as all unincorporated territory within the boundaries bordered. by Waterman Avenue on the west, the United States Forestry Boundary on the north, the east line of Section 36 (T1N,R3W) and Section 1 (TIS,R3W) on the east, and by the south lines of Section 1,2,3, and 4 (T1S,R3W) and existing City boundaries on the south. Also approved in this reorganization is the unincorpor- ated area known as Arrowhead Suburban Farms, as more specifically described in the attached Exhibit NOW, THEREFORE, BE IT RESOLVED, that the Local Agency Formation Commission of the County of San Bernardino does hereby determine, resolve, order, and find as follows: DETERMINATIONS: SECTION 1. The Executive Officer is hereby authorized and directed to mail certified copies of this resolution in the manner provided by Section 35201 of the Government Code. SECTION 2. This proposal is approved subject to the terms and conditions herein- after specified: LAFC 2260E RESOLUTION NO. 1918 Page Two CONDITIONS: Condition No. 1. The conducting authority for this proceeding shall be the City Council of the City of San Bernardino.. Condition No. 2. The boundaries are approved as set forth in Exhibit "A" attached. Condition No. 3. The following distinctive short form designation shall be used throughout this proceeding: LAFC 2260B. Condition No. 4. An election shall be called and held on the question of this municipal reorganization. Condition No.-S. If approved by the voters, the effective date of this municipal reorganization shall be July 1, 1985. Condition No._6. Included in the City's resolution depicting final action shall be the detachment of County Service Area SL-1 (street lighting), County Service Area 38 (fire protection), Improvement Zone G of CSA 38, County Service Area 70 (countywide), and Improvement Zone A of CSA 70 (weed abatement) without split of assets or liabilities,. except as noted in Condition No. 7. Condition No. 7. The California Division of Forestry -County Service Area 38 station on Baseline shall be purchased by the City of San Bernardino.at its present County of San Bernardino depreciated value, or the original land purchase and construction cost (whichever is lower); or, if the County wishes to retain ownership of this facility, the City shall lease the station at a cost of one dollar per year,.until such time as the proposed East Highlands station is constructed. Condition No. 8. Library service at the location of the County branch library on Baseline near its intersection with Palm Avenue shall be continued until the proposed new City library can be constructed. In order to protect the County commitment at that location, the'City of San..Bernardino will either assume the County lease on the same terms and conditions as exist on the effective date of this change, or contract with the County of San Bernardino for continued operation. Condition No. 9• All County and County Special District employees who may be displaced! ,y�this municipal reorganization shall be considered with first preference by the City of San Bernardino for employment with the City to perform comparable service assignments now assumed by the City under the following terms: a. That employee applicants be shown, in the sole judgement of the City of San Bernardino, to be qualified to fill the employment which is being considered. b. That employees hired by the City retain accumulated benefits relating to sick leave and vacation time. c. That in all other respects, the County and County Special District employees hired by the City of San Bernardino would be under the same employee benefit program as,other City employees SECTION 3. The conducting authority is hereby directed to initiate appropriate proceedings in compliance with this resolution and State law. SECTION 4. The conducting authority shall not make any changes in the boundaries hereby approved nor shall it impose any new conditions or modify any conditions hereby imposed unless and until it receives the approval of the Local Agency Formation Commission for such changes, modifications, or conditions, pursuant to the procedures prescribed in Section 35162. SECTION 5. Upon completion of its proceedings, the conducting authority is hereby directed to adopt its own resolution setting forth its action relating to the proposal considered and forward the required number of certified copies of the resolution to the Local Agency Formation Commission. SECTION 6. Upon receipt of the resolution of the conducting authority approving said action the Certificate of -Completion shall be prepared and filed. SECTION 7. Approval by the Local Agency Formation Commission indicates approval of this proposal by the conducting authority would accomplish the proposed changes of organization in a reasonable manner with a maximum chance of success and a minimum disruption of service to the functions of other local agencies in the area. LAFC 2260E RESOLUTION NO. 1918 PAGE 11IRFE SECTION 8. FINDINGS: This proposal is approved with the following findings: 1. The Local Agency Formation Commission finds that the City of San Bernardino has represented that the City will propose a City Charter amendment to provide for two additional city councilmen (Council increased to nine members) to provide for representation from the area annexed. 2. The Local Agency Formation Commission finds that it is its desire that a November 1984, election be held on the question of this municipal reorganization. The following findings are noted in conformance with Commission policy: 3. The County Registrar of Voters indicates that the annexation areas are legally inhabited with 18,464 registered voters. 4. The County Assessor has reviewed this proposal and has determined that the assessed valuation of the annexation areas is $714,111,438 through analysis. of the 1983-84 tax rolls. 5• The City of San Bernardino has not pre -zoned the annexation areas, as per- mitted by LAFC policies which accord flexibility to a City proposing to annex large, substantially developed land areas. The City has, however, commenced an "Area Plan" review with the participation of a citizens' committee composed of residents in the Highland/East Highlands area (both unincorporated and incorporated territories). The Arrowhead Suburban Farms annexation area will be included, upon annexation, within the larger "State College" area plan. 6. A Negative Declaration has been prepared pursuant to the provisions of the California Environmental Quality Act (CEQA) indicating the municipal reorg- anization will have a non -significant effect on the environment. The LAFC adopted the Negative Declaration and a copy is on file in the office of the Clerk. The Clerk has been instructed to file the Notice of Determination within seven days. 7. Special Districts which serve the annexation areas in whole or in part are listed in the file. County Service Area SL-1, County Service Area 38, Improvement Zone G of CSA 38, County Service Area 70, and Improvement Zone A of CSA 70 should be detached to avoid duplication of services. None of the other agencies are affected by this municipal reorganization. 8. State law requires that notice of a proposed annexation be published once in a newspaper of general circulation within the annexation area. Notice of LAFC 2260E has been published twice in The Sun along with a "display map" indicating the areas of annexation review. 9. The City has submitted a Plan for Municipal Services to the annexation areas in accordance with state law. The Plan is on file in the office of the Clerk and available for public dissemination and review. It in- dicates that the level and range of services available to the Highland/ East Highlands/Arrowhead Suburban_ Farms areas will exceed that which is currently rendered by the County. 10. This proposal and its anticipated effects conform with state laws and local LAFC policies which promote the orderly and logical expansion of municipal boundaries. 11. All notices required by law have been provided. The Commission in its determination has reviewed and considered the protests filed and pre- sented before it. 12. The City and County have negotiated the transfer of ad valorem taxes as required by this proposal. Copies of the resolutions adopted by the San Bernardino County Board of Supervisors and the City Council of the City of San Bernardino are on file in the office of the Local Agency Formation Commission outlining the exchange of revenues.
