CITY OF SAN BERNARDIIlO - REQUEST FOR COUNCIL ACTION
STAFF REPORT
The United States of America Air Force, through the Department of the
Army, has purchased the homes located between Mill Street and Central
Avenue, East of Tippecanoe Avenue. Subsequently, these improvements
have been removed.
The Department of the Army has requested that the dedicated streets
within that area be vacated in order that they may maintain the area.
It is also requested for security reasons.
It is the opinion of this Division that there is no further necessity
for the streets and alleys, to be vacated by the attached Resolution,
ei ther for present or prospecti ve street purposes. Therefore, we
recommend the vacation on the basis of the following Findings of Fact:
1. We have 100% consent of the abutting property owners.
2. The streets and alleys have been determined, by the Planning
and Publ ic Works Department, to be of no further necessi ty to
the general public.
3. By virtue of the posting and publication of this proposal,
neither this office, nor the City Clerk's office, has received
any written protests against the vacation as of this date.
4. All interested Department Heads and utility companies have been
notified of the vacation.
a) A reservation for sewer facilities within Mill Street has
been provided for an existing sewer main.
We recommend the adoption of the attached Resolution.

A RESOLUTION OF TilE CITY OF SAN BERNARDINO VACATING HILL
STREET BETHEEN TIPPECANOE AVENUE AND CALIFORNIA STREET; SANTA
FE STREET BEHIEEN TIPPECANOE AVENUE AND FAIRFAX DRIVE; SULLIVAN
STREET BETHEEN TIPPECANOE AVENUE AND FAIRFAX DRIVE; ERHIN
STREET BETWEEN SULLIVAN STREET AND SANTA FE STREET; FAIRFAX
DRIVE BETWEEN A POINT APPROXIMATELY 150 FEET SOUTH OF SULLIVAN
STREET AND A POINT APPROXIMATELY 150 FEET NORTH OF SANTA FE
STREET, THAT CERTAIN UNNAMED STREET BETWEEN SANTA FE STREET AND
SULLIVAN STREET, EAST OF FAIRFAX DRIVE AND A POINT APPROXIMATE-
LY 140 FEET EAST THEREOF; THAT CERTAIN ALLEY BETWEEN SULLIVAN
STREET AND A POINT APPROXIMATELY 140 FEET NORTH OF SANTA FE
STREET, IN THE CITY OF SAN BERNARDINO AND RESERVING A PUBLIC
UTILITY EASEMENT WITHIN A PORTION OF MILL STREET, EAST OF
TIPPECANOE AVENUE.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1: The Mayor and Common Council of the City of
San Bernardino, having heard the evidence offered in relation
to the proposed vacation of Mill Street between Tippecanoe
Avenue and California Street; Santa Fe Street between
Tippecanoe Avenue and Fairfax Drive; Sullivan Street between
Tippecanoe Avenue and Fairfax Drive; Erwin Street between
Sullivan Street and Santa Fe Street; Fairfax Drive between a
point approximately 150 feet South of Sullivan Street and a
point approximately 150 feet North of Santa Fe Street, that
certain unnamed street between Santa Fe Street and Sullivan
Street, East of Fairfax Drive and a point approximately 140
feet East thereof; that certain alley between Sullivan Street
and a point approximately 140 feet North of Santa Fe Street,
more particularly described in City Resolution of Intention No.
86-189, hereby find from all of the evidence submitted that
such streets and alleys, proposed to be vacated by said
Resolution, are unnecessary for present or prospective street
purposes.

SECTION 2. The Mayor and Common Council of said City do
2 hereby vacate Mill Street between Tippecanoe Avenue and
3 California Street; Santa Fe Street between Tippecanoe Avenue
4 and Fairfax Drive; Sullivan Str"eet between Tippecanoe Avenue
5 and Fairfax Drive; Erwin Street between Sullivan Street and
6 Santa Fe Street; Fairfax Drive between a point approximately
7 150 feet South of Sullivan Street and a point approximately 150
8 feet North of Santa Fe Street. that certain unnamed street
9 between Santa Fe Street and Sullivan Street. East of Fairfax
10 Drive and a point approximately 140 feet East thereof; that
11 certain alley between Sullivan Street and a point approximately
12 140 feet North of Santa Fe Street. San Bernardino. California.
13 more particularly described as follows:
14 All those streets and alleys as delineated on
Tract No. 3309 as per plat recorded in Book 44

East of the East line of Tippecanoe Avenue and
16 that portion of Mill Street lying between a
point 50 feet East of the center line of

SECTION 3. This Resolution shall reserve. and nothing
herein shall in any way affect or di sturb each and every
San Bernardino or to any public utility and there is further
reserved for present and future general public utility purposes
and for this City an easement reasonably necessary to locate
sanitary sewer. public utility and appurtenant facilities over.
in. under or across said Mill Street along with the right to

use, install, maintain, repair, replace or renew such

facilities and those reserved by Resolution of Intention No.
86-189.
SECTION 4. The City Clerk 01 t/Je City of San Bernardino
shall cause a certified copy of this Resolution to be recorded
in the offi ce of the County Recorder of the County of San
Bernardino.
