STAFF REPORT
The purpose of this proposed amendment to the San Bernardino Municipal Code
is to allow the City to make purchases utilizing prices obtained by bidding
procedureS performed by another California governmental agency or to utilize
a prior bid obtained by the City. During the bid procedure more than one
responsible bid must have been received. and the bid award must have
occurred within one year of the City of San Bernardino's issuance of a
purchase order.
The adoption of this amendment will in some cases save the time required
to initiate a new formal bidding procedure. It will also allow the City
to avoid surcharges which other governmental agencies impose if we buy
through them rather than directly from the vendor. Any purchases that would
be handled in this way would be taken to the Mayor and Common Council
for prior approval and the circumstances would be completely outlined.
There have been examples of transactions that could have been completed to
the better advantage of the City had the proposed procedure been in place:
1. A vendor offered to supply a fire truck to the City in 1985/86
for the same price that one had been sold to us in 1984/85.
The truck was re-bid and this vendor was the only bidder. The
price that resulted from the re-bid was higher than the prior
year price and more time was required to obtain the truck.
2. A wood chipper was re-bid that could have been obtained at last
year's price without are-bid.
Currently another fire truck is due to be purchased which could be
accomplished under the proposed revision. Also radio equipment budgeted
in 1985/86 could be purchased utilizing a San Diego County bid rather
than going through the County of San Bernardino and paying a surcharge.

BERNARDINO. BASED UPON A PRIOR COMPETITIVE BIDDING.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:

SECTION 1. Section 3.04.010 of the San Bernardino Municipal
7 Code is amended to read:

-3.04.010 Adoption of purchasing system.
A. In order to establish efficient procedures for the
10 purchase of supplies, materials and equipment, to secure for all
11 departments or agencies of the City, excepting the Municipal
12 Water Department and the Free Public Library~ supplies, materials
13 and equipment at the lowest possible cost commensurate with the
14 quality needed, to exercise positive financial control over

purchases to clearly define authority for the purchasing
]6
functions and to assure the quality of purchases, a centralized
17
purchasing system is adopted. There shall be no exemption from
]8
centralized purchasing and no agency or department shall be
]9
authorized to purchase, or contract for the purchase of supplies,
20
services or equipment independently of the administrative office.

The Board of Water Commissioners and the Board of the Free Public
22
Library shall employ procedures substantially in compliance with
23
the provisions of this chapter as such may be applicable.

B. Exemptions. This chapter shall not apply to the
25
following:

1. Purchases from, or sales to a government or
27
governmental agency, or through any advantageous governmental

2. Purchases from a vendor or manufacturer which,
3 through the Cit~'s bidding procedure, or other California
