Subject: Public Comment for Special Meeting May 22, 2024 Re: Firing Charles Montoya
Mr. Montoya, the City Manager, MUST be fired immediately with cause for violating his contract
under several San Bernardino Municipal Code (the “Code”) / The Charter of The City of San
Bernardino (the “Charter”) statutes.
Mr. Montoya’s actions prior to the Regular Meeting on May 15, 2024 amplifies the urgency for
the Council and Mayor to correct their mistake from 18 October 2024 and abrogate Mr. Montoya’s
contract. Violations are from not following the several sections of the San Bernardino Municipal
Code / The Charter of The City of San Bernardino, Article IV: City Manager, Section 401: Powers
and Duties.
The firing of Ms. Whitehorn, under threat, abusing his color of power, violates subsection (d) “the
City Manager is to ensure the Mayor and Council are to be informed on all aspects of important
emerging issues, including the City’s financial condition and future needs”, PLUS subsection (o)
“Make business and policy recommendations based solely on his or her independent professional
judgment and best practices in the interests of the City;”
Mr. Montoya publicly stated in the January 31, 2024 Study Session that he had signed a Letter of
Intent with Stifel, Nicolaus and Company to submit a bond proposal for the City Hall renovation
without knowledge or approval of the Council or Mayors is a violation of the Municipal Code / City
Charter. Under Article IV: City Manager, Section 401: Powers and Duties it does not stipulate
signing Letters of Intent is part of his duties.
Pick a lane of transparency or pick a lie.
As to the lack of public access to this Letter of Intent with Stifel:
1) The City Clerk is consistently violating PRA / FOIA laws under the
commands of the City Manager, breaking the law and breaking her
oath of office;
2) The Letter is in the back pocket of the City Manager and he has zero
intent of filing it with the City Clerk, or both, and;
3) The Letter of Intent never existed and he bold-faced lied to the
Council, the Mayor, as well as the businesses and citizens of
San Bernardino.
The firing of Ms. Whitehorn, under threat, abusing his color of power, notates subsection (d) “the
City Manager is to ensure the Mayor and Council are to be informed on all aspects of important
emerging issues, including the City’s financial condition and future needs”, PLUS subsection (o)
“Make business and policy recommendations based solely on his or her independent professional
judgment and best practices in the interests of the City.” He held to his promise of threat in the
impotent official press release on May 17th, 2024, implementing her firing as problems in her
department.
City Manager Montoya now has implicated himself in knowledge of other financial disparities and
improprieties, and has said nothing.
Although his professional background of consistently making bad decisions with taxpayer dollars,
from Castle Rock CO, Florence AZ, Watsonville CA, and Avondale AZ, you five: Theodore
Sanchez, Sandra Ibarra, Juan Figueroa, Fred Shorett, and Helen Tran, hired him with full
confidence. Now we the people of San Bernardino will not tolerate the autocracy over our
democracy and give our financial key of success to a 4-time fired failure and fallback into
bankruptcy.
If the Mayor and Council are having difficulty providing a productive and a positive health, safety,
and wellness stated under the Charter for the residents, remember there are only 741 days until
the 2026 Primary.
