STAFF REPORT
On December 16, 1985, the Commission directed the formation of a committee to
study that area in Central City South from Rialto Avenue to Mill Street and "E"
Street to 1-215. The committee has been meeting almost weekly to study the area
with our consultants, URS. It was detemined early in the meetings that the srea
from Mill south to Inland Center Drive should also be addressed in order that
traffic circulation and land uses between our two malls would be consistent.
On March 3, 1986, a l20-day moratorium was placed on this area. It was felt that
this time period would give the study team time to recommend land uses and
initiate a Specific Plan. Two land use alternatives are being reviewed by the
study team. They are addressed in the attached Conceptual Development Plan
Alternatives. The study team should make its final recommendation by the May 5,
1986, Commission Meeting.
Specific Plan
.
On April ll, 1986, the study team reviewed the Conceptual Development
Plan Alternatives and recommended that URS prepare a proposal for the
preparation of the Specific Plan and that the proposal be submitted to
the Commission on April 21, 1986. The Redevelopment Committee, on
April 14, 1986, recommended entering into a contract with URS
Consultants for the preparation of the Specific Plan. The proposal is
attached. Cheryl Flowers of URS will be present at the Commission
Meeting to answer any questions raised. Total compensation shall not
exceed $156,000, based on an hourly fee schedule. The Specific Plan
should take approximately four montha to complete and be adopted. An
Action Schedule will be provided at the meeting of May 5, 1986.
The contract proposed includes the following five elements that are
required for the adoption of a Specific Plan:

Engineering Proposal

Staff and Gene Klatt, Assistant City Engineer, met on April 4, 1986,
with Russ Mullins of Brown & Mullins regarding the parcel map for Simi
Development, Gene Klatt felt that a decision needed to be made regarding
the vacation of Velarde Street and the location of the "F" Street
extension. After discussion, it was felt imperative that complete
engineering be accomplished for not only the "G" Street realignment, but
"F" Street extension.
on April II, 1986, the study team reviewed a proposal from Brown &
Mullins to provide complete engineering required for the Specific Plan.
The contract will also include a cost estimate to accomplish the traffic
circulation pattern proposed. The engineer will work with the Agency,
City Engineering and the Consultant during the Specific Plan process.
The Agency is proposing a joint contract between the Agency, City
Engineering and Brown & Mullins -- all services to be coordinated
through Roger Hardgrave's office. The contract is for a not to exceed
amount of $55,000 based on actual hours. Attached is a letter from
Engineering recommending approval of the agreement. Also attached is a
letter from Ben Wixen supporting the agreement.

AGENCY OF THE CITY OF SAN BERNARDINO AND URS CORPORATION FOR
CENTRAL CITY SOUTH STUDY AREA SPECIFIC PLAN AND ENVIRONMENTAL
IMPACT REPORT CONSULTANT SERVICES
THIS AGREEMENT made and entered into eff,ptive the

REDEVELOPMENT AGENCY OF THE CITY OF SAN BERNARDINO, a public body
corporate and pOlitic, hereinafter .Agency., the CITY OF SAN
BERNARDINO, a municipal body corporate, hereinafter .City., and
URS CORPORATION, hereinafter .Consultant,. sets forth the
agreement of the parties.
SECTION 1. Recitals. The parties hereto acknowledge:
1. Agency desires to develop a coordinated comprehensive
study and specific plan for the development of the area bounded
by .E. Street on the east, Rialto Avenue on the north, Inland
Center Drive on the south, and the 1-215 Freeway on the west,
which area is hereinafter referred to as the .study area..
2. Agency requires professional services to accomplish
tasks related to the studies involved in preparation of and
finalization of a Specific Plan and its related Environment
Impact Report.
3. Consultant represents that it has the professional
ability and technical means to accomplish work requirements of
preparing the Specific Plan for the study area and the
Environmental Impact Report for the Specific Plan, and has
offered its services to Agency through submission of a proposal,
dated April 16, 1986, a copy of which is on file with the Agency,
and is incorporated herein by reference.
SECTION 2. Implementation. The parties therefore agree:

1. Emnlovment of Consultant. The A~ency hereby retains th
Consultant to provide the preparation of the Specific Plan and
Environmental Impact Report services for the study area, and the
Consultant hereby agrees to perform, or cause to be performed,
professional services as hereinafter set forth.
2. Personnel. The Consultant has available, or will
provide, all personnel required to perform services under this
agreement. All subconsultants to be secured by the Consultant
must have the prior written approval of the Agency. The
Consultant will work closely with and coordinate its efforts wit
those of Brown and Mullins, Inc., engineering consultants hired
by Agency and City. All of the services to be performed by the
Consultant shall be performed by the Consultant or under its
supervision, and all personnel engaged in the work shall be full
qualified and shall be authorized and permitted under state and
local laws to perform such services, and shall be acceptable to
the AgeRcy.
3. Performance Specifications. The Consultant shall
perform the tasks listed in Attachment -A-, -Proposed Scope of
Work,- which is attached hereto and incorporated herein by
reference.
4. Products. Specific products listed in Attachment -A-
shall be delivered to the Agency by the Consultant in detail as
required by the description set forth in Attachment -A-.
5. Work Schedule. Work has already commenced under a
preliminary study agreement, and shall continue uninterrupted to
complete this project in a timely manner. Consultant agrees to
complete all tasks required to meet the schedule outlined in
Attachment -A-.

6. Co~ensation and PaYment Schedule.. Tbe Agency will pay
tbe Consultant a sum not to exceed $156,000, computed on the
basis of tbe -Hourly Billing Rates,- a copy of wbicb is annexed
ebereto as Attachment -B-, and is incorporated berein by
reference. Tbe parties recognize that tbe hours and costs set
forth tberein are reasonable, and Agency agrees to make payment
for services rendered on the following basis:
Consultant sball submit to Agency montbly its invoice for
services rendered and tbe cbarges for sucb services based upon
tbe Hourly Billing Rates set forth in Attachment -B-. Tbe
invoice sball contain sucb detail as Agency may reasonably
require to enable Agency to satisfy itself tbat all amounts
billed are appropriated for payment. Supporting evidence sball
be provided by Consultant upon request from Agency. Total
billings shall not exceed $156,000.
7. Method of Payment. Upon review of each montbly invoice,
Agency sball determine tbat all cbarges are appropriate, and
shall thereupon remit payment therefor to Consultant. Payment
sball be submitted within tbirty (30) days of receipt of any such
invoice.
8. Agency Management. Tbe Executive Director of tbe Agency
sball represent tbe Agency in all matters pertaining to the
administration of this agreement, including without limitation
coordination of all necessary meetings and conferences, and
review and approval of all products submitted by tbe Consultants;
the Executive Director shall have no authority to enlarge the
scope of work or change the compensation due tbe Consultant. The
Consultant shall work closely with the City's Director of Public
Works/City Engineer and tbe City's Planning Director.

9. No Benefit to Arise to Local E~loyees. No member,
officer or employee of Agency, or its designees or agents, and no
public official who exercises authority over or responsibilities
with respect to the project during his or her tenure for one year
thereafter, shall have any interest, direct or indirect, in any
contract or any subcontract,or the proceeds thereof, for work to
be performed in connection with the project assisted under this
agreement.
10. The Consultant as an Independent Agent. The Consultant
and its officers, agents and employees, in their performance of
this agreement, shall act in an independent capacity and not as
officers, employees or agents of the Agency.
11. Keeping Accounts. The Consultant shall keep separate
books of account in connection with the work to be performed
under this agreement. These books shall be subject to audit by
the Agency. All such books and records shall be retained for
such periods of time as required by law, provided, however, in
any event, all books, records, and supporting detail shall be
retained for a period of at least three years after the
expiration of the terms of this agreement.
12. Ownership of Material and Documents. All reports and
maps, field survey notes, computations and other material
prepared by the Consultant shall be the property of the Agency
and the Consultant shall deliver such materials to the Agency
according to the terms of this agreement. Bowever, the
Consultant shall have the right to make duplicate copies of such
materials and documents for its files or other purposes as may be
authorized in writing by the Agency.

