The applicant requests approval to chanze the zone of a parcel encompassing approximately .30 acres from R-1-7200, Single- Family Residential to R-3-1200, Multiple-Family Residential District on tae east side of Sepulveda Avenue between 25th and 27th Streets. 2. The site is designated Medium Density Residential (8-14 dwelling units per acre) on the City of San Bernardino General Plan. Said General Plan designation is delineated from approximately 400 feet north of Highland Avenue to 27th Street (on both the east and west sides of Sepulveda Avenue). The zoning district to the north, west and east of the site is R-1-7200. Property to tae immediate south of the project is zoned R-3-1200, Multiple- Family Residential. 3. The encroachment of multiple-family residential development from the south is apparent. The applicant has indicated that they intend to develop residential unit/units on the rear portion of the parcel. The lot measares approximately 50 x 258.5 feet in width and depth respectively. The R-3-1200 zone under Section 19.12.030(B) and (C) of the San Bernardino Municipal Code specifies a minimum width of sixty feet and the minimum depth of one hundred and thirty-five feet. The parcel in question is nearly a third of an acre in size, however, the measurement is long and linear as are other parcels within the neighborhood; the parcel is thus, underutilized at the present time, since the existing house and yard occupy about half of the site. The Review of Plans application and support data must be sub- mitted to the Planning Department in order to determine if any additional residential development is appropriate on said parcel per the R-3-l200 development criteria. 4. At the regularly scheduled meeting of t.he Environmental Review Committee held on May 1, 1986, a negative declaration was recommended for Change of Zone No. 86-9. RECOMMENDATION Based upon the above observations, Staff recommends adoption of ~he negative declaration and approval of Change of Zone No. 86-9. Respectfully Submitted, FRANK A. TIle applicant requests approval to zone a 29.4 acre parcel of land recently annexed to the City (Annexation No. 339) to C-M, Commer- cial Manufacturing. The subject property was formerly zoned residential and commercial in the county and is partially developed with single-fam~ly residences on approximately 22 acres; the remaining 7.4 acres adjacent to the 1-10 Freeway are vacant. The subject property is located north of the 1-10 Freeway, south of the former San Bernardino corporate limit, east of Tippecanoe Avenue, and west of Orchard Drive. 2. Land uses and zoning surrounding the site include: 246.5 acres zoned C-M, Commercial Manufacturing under development as the Tri-City Corporate Center to the north and west; C-2 and C-M in the City of Loma Linda to the south; Commercial and Residential zoned R-l, Single Family Residential and C-3, General Commercial in the unincorporated county to the east. 3. The proposed zoning is consistent with the San Bernardino General Plan which designates the site and surrounding properties for Commercial and Industrial uses. 4. Included in this property is Tract 2743, recorded in 1944. The residences in this subdivision would become non-conforming uses under the C-M zone. Chapter 19.66 of t he San Bernardino Municipal Code specifies the following relative to non-conforming uses. These provisions include: . additions and alterations may be made with the approval of the Planning Commission through the presentation of a petition of 75% of the property owners within 500 ft; it is done following the procedures of the Variance chapter; and the Common Council approves. reconstruction of any destruction caused by fire or Act of God, not in excess of 50% of the replacement value, may be permitted once the use is discontinued for a period exceeding 180 days, it may not be reestablished unless done so in conformance with the provisions of the district in which it is located 5. Tne residential tract of homes is an isolated residential development. The surrounding uses anJ Jevelopments, the Tri- City redevelopment area to the north and west are consistant with the General Plan designation of General Industrial. 6. We are an ~rea of small s,ngle family homes which are mostly owner occupied. Fifty foot lots are just too sll'.all to accomodate apartrr.ent buildings, or multi family residences as you choose to call them. Sepulveda is a very narrow street and the increase in traffic would create serious safety problems for the many small children who live in the ne~ghborhood. I feel that we would ha.ve a constant traffic "jam" around the entrance to lot number 2601. Surely, instead of strangling us, the city can find more suitable lane for those promoters who wish to do this kind of building. ". This street is alreRdy oVer-run with vehicles, some of which use it as a raceway. Only a couple of weeks ago the crepe ~le tree in our neighbor's yard was destroyed by a speeding auto. Also, from Highl~nd Avenue to 24th street on Sepulveda, there are 7 apartment buildings on the east side, 4 on the west side, plus 1 small apartrrent in back of a large house. At the intersection of Sepulveda at 27th Street there is an Olive Crest Horre for boys which creates more traffic. We have lived at this address since 1953. Slowly but surely our residential area has been infiltrated by apartment after apartment. Ii' this street is classified as residential, why are landowners allowed to build apartment complexes in every block; There are too many cars on this street now. MEET ING .... n'l._ MAR,I'I. - ""' ) c Craig & Debbie Swal~ 3780 Camellia Drive San Bernardino, CA 92404 City of San Bernardino Mayor and City Council Members May 30, 1986 Dear Mayor and City Council Members, This letter is to appeal decision of the Planning Commission on May 20, 1986, regarding Zone Change 86-9. We feel we did not receive fair consideration. At the meeting on May 20, our zone change was considered along with Zone Change 86-8. Our lot is almost twice the size of that lot and the two are no where near each other. These should be considered separately. We feel our zone change should be passed as per the Planning Departments recommendation. Our lot measures 50' X 258k'. Although our lot is slightly narrower than standard R-3 lots it is very deep. The existing house is at the very front of the lot and more than half" of the land is unused. This is also characteristic of the surrounding lots. Many of the backyards are full of weeds and debris causing an extreme fire hazard. Most of the houses in this neighborhood are being rented and the backyards are unkept. By changing our zone to R-3 we can therefore build some units to the rear and utilize our property. Under the current building codes we could only build a couple units and we would be required to provide on site parking, there- fore this should not cause any more traffic than is already there. The lots to the South are zoned R-3 and we feel this would be unfair to deny our request. The logical place to end the R-3 zoning would be at a corner not in the middle of a block. Unfortunately, people who do not oppose this zone change don't wri te letters and do not take time to come to City Council meet- ings. So as we see it, out of 139 homeowners who received the letter regarding this zone change, only 5 people opposed it. That means 134 do not oppose it. Out of the five that oppose it, one person lives on another street, one lives two doors north, and three live accross the street. I went to talk to these people and explain what we wanted to do was not build apartments as th~ automatically think when they think R-3, but to build a couple one bedroom units with on site parking. I detected a tone of jealousy as one man stated" They are going to let all these people change their lots to R-3 and ours will never be changed because our lots are only 135' deep." We are residents of San Bernardino and own several rentals. All of which we are very proud. We recognize the need for clean, well kept rentals and we feel by adding units to this lot it will be to the best interests of this neighborhood and San Bernardino.
