AQenda Item~""" ~ ~ CIT' OF SAN BERNARDIIIP - REQUew FOR COUNCIL AClPN STAFF REPORT This action is the result of a motion made by your Honorable Body on March 17, 1986, in response to requests for the installation of traffic signals at the intersection of University and Hallmark Parkways due to the growing traffic problem in that area. The purpose of the action is to preliminarily determine that the public convenience and necessity require the formation of an improvement district; declaring the intention to proceed to order work within the district to be known as the "University and Hallmark Parkways Signalization District". April 18. 1986 File No. 14.40-44 ENGINEER'S REPORT CITY OF SAN BERNARDINO PROPOSED ASSESSMENT DISTRICT NO. 973 UNIVERSITY AND HALLMARK PARKWAYS SIGNALIZATION DISTRICT PETITION -- There has been no petition filed for this project. The Mayor and Common Council initiated this project by action at their meeting of March 17. 1986. AUTHORIZATION TO PROCEED -- On March 17. 1986, the City Engineer and City Clerk were authorized to initiate proceedings under the provisions of Chapter 12.90 of the San Bernardino Municipal Code and the City Engineer was directed to prepare this report. DESCRIPTION OF IMPROVEMENTS -- The improvements to be constructed include poles. controllers, mast arms, signal heads, detector loops and all appurtenant facilities for the installation of four way traffic signals at the intersection of University Parkway and Hallmark Parkway. PLANS AND SPECIFICATIONS -- Plans and Specifications for the installation of the signals are being prepared by the Department of Public Works, Engineering Division and will be approved by your Honorable Body before construction begins. DESCRIPTION OF BOUNDARIES -- On March 19, 1986, the boundaries of the proposed district were determined and are delineated on the attached Proposed Boundary Map of Assessment District No. 973. The property involved presently are all of those properties located within what is known as the Hallmark Development Area and is bounded on the North by Interstate Freeway No. 215, on the South by the A.T.& S.F. Railway, on the West by Pepper Linden Drive and on the East generally by University Parkway. VICINITY MAP -- The vicinity map is attached as Exhibit 1. DISTRICT BOUNDARY MAP -- A reduced copy of the District Boundary Map is attached as Exhibit 2. 1 . . . . . . METHOD OF ASSESSMENT --It is somewhat difficult to determine the benefit which attaches to individual parcels of land by the installation of traffic signals, expecially when a majority of the parcels are undeveloped, as in this case. The necessity for the signals is prompted by the development of the land on both sides of University Parkway at this location, therefore those lands are the direct beneficiaries of the signals. After much deliberation, it was determined that the possibility of a large parcel generating more traffic than a small parcel was a viable conclusion. Hence the benefit received by the respective parcels was determined to be in proportion to the area contained therein. The assessment, therefore, will be spread on the area of each parcel in proportion to the area of the district. The boundaries of the proposed district are drawn with this in mind and the Resolution of Intention delineates this fact. METHOD OF FINANCING -- The City will upfront the costs of the construction and incidentals and will be reimbursed over a ten (10) year period with interest at the rate of 10% per annum on the unpaid balance through assessments collected on the annual County Tax bills. NOTE--The City presently has the amount of $12,000.00 on deposit for the installation of these signals which was made by the property owner on the East side of University Parkway as his required proportional share of the cost of the signals. This amount will be subtracted from the total cost of the project before the assessment is prepared. By virtue of the deposit made by the property owner, this parcel is not included in the district. ASSESSMENT ROLL -- Presently there are 71 parcels liable to be assessed. The assesssment roll has been prepared to reflect the amount of the principal payment due for any given year on the estimated construction and administration cost for the project, attached hereto as Exhibit 3, and has been prepared to reflect the total principal cost to each parcel, attached hereto as Exhibit 4. BONDS -- No bonds are to be sold on this' proposed assessment district. costs will be up-fronted by the City and the assessments will .. collected on the County Tax bill annually for ten (10) years and bear interest at the rate of 10% per annum on the unpaid balance. RESOLUTION NO. RESOLUTION OF THE CITY OF SAN BERNARDINO PRELIMI- NARILY DETERMINING THAT PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE FORMATION OF A SIGNALIZATION CONSTRUCTION ASSESSMENT DISTRICT; DECLARING ITS INTENTION TO PROCEED TO ORDER WORK WITHIN THE DISTRICT, TO BE KNOW AS "ASSESSMENT DISTRICT NO. 973"; AND SETTING AND DIRECTING PUBLICATION OF NOTICE OF A TIME AND DATE OF A PUBLIC HEARING. WHEREAS, the City of San Bernardino (hereinafter called "City") as an exercise of its municipal affairs powers has enacted an Assessment District Ordinance (Municipal Code Chapter 12.90) to provide for the procedure for the formation of assessment districts within the City; and WHEREAS, it has now become necessary to consider the formation of a signalization construction assessment district within the City, to be known as "Assessment District No. 973"; and WHEREAS, as a further exercise of the powers vested in the City by virtue of Section 19, Article XVI, California Constitution, the City intends to conduct a hearing and hear protests, if any, as to why the district should not be formed and the acquisitions and improvements completed, without compliance with the Special Asssessment Investigation, Limitation and Majority Protest Act of 1931; NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO THAT: SECTION 1. Pursuant to Chapter 12.90 of the San Bernardino Municipal Code, the Mayor and Common Council of said City, hereby preliminarily find and determine that the public convenience and necessity require, and it is the 1 , . 