13. Release of Information. No information, including
photographs, public announcements or confirmation of same, or any
part of the subject matter of this agreement or any phase of any
program hereunder shall be made public without prior approval of
the Agency.
14. Exclusive Agreement. It is agreed and understood that
the consultant will not be engaged in private work projects in
the study area during the term of this agreement.
15. Indemnification. The Consultant shall defend, hold
harmless and indemnify the Agency, its officers, employees and
agents against liability (whether bodily injury, including death,
and/or property damage) arising out of the negligent acts or
willful misconduct or lack of good faith or omissions of the
Consultant or its officers, agents, employees or contractors in
the performance of this agreement.
16. Insurance Requirements. As a condition precedent to
the effectiveness of this contract and in partial performance of
Consultant's obligation hereunder, Consultant, at its own
expense, shall deliver to Agency for approval, certificates or
policies of insurance as evidence that the following types and
amounts of insurance are in full force and effect to assure
protection of the Agency under this contract:
A. At least One Million Dollars ($1,000,000.00) combined
single limits for bodily injury and/or property damage.
B. At least Five Hundred Thousand Dollars ($500,000.00) in
errors and omissions coverage.
C. Evidence of a Certificate of Self-Insurance or Workers'
Compensation individual coverage that meets the requirements of

the California Labor Code in relation to Workers' Compensation
Insurance.
Agency shall also be named an additional named insured under
the liability insurance policy. Consultant shall be required to
inform Agency in writing of any change, expiration or renewal of
any insurance policy or policies within thirty (30) days of the
effective date of the change. Further, any renewal policy shall
provide at least the minimum coverage specified herein, and each
Policy of Insurance or Certificate of Insurance shall provide
that the policy shall not be canceled without an advanced thirty
(30) day written notice of cancellation to Agency.
17. Co~liance with Requlations. Consultant shall be
responsible for compliance with all federal, state and local
laws, rules, regulations, and requirements insofar as they apply
to this project.
18. Time is of the Very Essence. The parties hereto
recognize that time is of the essence of this agreement. This
Specific Plan and Environmental Impact Report must be completed
within the time limits specified herein unless good cause for
delaying exists. Failure of Consultant to complete this work
within the time schedule provided will result in extraordinary
losses to the Agency and City. Consultant recognizes that it has
been selected in large part because of its assurances that it can
and will complete the work necessary within the time frame
specified. The draft Environment Impact Report shall be
submitted not later than September 1, 1986, and the final
Environmental Impact Report shall be submitted by Consultant to
Agency not later than December 1, 1986. No deviation from this
schedule will be sought without good cause.

19. Notification. All notices, memoranda, reports, drafts,
and communications sent to the Agency under this agreement shall
be sent to the following address unless authori..d to be sent
elsewhere by Agency:

Any such notices, demands, invoices and written
communications by mail shall be conclusively deemed to have been
received by the addressee five (5) days after the deposit thereof
in the Dnited States Mail, first class postage prepaid and
properly addressed as noted above.
20. Effective Date. This agreement shall become effective
on the date it has been executed by the Chairman and Secretary of
the Redevelopment Agency of the City of San Bernardino, and by
the Mayor of the City of San Bernardino.
21. Entire A9reement. This agreement supersedes any and
all other agreements, either oral or in writing, between the
parties with respect to the subject matter herein. Each party to
this agreement acknowledges that no representation by any party
which are not embodied herein and that no other agreement,
statement, or promise not contained in this agreement shall be
28 valid and binding. It is expressly acknowledged, however, that

