April 22,1986. . A. This proposal affects my ) parcels of land, IE, 0267-q11 -21 0262-201-09 and 0262-201-10 (jointly owned by myself, Eileen S Arnold and daughter Sheila K Arnold). B~ Proposal is to change my 'life style' at a time when I am in my 8~h year, living on a fixed income which is now just adequate. To suddenly be thrust into city life with all of its mythical benefits, which incudes increased taxation which I won't be able to afford) increased service expenses(which I can't afford) plus the projection into living in city life environment which I've avoided all my life. C. Proposal for annexation into the city was made according to ) notices to me indicate that request was made by a single property owner, not resident in this area. Infact there has been no permanent resident in this specific area(exclusiveof the,' hamlet of Muscoy,' except myself for over 15 years. D. This is the second proposed upheaval of my life style. It hap- pened in 1956v wbp.n,Shandin Hills pushed the only two long-t1me residents off !endall Drive to make way for a beautifying Golt. Club. The two reS1uents were myself owner of Erewhon Ranch, and A~@ Lyons who owned the Circle DiamondRanch.After 30 yearS they (Shandin Hills Vevelopment) finally built the uolf Course (not even on the side of the hill upon which our Ranches existed.) C. The result was that my whole life style was disrupted as was my dau~hte~ schooling all of which was unnecessary since tor apP~oX1mately Some )0 years that land lay IDLE. What I have written is purely the personal affects of this proposal. What you should take a look at is the ~IRE HAZARD to a . populated area, the ~LOOD CONTROL INADEQUACY- the ODIrEROUS STENCH- from the DOG ~OOD rACTORY . The product may be DRY DOG ~OOD, but the cooking or processing of the ENTRAILS of slaughtered animals is what provides the odor. During summer, it is necessary to close all doors, a~a windows. It is not possible to sit outside in the evening or have a barbecue. As for the Railroad tracks along Santa Fe. Only one passenger train (Amtrak) travels this route per day, but all day and all night, the freight trains loaded with cars, tractors. etc shunt back and foth resulting in all the walls of the houses Shaking and Sonic booms (from the dog factory) which crushes all their ~efuse nightly and the glare of a big searchlight which operates nightly are not going to be acceptable to ~enants who believe they are moving into a RESIDENTIAL area. This place is definitely a Commercial Industrial area and one that is needed and one that rural loving tenants will put up with in order to enjoy the privacy that city life does not guarantee. ~. , ~Sineere~!, . The applicant is proposing to subdivide 72.8 acres into 278 lots located on the westerly side of Cajon Blvd., and north of June Street. The existing zoning for the site is C-M, Commercial Manufacturing, (2.4 acrea) adjacent to Cajon Blvd., and the remaining portion of the project (70.4 acres) site is zoned R-1-7200, Single- Family Residential, minimum lot size is 7200 square feet. 2. The General Plan designates the site for general industrial types of land uses adjacent to Cajon Blvd., and low-medium density residential, 4-7 units per acre for the remaining portion of the project. Therefore, the proposed development, as requested, conforms to the City's Gene!al Plan. Lot No.1, which fronts onto Cajon Blvd., is 2.4 acres in area and is proposed to be a commercial development for the overall. tract. The remaining lots will be for single-family homes and will meet the minimum requirements of the R-1-7200 standards for lot area, depth and width. In phase 2 of Tract 13274, lots 2 thru 9 and portions of 13, 14, 15, 16 and 17 are within the existing C-M zone. The applicant is aware of this and will be submitting an application for a change of zone to realign the legal description of the R-1-7200 and C-M z.one boundary to conform to ':chat boundary established within Tract 13274 as proposed. Said zone change request is a conditon of approval of the tract map. 3. The overall development is proposed in 7 phases; Phase 1 being the commercial lot adjacent to Cajon Blvd., comprised of 2.4 acres, Phase 2 consists of 10.0 acres and will be comprised of 39 units with a density of 3.9 units per acre, Phase No. 3 will have 13.5 acres comprised of 53 units with a density of 3.93 units per acre, Phase No 4. will consist of 12.9 acres comprised of 53 units for an overall density of 4.1, units per acre, Phase No. 5 having 10.6 acres and 44 units will have a phase density of 4.15 units per acre, Phase No.6 with 13.1 acres and 44 units will have a phase density of 3.36 units per acre and the final phase, NO.7, will have 10.3 acres and 44 units with a phase density of 4.27 units per acre. With all 7 phases complete, the overall density of the entire project will be 3.82 units per acre in conformance with City's General Plan designation of low medium density of 4-7 units per acre. To the south lies existing single-family developments that have been constructed within the unincorporated area of San Bernardino County. Several streets within these single-family tracts presently stub into the proposed development. The proposed tract has been designed to allow a circulation pattern in and out of the unincorporated area. Those streets that are going to provide ingress, egress of the tract are Acapulco, San Benito, Carmelina, Don Diego, Vermont and Bronson Street. 