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 . . . intention of the Mayor and Common Council to form Assessment District No. 973, the boundaries of which are generally, as follows: Bounded on the Northwest by Pepper linden Drive; on the Southeast generally by University Parkway; on the Northeast by Interstate Freeway 1-215; on the Southwest by the Atchison Topeka & Santa Fe Railroad right-of-way (Cajon Boulevard). Reference is hereby made to the Engineer's Report on file in the office of the City Clerk of said City for a map of the boundaries of said district, a description of the type of improvement, an estimated cost of the improvement and a proposed assessment roll which Report and Assessment District Map are hereby approved. SECTIDN 2. It is the intention of said Mayor and Common Council to order improvements within the district which improvements consist of, but are not limited to, the construction and installation of poles, controllers, mast arms, signal heads, detector loops and all appurtenant facilities. The estimated cost of said construction and installation, including incidental costs, is $130,800.00. The City of San Bernardino presently has $12,000.00 on deposit for the construction of said traffic signals and that amount will be contributed to the district thereby reducing the estimated cost to $118,800.00. SECTION 3. Said contemplated work and improvements is of more than local or ordinary public benefit, and that said Mayor and Common Council do hereby make the expense of 2 . 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 . . . such work and improvement chargeable upon the district, which district is hereby declared to be the district benefited by said proposed work and improvement, and to be assessed to pay the cost and expense thereof. All public streets or alleys, or portions thereof, hereby are excepted from said assessment. SECTION 4. The assessment benefit procedure to be followed and the amount to be assessed against each particular parcel will be a proportion of the total sum of the cost of the construction, installation and incidentals within the area in relation to the area of each parcel of land therein as they relate to a single family residential unit. Reference is hereby made to said Engineer's Report on file in the office of the City Clerk for a detailed estimated individual assessment. SECTION 5. The assessment financing alternative to be followed shall be as follows, to-wit: The costs shall be pre-funded by the City and the assessment levied, collected and enforced in the same manner, at the same time, and with the same penalties and interest as in the case of taxes levied for the City for the repayment to the City of said pre-funding. The City of San Bernardino presently has on deposit for the construction of said traffic that amount will be contributed towards the $12,000.00 signals and district. The assessment for said district shall be made and collected as follows: The costs of installation, construction and incidentals will be collected over a period of ten (10) years with interest at the rate of 10% per annum on the unpaid balance which remains unpaid for thirty days after the date of recording of the Notice of Assessment with the County Recorder. All assessments less than $150.00 shall be paid before the expiration of said thirty (30) days by cash, check or certified check made payable to the CITY OF SAN BERNARDINO and indicate the assessment number or numbers on the back thereof. If the assessment is not paid then the assessment becomes delinquent and the total amount shall be placed upon the tax rolls for collection with the regular property tax bill. SECTION 6. That notice is hereby given that on June 16, 1986, at the hour of 9:00 a.m., in the Council Chamber, in the City Hall of said City, there shall be a public hearing before said Mayor and Common Council for the purpose of determining whether the public convenience and necessity require the formation of the proposed improvement district without compliance with the Special Assessment Investigation, Limitation and Majority Protest Act of 1931 and whether the Mayor and Common Council should proceed with ordering the above described construction and installation. At said hearing, any and all persons interested may appear and show cause, if any they have, why the Mayor and Common Council should not find and determine that the 4 . . . 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 . . . public convenience and necessity require the formation of the proposed district without compliance with the Special Assessment Investigation, Limitation and Majority Protest Act of 1931; on the question of estimated cost, and the intention of the Mayor and Common Council to proceed to order work within the district. SECTION 7. At said public hearing, all persons will be heard, any holder of title to taxable real property within the boundaries of the proposed district may file a protest in writing with the City Clerk, not later than the hour hereinabove set for hearing, containing therein a description of the property in which the signer thereof is interested sufficient to identity the same, and, if the signers are not shown on the last equalized assessment roll as the owners of such property, must contain or be accompanied by written evidence that such signers are the owners of such property. The basis for determining the existence of a majority protest shall be based on the area of respective lots or parcels involved in proportion to the area of the entire district. SECTION 8.