Consultant's original proposal to Agency dated April 16, 1986, is
expressly incorporated into this agreement.
22. Assignment or Substitution. The Agency has an interest
in the qualifications of and capability of the persons and
entities who will fulfill the duties and obligations imposed upon
the Consultant by this agreement. In recognition of that
interest, neither any complete nor partial assignment or
delegation of this agreement may be made by the Consultant nor
changed, substituted for, deleted or added to without the prior
written consent of the Agency and City.
23. Modification of Contract. The specific tasks and
scope of this project are subject to modification by mutual
agreement among Agency, City and Consultant. Any such changes
shall be incorporated by written amendments to this agreement.
24. Suspension of Agreement. The Agency shall have the
right to cancel or suspend the agreement by giving the Consultant
fifteen (15) days written notice to that effect. If such
cancellation or suspension shall take effect during the
performance of any incomplete work, the Consultant shall be paid
the reasonable value of work accomplished, based upon the rate
schedule provided for, and considering the relevance of the work
to the needs of the Agency. Any suspension shall relieve
Consultant of its obligation to meet the time deadline specified
herein.
25. Savings Clause. If any provision of this agreement is
found to be invalid, void or unenforceable, the remaining
provisions shall nevertheless continue in full force and effect
without being impaired or invalidated in any way.

26. Termination Date. It is agreed and understood that
this agreement will cease to be valid as of January 1, 1987,
unless the Environmental Impact Report and Specific Plan have
been submitted by that date.
If such items bave been submitted
by that date, Consultant shall continue to provide service
hereunder as requested or authorized until the Environmental
Impact Report and Specific Plan have been finally adopted.
27. Termination by Mutual ~greement. Prior to the
termination date of this agreement, it may be terminated by
written consent of the Agency, City and Consultant.

SUBJECT: Proposal for Preparation of a Specific Plan for the Central
City South Study Area
Dear Glenda:
The information provided herein is URS' proposal to prepare a Specific Plan
for the Central City South Study Area, for which URS has completed a Draft
Conceptual Land Use Plan Alternatives Report. Based on recommendations of the
Central City South Committee to 'proceed with a Specific Plan, and your request
for a proposal to provide such services, this letter proposal addresses the
tasks to be undertaken for completion and adoption of the Plan.
This proposal is based only on the work that has been completed to date, and
it recognizes that the Council/Committee has yet to approve the land use plan
alternatives in concept or to select those preferred land uses on which to
base the Specific Plan. The final outcome of those decisions may affect the
costs estimated herein; we have therefore provided you with what we feel will
be the higher range of costs. The scope of work is not as detailed as we
would prefer, and it should therefore be considered as preliminary and to be
refined following a decision on the Conceptual Land Use Alternatives Report.
Realizing that the City is also considering a proposal for engineering
services for the same study area, URS has not included any infrastructure
engineering tasks in our Scope of Work beyond what will be needed in the
Specific Plan's discussion sections. Assuming that most of the engineering
analyses area done under separate contract to the City, we plan merely to
incorporate the engineering consultant's work into the Specific Plan. We also
propose to include Mr. Chris Soltis of Soltis Design on our project team to
prepare the architectural design and landscape standards for the Plan. We
understand that the proposal you have received for engineering services only
includes utility and drainage design based only on street alignments. Follow-
ing the design of land uses, the engineering scope will need to be expanded to
address the entire study area. This information will be required for the
Specific Plan and for implementing an Assessment District.
Because most of the engineering work will become a part of the Specific Plan,
URS also proposes to be the managing consultant for preparation of the Plan.
This will assist in the timely completion of all work, assure no duplication
of effort, and aid in the overall process and report preparation.