5. To the west of the site lies the Devil Canyon Diversion Channel a 100 foot right-of-way for Pepper/Linden Avenue. Pepper/Linden Avenue is presently indicated on the City's General Plan within the circulation element as a proposed major arterial. No access has been proposed for access onto Pepper/Linden Avenue. 6. Within the development are proposed landscaped, open space lots. These lots will be utilized for both recreational activities as well as having a secondary function as drainage retention basins during heavy storm conditions due to the lack of drainage facilities to the south. These lots are designated as lettered lots. Lot "A" being located within phase 2 on the north side of June Lane, Lot "B" being within phase 3, located on the south side of "B" road, Lot "C" being indicated within phase 5 on the north side of "C" Road between,,"E" Court and "D" Road. These retention basins are'- to capture runoff from the roadways and hold the runoff for a short period until the runoff percolates into the ground. Some runoff will be released back to a roadway to allow proper drainage from the site in heavy storm conditions. These retention basins, as proposed, are presently being worked out as to details by the applicant through the City Engineering Department. Said retention basins/open space areas will be maintained by an assessment district which will be established for the tract. 7. At the northern terminus of "F" Court in phase 6 and the northern terminus of "G" Court of phase 7, the cul-de- sac right- of- way is extended to the rear lot line of the adjacent single-family lot. Staff has been in contact with the applicant's engineer concerning this matter to which the applicant has agreed to a one foot holding strip to disallow vehicular movement from the cul-de-sac to the rear yard of the adjacent parcel. The Covenants, Conditions and Restrictions (CC&R's) shall be reviewed and approved by the Planning Department prior to final approval of the tract maps. The CC & R's shall include liability insurance and methods of maintaining the open space, recreation areas, parking areas, private roads, and exterior of all buildings. The CC&R's shall also include a statement that no radio frequency antenna shall be included within the complex except for central antenna systems. b. No lot or dwelling unit in the development shall be sold unless a cor- poration, association, property owner's group, or similar entity has been formed with the right to assess all properties individually owned or jointly owned which have any rights or interest in the use of the common areas and common facilities in the development, such assessment power to be sufficient to meet the expenses of such entity, and with authority to control, and the duty to maintain, all of said mutually available features of the development. Such entity shall operate under recorded CC&R's which shall include compulsory membership of all owners of lots and/or dwelling units and flexibility of assessments to meet changing costs of maintenance, repairs, and services. The developer shall submit evi- dence of compliance with this requirement to, and receive approval of, the Commission prior to making any such sale. This condition shall not apply to land dedicated to the City for public purposes. c. The documents covering this matter shall be prepared by the owner and approved by the Planning Department. All refuse storage areas are to be enclosed with a decorative wall. Lncation; size, type and design of wall are subject to the approval of the Planning Department and Division of Public Services Superintendent. Energy and noise insulation shall comply with all state and local require- ments. 2 LANDSCAPI NG: a. Three copies of a master landscape plan shall be submitted to the Planning Departmentl Park and Recreation Department for review and approval. The plan shall include, but not be limited to, the foIl owi n g : 1) Size, type, and location of plant material proposed. 2) Irrigation plan. 3) Such other alternate plants, materials and design concepts as may be proposed. 4) Erosion control plans. b. The developer shall obtain Planning Department approval of the visual or engineering design of the proposed wall. When graded slopes occur within or between individual lots, the slope face shall be a part of the downhill lot. All utility lines shall be installed underground subject to exceptions apprqvpd by the Planning Department and the City Engineer.
