Synopsis of Previous Council action:
04/21/86 -- Your Honorable Body adopted Resolution of Intention No. 86-

street located at the Southerly terminus of Varsity Avenue,
per attached Plan No. 6941.
Recommended moti.on:
1. That the hearing be closed and the Findings of Fact, as set forth in
the Staff Report from Roger G. Hardgrave, Director of Publ i c
Works/City Engineer, as to why that certain East/West unnamed street
located at the Southerly terminus of Varsity Avenue, is no longer
necessary for street purposes, be adopted.

STAFF REPORT
Upon receiving a request from 33% of the adjoining owners to vacate that
certain East/West unnamed street located at the Southerly terminus of
Varsity Avenue, and after notification of all interested City Department
Heads and Utility Companies, your Honorable Body approved the attached
Plan No. 6941 and authorized this office to proceed on April 21, 1986.

In the opinion of this Division, there is no further necessity for that
certain East/West unnamed street located at the Southerly terminus of
Varsity Avenue, either for present or prospective street purposes.
Therefore, we recommend the vacation on the basis of the following
Findings of Fact:
1. The above street has been determined by the Planning and Public
Works Departments to be of no further necessity to the general
pUblic.
al Development in the area negates the use thereof as a street.
bl The Master Plan does not provide for any extension of this
street, therefore, this proceeding will not conflict with the
Master Plan.
2. 33% of the adjoining owners have requested the proceedings, and the
required $400.00 fee has been paid.
al By virtue of the posting and publication of the proposal,
neither this office nor the City Clerk's office has received
any written protests against the vacation as of this date.
3. The Resolution Ordering the vacation will not be presented for
adoption until dedication has been received for the extension of
Varsity Avenue, Southerly to University Parkway. This is a
condition placed upon the proceedings and will then eliminate any
protests from the remaining 66% of the adjoining owners.
4. All the interested Ci ty Department Heads and Uti 1 i ty Companies were
notified of the proposal, and all have given their respective
consent. A reservation for a sewer easement was requested,
however, and same has been provided for in the Resol ution of
In te n t ion.
al The fact that a sewer easement has been requested does not
indicate the necessity for general public use of the area in
question.