Additionally, URS can provide computer mapping services that will generate
highly detailed parcel maps for the study team to use in all engineering and
land use planning tasks. As an initial task, URS can use the photographic map
and survey control data from the engineering consultant to digitize street
names, rights-of-way, easements, and tax parcels. This information can then
be used, with legal descriptions for all preliminary engineering (including
all utility, drainage, and street designs), graphics, and land use planning.
These maps will later provide an excellent tool for City Planning and
Engineering Departments' review and approval processes for all future develop-
ment within the study area. Digitizing the initial base map is included in
our cost estimate. Additional overlays (streets, easements, infrastructure)
can be provided and would serve as the base for future land use and engineer-
ing planning throughout the City. A cost estimate for these maps will be
provided separately, following a decision by the City and a joint meeting
among all consultants.
The following pages present our proposed "preliminary" Scope of Work and
estimated cost for each required element of the Specific Plan, cost estimates
for two additional, recommended supporting elements to the Specific Plan, and
an hourly billing rate for staff proposed to be assigned to the project.
The Specific Plan will require an Environmental Impact Report (EIR), that the
Planning Department indicates can be prepared concurrently with the Specific
Plan and preferably adopted with the Plan. Therefore, our estimated study
period, based on the preparation of both documents is four to five months for
submittal of the Draft EIR and Draft Specific Plan. Again, this will depend
on final decisions on how to proceed.
As this project has developed over the last five months, URS has been very
anxious to see it succeed and progress to a plan that will ensure development
consistent with the City's goals and objectives, and more importantly, one
that will enhance the area and the city as a whole. Adoption of a Specific
Plan for the area will serve this purpose, and is the optimal route for the
City to consider. The State's 1984 guidelines for implementing General Plans
defines Specific Plans as being "most commonly used in areas of transition,
such as on the developing periphery of urban areas, and in central city areas
designated for rehabilitation or redevelopment. Their main advantages are
that they particularize the policies and programs of the general plan and
coordinate public and private efforts in the development of an area." As a
final consideration for the City, these same guidelines also state. ". . . the
law authorizes cities and counties to recover the costs of preparing a speci-
fic plan by charging developers seeking governmental approvals based on the
specific plan a prorated fee related to the benefit received" (Government Code
Section 65453).

3 THIS AGREEMENT, made and entered into effective the
4 day of , 1986, by and among the REDEVELOPMENT
5 AGENCY OF THE CITY OF SAN BERNARDINO, a public body corporate and
6 politic, hereinafter .Agency,. the CITY OF SAN BERNARDINO, a
7 municipal corporation, hereinafter .City,. and BROWN AND MULLINS,
8 INC., a California corporation, hereinafter .Consultant., sets
9 forth the agreement of the parties.
10 1. Recitals. The parties hereto acknowledge:
11 A. Agency and City desire the professional services of
12 Consultant to prepare a street alignment study within the Central
13 City South Study Area.
14 B. Consultant represents that it is qualified to perform
15 said professional services.
16 2. Implementation.
17 A. Employment of Consultant. Agency and City hereby
18 engage Consultant and Consultant hereby agrees to perform the
19 services hereinafter set forth.
20 B. Scope of Work. Consultant shall provide professional
21 services as set forth in Exhibit A. Consultant shall submit all
22 plans and materials to City's Director of Public Works/City
23 Engineer, who shall coordinate and review all plans and materials
24 relating to this project, with a copy to Agency and URS, Inc. , the
25 consultant preparing a specific plan for the area. All work items
26 specified in Exhibit A shall be provided by Consultant unless
27 City's Director of Public Works/City Engineer notifies Consultant
28 in writing that any particular item or items therein shall be

1 omitted. The parties contemplate complete design services.
2 C. Work Schedule. Consultant agrees to perform all of
3 the requirements of this agreement within sixty days from the
4 effective date hereof.
5 Compliance by Consultant with the work schedule established
6 herein presumes that all of the conditions not within Consultant's
7 control, but necessary for timely fulfillment of the Consultant's
8 obligations, will be assumed by Agency and City. Causes which may
9 produce delays in the work schedule include, but are not limited
10 to: failure of the Agency and City to consider all matters
11 promptly upon submittal by Consultant, failure to make decisions
12 within a reasonable time, failure to cooperate with or cause
13 delays in the work of Consultant, failure to issue in a timely
14 manner the proper approvals or recommendations, or failure to make
15 timely payments due to the Consultant. In such cases, the
16 established work schedule of Consultant shall be expanded.
17 D. Compensation. For Consultant's services as described
18 herein, Agency agrees to pay Consultant an amount not to exceed
19 FIFTY-FIVE THOUSAND DOLLARS ($55,000), with the actual amount
20 billed for services based upon those rates set forth in the
21 document, .Special Schedule of Fees,. annexed hereto as Exhibit
22 B.
23 E. Progress Payments. Agency agrees to make progress
24 payments to Consultant on a monthly basis in proportion to the
25 percentage of work completed, based upon billing for services at
26 the specified rates. Consultant will submit monthly invoices to
27 City's Director of Public Works/City Engineer accompanied by a
28 brief progress report. City's Director of Public Works/City

