CLOSED SESSION REPORT City Attorney Sonia Carvalho stated there was reportable action from Closed Session. The City Council voted unanimously to approve a settlement agreement for item A(i) for Maliya Guercy in the amount of $75,000. The City Council also voted unanimously to approve a settlement agreement for item A(iii) for Isidoro Oropeza in the amount of $50,000.00. PRESENTATIONS 1. Presentation of Tree City USA Designation for the City of San Bernardino 2023 (All Wards) Mayor Tran presented the designation to the Urban Forestry Service, Forestry Supervisor Matt McDonald, Public Works Director- Lynn Merrill, and Deputy Director- Ernesto Salinas and various Public Works staff. 2. Development Code Amendment 23­01 (Short­Term Rental Program) (All Wards) Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, California: 1. Hold a Public Hearing; and 2. Introduce for first reading, read by title only, and waive further reading of Ordinance No. MC-1628 of the Mayor and City Council of the City of San Bernardino, California, adopting the Short-Term Rental Program, and approving Development Code Amendment 23-01 amending Section 19.02.020 (Basic Provisions – Definitions) and Chapter 19.04 (Residential Zones) of the City of San Bernardino Development Code (SBMC Title 19) in order to establish a Short-Term Rental Program in the City of San Bernardino; and finding that Development Code Amendment 23-01 is exempt from review under the California Environmental Quality Act; and 3. Schedule the adoption of Ordinance No. MC-1628 for July 3, 2024. Mayor Tran opened the public hearing at 5:53 PM. Stephanie Castro, Economic Development Project Manager provided a presentation to the Mayor and City Council. There were two public speakers: Mike Hartley spoke on the lack of code enforcement presence in the city and in opposition to the Short-Term Rental program. Treasure Ortiz spoke in opposition to the Short-Term Rental program and the lack of enforcement by Code Enforcement and Business Registration. Ortiz also spoke on the potential difficulty of enforcing the program parameters. The public hearing was closed at 6:17 PM. Mayor Pro Tem Shorett made a motion to ban short-term rentals in the city with a second from Council Member Figueroa. Council Member Sanchez requested to have staff also bring back an enforcement plan. When the vote was taken Council Member Calvin abstained, she explained that she did not have enough information to vote in favor or in opposition. The motion passed with a simple majority vote. Commercial Cannabis Regulatory Program Update (All Wards) Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, California, receive and file the oral report on the Commercial Cannabis Regulatory Program. Discussion ensued on this item regarding the dedicated Code Enforcement staff hired for Cannabis enforcement. and the efforts of the task force. In addition, questions pertaining to illegal operators were posed. Staff were unable to provide details on those efforts. The number of available permits was questioned, and staff advised they were focusing efforts on current operators, and they had not opened the process to issue the remaining permits. Council member Sanchez advised that the decision to issue or not issue the remaining permits must be made by the legislative body. And directed staff to bring back the item providing the number of vacancies and a plan to regulate the process. RESULT: DIRECTED STAFF TO COME BACK WITH THE NUMBER OF VACANCIES AND A RECOMMENDATION ON FILLING THE REMAINING LICENSES AND FORMALIZE A PROCESS ON HOW TO ISSUE LICENSES. STAFF MUST ALSO BRING A PLAN TO REGULATE THE PROCESS. Continuation of May 15, 2024, Public Hearing: Presentation of the City Manager’s Proposed Fiscal Year 2024/25 & Fiscal Year 2025/26 Budget (All Wards) Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino: 1. Continue the Public Hearing of the proposed Fiscal Years 2024/25 and 2025/26 Operating Budget and Capital Improvement Plan; 2. Receive and file the proposed budget for Fiscal Years 2024/25 and 2025/26 Operating and Capital Improvement Plan presentation. Mayor Tran opened the public hearing at 7:20 PM. Jeannie Fortune, Acting Finance Director and Zuyva Ruiz, Budget Manager provided a presentation to the Mayor and City Council. There were three public speakers. Georgia L. spoke on the approved positions under the Animal Services and mentioned some inconsistent figures in the budget as presented. Lydia Zavala spoke on the need and salary of the shelter Veterinarian as indicated in the proposed budget. Selena M. spoke on the budget for Animal Services, shelter services and the number of animals currently in the shelter. The public hearing was closed at 8:04 PM Supplemental documentation was provided to the Mayor and City Council and made available to the public pertaining to item No. 7. Approval of the City Manager's FY 2025 & FY 2026 Operating Budget & CIP 2025­ 2029 (All Wards) Recommendation: It is recommended that the Mayor and City Council of the City of San Bernardino, California: 1. Adopt Resolution No. 2024-139 of the Mayor and City Council of the City of San Bernardino, California, approving the City of San Bernardino’s Fiscal Years 2024/25 and 2025/26 Operating Budget and Capital Improvement Plan; 2. Adopt annual budgets for Fiscal Years 2024/25 and Fiscal Year 2025/26 with any City Council approved modifications made during the Public Hearing to be incorporated into the City of San Bernardino’s Fiscal Years 2024/25 and 2025/26 Operating Budget and Capital Improvement Plan and included as part of the final adopted budgets; 3. Establish the City’s Appropriations Limit as required by Article XII of the California State Constitution; and 4. Adopt Resolution No. 2024-140 of the Mayor and City Council of the City of San Bernardino, California, approving an amendment to the city-wide salary schedule for full-time, part-time, temporary, and seasonal positions. ITEM PULLED BY THE ACTING CITY MANAGER DUE TO THE CONTINUATION OF THE BUDGET PUBLIC HEARING ITEM. NO ACTION TAKEN. CITY MANAGER UPDATE Jeff Kraus, Public Information Officer, provided city wide updates. Highlights included Annual Homeless Point in time count, Memorial Day Ceremony, the State of the City Event, Public Works Beautification at Hernandez Community Center, Nicholson Park Improvement updates, Pet Adoption and Parks and Recreation night concert summer series. Acting City Manager Clayton provided an update on the Pavement Management Plan program award and the new facility for Animal Services being delivered in July and operation by the Fall. PUBLIC COMMENTS FOR ITEMS LISTED AND NOT LISTED ON THE AGENDA At this time public comments for Open Session were heard. Sarah R spoke in favor of a candidate for Ward 7 and addressed public access to the State of the City event. Also discussed was Best, Best, and Krieger services. Harry Hatch addressed housing and fireworks in the city, opposing item no. 29 due to concerns over the number of permits issued. Advocated for banning fireworks and discussed issues with the permitting process. Regular Meeting Minutes June 5, 2024 Mayor and City Council of the City of San Bernardino Page 12 Jim Mulvihill spoke on the May 1st Mayor and City Council meeting, emphasizing the need for guidelines in the General Plan and addressing significant needs in several wards. Advocated for promoting safe, sanitary homes and direct community engagement through forums. Malibu commented on the State of the City event and highlighted aspects such as the National Anthem singer. Encouraged community unity and attendance at specific events. Christian Shaughnessy requested the Mayor and City Council to establish a subcommittee for item no. 32. Treasure Ortiz spoke on agenda meeting minutes, Public Records Request from the City Clerk's office, the existence of a letter of intent, and legal issues with charges for the State of the City. James Smith praised the State of the City event and its positive impact. Discussed improvements mentioned at the event. Tony Lara addressed flooding issues in the 6th ward and drainage problems on 19th Street. Mike Hartley spoke on unresolved code enforcement issues and proposed heavier fines. Kathy Mallon shared past health issues and expressed gratitude for being able to participate in Mayor and City Council meetings, requested Artificial Intelligence captioning. Junior Carrillo praised Lydie for her leadership and community support in Parks and Recreation. Henry Nickel addressed fireworks' impact on his ward, street light outages, and home burglary issues. Planned to bring these issues to future meetings. Micheal Davis spoke about a prior Council Meeting he attended and not providing his public comment. Clarified his position on the crime-free housing ordinance and potential professional misconduct of the Police Department. Gina Mirilez raised concerns about the Homeowners Association improprieties and potential child endangerment at her residence. Ronney Murphy raised issues at the Elks lodge and requested follow-up. Dolores Armstead criticized the former finance director and City Manager and questioned the legality and cost of the State of the City event, calling for an investigation. Georgia L. discussed the State of the City, the launch of the mobile pet clinic, and other concerns in animal services. Ray Blum spoke regarding item No. 27 for GFR tract final approval addressed concerns about property boundaries and requested more time for determination. Lydia Zavala addressed issues with animal services, emphasizing the need for a vet in the mobile clinic and critiquing volunteer experience. Al Palazzo expressed interest in becoming City Manager and Economic Development Manager, proposing job training and housing initiatives. Requested to present ideas to Mayor and City Council.
