Recommended motion:
That the City's participation in the cost of widening
Highland Avenue, east of Boulder Avenue, be approved, and
the Directors of Finance and Public Works be directed to
identify the necessary funds in the 1986/87 Street Con-
struction Fund Budget to finance the estimated City's
share of $70,000.

Approximately 1200 units will be constructed in the Highland Hills
Development. Two access points will be provided to Highland Avenue. Traffic
studies indicate that the majority of the residents (at least 70%) will use
the westerly point.
The projected traffic volume, between the westerly access point and
Boulder Avenue, is sufficient to warrant 4 traffic lanes. Widening of the
existin~ roadway to provide 4 traffic lanes will be done by the developer, as
provided in the conditions for approval of the development. Caltrans has
agreed to design the new bridge over City Creek as a 4 lane facility, in con-
junction with the interchange for the Route 330 freeway.
Projected traffic volumes, from the westerly access point to the east
boundary of the development, are not sufficient to mandate 4 traffic lanes.
However, 4 lanes are deemed necessary for continuity, since Highland Avenue
to the east of this development is being improved as a 4 lane facility in the
County. '
The developer has agreed to bear one-half of the estimated cost of
$225,000, for widening Highland Avenue, east of the main access point, to
4 lanes (without normal shoulders).
The County has indicated a willingness to finance one-half of the
remaining $112,500.
Both City and County Traffic Engineering Staffs feel that normal 8
foot shoulders are needed to avoid an accident or liability problem. The
estimated cost of widening Highland Avenue an additional 12 feet to provide
normal shoulders is $28,000. It has been proposed that this cost be financed
equally by the City and County. The total City's share will be $70,500.00.
An understanding was reached last year that the City and County
would participate equally in this widening, up to an amount of $125,000 each.
This understanding was recognized by inclusion of $125,000 in the City's
1985/86 Street Construction Fund. All of these funds have since been
transferred to other projects.
All necessary rights.of way for the widening will be granted by the
developer at no cost.
The County will proceed to prepare a joint cooperative agreement for
this widening, with the City indicated as the lead agency. This arrangement
is due to the fact that the development is within the City limits.
Funding for the City's share will have to be identified in the
1986/87 Street Construction Fund 8udget. The recommended motion approves
the City's participation and directs staff to identify the funds for in-
clusion in next year's budget.

8. If General seeks an attrition allowance for 1987, such
request must be filed under the present application number and TURN
will receive notice and can comment as to the necessity of hearing at
that time.
Conclusions of Law
1. General's petition for modification should be granted.
2. TURN's petition for modification should be denied.

IT IS ORDERED that:
1. D.85-12-081 is modified as follows:
a. The third, fourth, and fifth sentences of the
first full paragraph on page 24 are deleted.
b. Conclusions of Law 5 and 6 are deleted.
c. Ordering Paragraph 2 is deleted.
2. TURN's request to modify D.85-12-081 is denied.
This order is effective today.

I concur in the decisi~n, ~^cept for the treatment of the Central
Office Switching Equipment penalty. I dissent from the majority's
decision to rescind the $6 million revenue requirement penalty
