Schuma From: Planning Director Subject: Amendment to the San Bernardino Municipal Code, Sections 19.56.440 and 19.56.020 - Parking of Recreational Vehicles Mayor and Council Meeting of May 19, 1986, 2:00 p.m. Dept: Planning D~~ May 8, 1986 Synopsis of Previous Council action: Previous Planning Commission action: At the meeting of the Planning Commission on May 6, 1986, the following recommendation was made: The proposed amendment to the San Bernardino Municipal Code, Sections 19.56.440 and 19.56.020, pertaining to parking of recreational vehicles, was recommended for approval, with wording and modification as noted in the memorandum to the Planning Commission dated May 6, 1986. The Negative Declaration for environmental review was also recommended for approval. Recommended motion: To approve the responses to comments and to adopt the Negative Declaration for environmental review which has been reviewed and considered. To approve, modify or reject the findings and the recommendations of the Planning Commission and to direct the City Attorney to prepare the necessary amendments to the Zoning Ordinance. ~/~ L ~..\/\. Since most truck campers are placed on 3/4 ton trucks or less, it is recommended that only the larcer trucks over 3/4 ton which are less likely to be used for basic transportation be required to comply with the proposed provisions. Based upon the above noted observation, it is recommended that Section 19.56.440B be modified to read as follows: "B. For the purpose of this section' recreational vehicle' is a motor home, travel trailer, truck camper over 3/4 ton, or caQping trailer, witn or without motive power, designed for human habitation for recreational or emergency occupancy, which meets all the following criteria:" Respectfully Submitted, FRANK A. ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTION 15.52.020 AND ADDING SECTION 19.56.440 TO THE SAN BERNARDINO MUNICIPAL CODE TO REGULATE PARKING OF RECREATIONAL VEHICLES, BOATS OR TRAILERS IN THE REQUIRED FRONT YARD OR STREET SIDE YARD SETBACK IN RESIDENTIAL DISTRICTS, AND IN OTHER PLACES. THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: SECTION 1. Section 15.52.020 of the San Bernardino Municipal Code is amended to read: "15.52.020 Parking regulations. A. No trailer or mobile home shall stop, park or stand on or in any property zoned for residential use or occupied for residential purposes except as provided herein, or as authorized by Section 19.56.440 of this Code. One trailer or one mobile hone may be parked in an accessory buildi~g, private garage building 01 directly to the rear of the dwelling house or garage and upon the sa~e lot, provided t~at there is compliance with esch of the fellowing conditions: 1. The lengt~ therecf shall not exceed thirty-five feet for a mobile home, fifteen feet for a utility trailer, open ('1- enclcsed, and twenty-five feet for Ii boat trailer. 2. Any trailer or mobile home shell comply with the current provisions of the Vehicle Code of the state, and shall be maintained in an operative condition at all time5 ~ith tires maintained and inflatrd to nClffial operating pressures. , J' The trailer or mobile home shall have an ullinpeded access to a public way withoLt the need for removal of any structure or for any special ground preparation. There shall be no human habitation or occupancy of trE.iler or mobile home and utilities shall not be connected E. 1he term 'trailer or mobile home' for purposes of this 5 Chapter, shall be deemed to include recreational vehicles, boats 6 and trailers. 'Recreational vehicle' is defined in Section i 19.56.440 of this Code." 8 SECTION 2. Section 19.56.440 is added to the San Bernardino 9 Municipal Code to read: 10 "19.56.440 Recreational vehicle, boat or trailer parking in 11 residential districts. 12 A. It is unlawful for any person to stop, stand or park a 13 recreational vehicle, boat or trailer in the required front yard 14 or street side yard setback of any residential district, for a 15 period exceeding seventy-two hours, or for more than seventy-two 16 hours in anyone week. 17 B. For the purpose of this section 'recreational vehicle' 18 is a motor home, travel trailer, truck camper, or camping 19 trailer, with or without motive power, designed for human 20 habitation for recreational or emergency occupancy, which meets 2] all of the following criteria: 22 1. Contains less than three hundred and twenty square feet 23 of internal living room area, excluding built-in equipment, 24 including, but not limited to, wardrobe, closets, cabinets, 2fl kitchen units or fixtures, and bath or toilet rooms. 26 2. Contains four hundred square feet or less of gross area 27 measured at maximum horizontal projections. 28 3. Is either self-propelled, truck-nlounted, or permanently t~wable on the highways without a permit. C. The provisions of Section 15.52.020 of this Code shall apply to parking of a recreational vehicle elsewhere on residential property."