1 Engineer shall review said monthly invoices and the progress
2 report and recommend payment by Agency. Agency will make payment
3 to Consultant within ten days after receipt by Agency of an
4 invoice approved by City's Director of Public Works/City Engineer,
5 which payment shall be made within 30 days from receipt of such
6 invoice by the City Engineer.
7 F. Personnel. Consultant has available, or will
8 provide, all personnel required to perform services under this
9 agreement. All of the services to be performed by Consultant
10 shall be performed by Consultant or under its supervision, and all
11 personnel engaged in the work shall be fully qualified and shall
12 be authorized and permitted under state and local laws to perform
13 such services, and shall be acceptable to Agency and City. All
14 personnel employed by 'Consultant shall be employees of Consultant,
15 and not employees of Agency or City.
16 G. No Benefit to Arise to Local Employees. No member,
17 officer or employee of Agency or City, or their designees or
18 agents, and no public official who exercises authority over or
19 responsibilities with respect to the project during his or her
20 tenure or for one year thereafter, shall have any interest, direct
21 or indirect, in any contract or any subcontract, or the proceeds
22 thereof, for work to be performed in connection with the project
23 assisted under this agreement.
24 H. Consultant as an Independent Agent. Consultant and
25 its officers, agents and employees, in their performance of this
26 agreement, shall act in an independent capacity and not as
27 officers, employees or agents of the Agency or City.
28 I. Keeping Accounts. Consultant shall keep separate

1 books of account in connection with the work to be performed under
2 this agreement. These books shall be subject to audit by Agency.
3 All such books and records shall be retained for such periods of
4 time as required by law, provided, however, in any event, all
5 books, records, and supporting detail shall be retained for a
6 period of at least three years after the expiration of the term of
7 this agreement.
8 J. Ownership of Material and Documents. All reports,
9 maps, studies, interview notes, photographs, graphics, statistical
10 reviews and notes, field survey notes, computations and other
11 material prepared by Consultant pursuant to this agreement shall
12 be the property of Agency, and Consultant shall deliver such
13 materials to Agency at the termination of this agreement.
14 However, Consultant s~all have the right to make duplicate copies
15 of such materials and documents for its files or other purposes as
16 may be authorized in writing by Agency.
17 K. Release of Information. No information, including
18 photographs, public announcements or confirmation of same, or any
part of the subject matter of this agreement or any phase of any
program hereunder shall be made public without prior approval of
Agency.
L. Indemnification. Consultant shall defend, hold
harmless and indemnify Agency and City, their officers, employees
and agents against liability (whether bodily injury, including
death, and/or property damage) arising out of the negligent acts
or willful misconduct or lack of good faith or omissions of
Consultant or its officers, agents, employees or contractors in
the performance of this agreement.

1 M. Insurance Requirements. As a condition precedent to
2 the effectiveness of this agreement and in partial performance of
3 Consultant's obligation hereunder, Consultant, at its own expense,
4 shall deliver to Agency for approval, certificates or policies of
5 insurance as evidence that the following types and amounts of
6 insurance are in full force and effect to assure protection of the
7 Agency and City under this contract:
8 1. At least One Million Dollars ($1,000,000)
9 combined single limits for bodily injury and/or property damage.
10 2. At least Five Hundred Thousand Dollars ($500,000)
11 in errors and omissions coverage.
12 3. Evidence of a certificate of self insurance or
13 workers' compensation individual coverage that meets the
14 requirements of the California Labor Code in relation to Workers'
15 Compensation Insurance.
16 Agency and City shall also be named an additional named
17 insureds under the liability insurance policy. Consultant shall
18 be required to inform Agency in writing of any change, expiration
19 or renewal of any insurance policy or policies within thirty days
20 of the effective date of the change. Further, any renewal policy
21 shall provide at least the minimum coverage specified herein, and
22 each policy of insurance or certificate of insurance shall provide
23 that the policy shall not be canceled without an advance thirty
24 day written notice of cancellation to Agency and City.
25 N. Compliance with Regulations. Consultant shall be
26 responsible for compliance with all federal, state and local laws,
27 rules, regulations, and requirements insofar as they apply to this
28 project.

