Honorable Mayor & Esteemed Councilmembers;
On March 5th, 1986 a traject event struck a very well known
west end family. On this day at approximately 9130 p.m. Felix was
a victim of a violent crime, one that was committed in his own home,
and touched everyone of his fami~y and friends. During this two
month period Felix has gone through pains and agonies that no person
should wish on another, Felix has spent two memorable events of
life in a hospital because of someone else's disregard for human
well being. On March 28th,1986 Felix passed his 28th birthday under
intensive care by physicians, and on April 12th, another milestone
in his life ... set aside this would have been Felix's wedding day.
In the past the Olguin family has contributed to numerous
charities and civic affairs, and are well recognized by various
groups associated with the development of our youth. On June 13th
thru 15th we the supporting Family and Friends of Felix are scheduling
a benefit softball tournament to offset the enormous medical liabilities
that eventually Felix and his family will have to repay.So it is

associated with the use of our city parks for this type ot event

The friends and family of Felix Olguin, Jr., have requested through Mayor and
Council waiver of fees for use of the Encanto softball fields on June 13 - 15
for a benefit softball tournament. Since the Olguin family have not finalized
arrangements for the use of this facility, the actual fees are undetermined.
Rental cost for both fields for tournament use is $230.00. Refundable deposits
are approximately $125, and the user will be required to provide a liability
policy naming the City as additionally insured.
This department opposes the waiver of any fees associated with facility use.
This position is based on the following:
1. The majority of Park and Recreation facility users are nonprofit organiza-
tions and pay fees as established by Resolution. The waiver of fees for one
user would set a precedent potentially resulting in requests by all users
for similar arrangements for their worthy causes.
2. Fees are based upon actual expenses incurred by the city exclusively for the
special use by the applicant. These expenses are for energy costs, ballfield
preparation fees, and administrative costs. Unless these costs are reimburs-
ed, they represent a gift of public resources to the special interest user
and directly reduce the services to the general public by an equal amount.
3. The traditional practice of providing weed abatement projects in 1 ieu of
waiving fees would be undermined.
It is my recommendation that the request for waiver of fees be denied and that
the Olguin family and friend be offered a weed abatement project to cover costs
for facility rental.
