I am dismayed by your closed session vote regarding Ms. Calvin's possible censure and how
there appears to be a perception that the left-side-of-the-dais continuously tries to reprimand
her (or very vocal members of the community) for speaking on matters of public transparency.
At the heart of it, are still many unanswered questions that citizens still have regarding the
events leading up to carrigan's claim.
Why has no one initiated a complaint or investigation regarding the 3rd undisclosed candidate
who pulled out of the running because his employer was contacted, and in effect sabotaged the
hiring process. He was allegedly a very qualified and remarkable candidate!! There was a
breach of confidentiality related to that candidate which no one is addressing except Ms.
Calvin. You all, with the exception of Ms. Calvin and Mr. Reynoso, voted to continue the city
manager selection process in the fall even while Ms. Calvin alarmed you all that there was a
breach of privacy. Legal (Sonia Carvahlho) was present and provided absolutely no
commentary or direction, which is evident in a public recording of the meeting. You chose to
continue the recruitment efforts with a poor pool of candidates, finally settling on Montoya at
the bottom of the barrel. One of you even stated we would be lucky to find a candidate with a
clean record to paraphrase it.
Why has no one questioned Rojas' involvement in divulging confidential information to Mr.
Carrigan and why hasn't Susie Soren been reprimanded for reaching out to Carrigan indicating
that there is word out there that the City cost him his job, (paraphrasing). As a former HR
director for the City of San Bernardino, it was and IS HER DUTY to express herself with
more tact and discretion. Any competent HR professional would not make such a statement
exposing us to liability and litigation, and moreover, there is insult added to injury now that
she is the newly promoted Deputy City Manager. This just speaks to her ineptitude in her role
to safeguard the City
There are people who need to be censured, but it wouldn't be Ms. Calvin. Some of you have
called out members of the public by name, engaging in circus-like behavior on the dais. Some
of you have been caught on a hot mic indicating a member of the public was "so full of shit."
Some of you may have pending suits coming forward in the near future. My aim is not to
highlight your wrongdoings, (at least not my primary reason), but to call you out for the
unequal treatment being afforded to Ms. Calvin and others in the community. In fact, there
may be others who may have had a bigger involvement in this breach. The public believes you
are looking for a scapegoat to blame and the timeline of events does not add up. Also, how are
you releasing documents on a pending litigation? It's that even legal? Or has a settlement
already been decided behind closed doors. I can barely get the CM to release his Letter of
Intent, but for this matter it was quickly a matter of public record.
There seems to have been someone who STRATEGICALLY leaked the info to the press
regarding Carrigan, and that is probably the same person who leaked information on the
leading candidate with distinguished credentials. But again, no one is speaking about that
breach of privacy and sabotage that resulted in the strongest candidate we had pulling out of
the recruitment for CM.
The city cannot afford any more mindless and avoidable suits and if BBK cannot defend the
City against ridiculous claims, perhaps we are better suited and due for a much-needed RFP
for a new legal service provider. We will look into preparing public comments to address this
further in the near future.
