HomeMy WebLinkAbout1984-446 Imposing Liens on certain parcels of real property for abatement costsi I� 1 RESOLUTION NO. 84-446 2 11 RESOLUTION OF THE CITY OF SAN BERNARDINO IMPOSING LIENS ON CERTAIN PARCELS OF REAL PROPERTY LOCATED WITHIN THE CITY OF SAN 3-BERNARDINO FOR THE COSTS OF THE ABATEMENT OF A PUBLIC NUISANCE. (1071 NORTH "G" STREET, 871 NORTH "H" STREET, 454 NORTH LUGO, 4 ,I1147 NORTH MT. VERNON, 1717 WEST 30TH STREET, 385 SOUTH MT. VERNON 5 i! BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF 6 SAN BERNARDINO AS FOLLOWS: 7 II SECTION 1. The City of San Bernardino, pursuant to its 8 Iauthority under San Bernardino Municipal Code Section 3.68.020 and 9 ISan Bernardino Municipal Code Chapters 8.18, 8.27, 8.30, 8.33 and 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 i15.28 and other laws, did lawfully cause public nuisance abatements on projects on the real property described on Exhibit "A", attached hereto and incorporated by reference as fully as though set forth at length. The last known owners of record as to each such parcel are also specified in Exhibit "A". Due notice was given to the person or persons having an interest in said property and a hearing was held by the Board of Building Commissioners to hear protests and to assess the costs of said abatements on said property. The Board of,Building Commissioners has entered its order determining the costs to be reasonable and proper, and imposing a lien upon the land involved. Notice of the right of appeal to the Mayor and Common Council has been issued to all affected property holders. The Board of Building Commissioners now requests that the Mayor and Common Council confirm the imposition of the lien. SECTION 2. The matter having now come before the Mayor Common Council for hearing on confirmation of the imposition the lien imposed, and a hearing thereon having been held, the following costs are found to have been duly incurred by the C 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 pursuant to proceedings under said provisions of the San Bernardino Municipal Code and the final statements of costs on file with the City Clerk are hereby confirmed and adopted as special assessments: Assessment Project Address Amount of No. No. Assessment 1 2135 1071 North "G" Street $1,190.00 2 2554 871 North "H" Street $1,870.00 3 2565 454 North Lugo $1,338.15 4 2583 1147 North Mt. If said sum is not fully paid to the City Clerk, City Hall, San Bernardino, within five (5) days after the adoption of this resolution as to any such individual parcel, then said sum shall be and become a lien on said property pursuant to said Municipal Code provisions and applicable laws and shall be collected as a special assessment thereon. SECTION 4. In the event said sum is not paid as hereinabove provided, the City Clerk is hereby directed to file a certified copy of this resolution with the Auditor of the County of San Bernardino, State of California, directing that said sum be entered as lien charges against said property as it appears on the current assessment rolls, to be collected at the same time and in the same manner, subject to the same penalties and interest upon delinquencies, as the general taxes for the City of San Bernardino are collected. The City Clerk shall also present for recording appropriate notices of the imposition of these liens with the County Recorder.