1 R. Assignment. Consultant shall not assign (whether by
2 assignment or novation) this agr~ement or delegate the duties or
3 any right or interest hereunder in whole or in part without the
4 prior written consent of Agency. Any assignment or attempt to
5 assign this agreement or delegate Consultant's duties hereunder
6 without such prior written consent or by operation of law shall be
7 void and shall constitute cause for termination.
8 S. Modification of Agreement. The specific tasks and
9 scope of this project are subject to modification by mutual
10 agreement between Agency, City and Consultant. Any such changes
11 shall be incorporated by written amendment to this agreement.
12 T. Termination. Agency may terminate this agreement at
13 any time by giving written notice to City and Consultant of such
14 termination and specifying the effective date thereof at least
15 fifteen days before the effective date of such termination. In
16 such event, all materials in Consultant's possession relating to
17 this project shall, at the option of Agency, become its property.
18 If the agreement is terminated by Agency, Consultant will be
19 entitled to be paid all compensation for work performed to the
20 date of termination: provided that in no event shall the
21 compensation of Consultant exceed the amount provided for in this
22 agreement.
23 IN WITNESS WHEREOF, the parties have executed this agreement
24 effective the day and year first above written.

Dear Ms. Saul:
Reflecting on the Central City South project after attending todays RDA
meeting left me with some thoughts I would like to share with you.
Brown and Mullins, Inc. proposal that comprehensive engineering plans be
undertaken for this study area is a definite necessity for the project to
be undertaken seriously. The absence of comprehensive plans creates havac
for all important city departments responsible for approving any construc-
tion within this project area. Engineering has to look at each parcel and
street to determine safety, drainage, uti! ity, traffic flow, etc. It would
be very difficult to develop any large area of land without the proper
engineering plans. These plans can determine the cost and feasability of
various proposals already made regarding the project.

I want to commend you and your staff, the committee and councilpersons
working on this project. Each person has worked diligently and hard in
bringing the concept to this point of fruition. The merit of changing
the character of this area to a higher general use, of creating a business
climate that would bring in new enterprises and of developing streets and
avenues that would connect the two vital retail shopping centers is marvel-
ous. The elimination of blighted business's and structures in the area is
a worthy endeavor.

This Department has reviewed the proposal for engineering
services as prepared by BMI, Inc. for the preparation of
alignment studies and other engineering studfes for the area
bounded by 1-215, E Street, Rfalto Avenue and the Inland
Center Mall.
At the request of this Department, costs for the engineerfng
study were solicited on ~he basis of necessity 'to properly
plan and approve the developments in the area. Presently,
maps and plans have been submitted for development in this
area and without an overall detailed, plan with specific
alignments and design parameters, this department cannot ade-
quately check or approve development plans. The proposed
study should provide sufficient detail and overall criteria
to allow the area to develop "as planned" and without causlng
future confllcts in alignment, purpose or deslgn.
Thls department has revlewed the cost estlmate as submitted
and can support an agreement:
1. In which the City can select the ftems of work to
be performed;

A cooperatlve effort between RDA, Public Works and consultant

problems and concerns of the City and the end result is a
useable design meetlng the needs of the communlty at large
and the specific requlrements of this area ln particular.

It 1s also suggested that 1n the f1nal agreement, some
l1m1ts be estab11shed for the complet10n of the work and
t1me frames be made for each 1dent1f1ed work task. It
