Director/City Engineer and City Clerk to Proceed with this
Annexation.

The Mayor and Common Council passed Resolution No. 85-483
making an application to the Local Agency Formation
Commission for the annexation of 230 acres of inhabited
territory located East of Waterman Avenue, North of Third
Street.
Recommended motion:
Adopt Resolution.

STAFF REPORT
The annexation process has been completed up to this point.
The next step to be taken, before L.A.F.C. wi 11 hear thi s
annexation, is to pass a resolution determining the amount of
property tax revenues to be exchanged between the Ci ty and the
County.
The final date for submission of the City's resolution to the
local Agency Formation Commission is April 7. 1986.
We recommend that the resolution be passed.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO DETERMINING
THE AMOUNT OF PROPERTY TAX REVENUES TO BE EXCHANGED BETWEEN THE
CITY OF SAN BERNARDINO AND THE COUNTY OF SAN BERNARDINO
RESULTING FROM THE JURISDICTIONAL CHANGE DESCRIBED BY LAFC NO.
2372.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Recitals. The Mayor and Common Council of
the City of San Bernardino hereby find and determine that:
A. Pursuant to Section 99 of the Revenue and Taxation
Code. pri or to the issuance of a certi fi ca te of fi 1 i ng by the
Local Agency Formation Executive Officer. the governing bodies
of all local agencies whose service area or service responsi-
bilities will be altered by a proposed j~risdictional change
will negotiate and determine by resolution the amount of
property tax revenues to be exchanged between and among such
local agencies.
B. Except as provided in Section 99.1 of the Revenue
and Taxation Code. in the event that a jurisdictional change
would affect the service area or service responsibility of one
or more speci al di stri cts. the Board of Supervi sors of the
County of San Bernardino shall, on behalf of the district or
districts. negotiate any exchange of property tax revenues.
C. The Mayor and Common Council of the City of San
Bernardino and the Board of Supervisors of the County of San
Bernardino have determined the amount of property tax revenues
to be exchanged as a result of the jurisdictional change des-
cribed by LAFC No. 2372.

SECTION 2. Implementation.
A. The negotiated exchange of property tax revenues
between the City of San Bernardino and the County of San
Bernardino attached hereto as Exhibit "A" and incorporated
herein by reference. resulting from the above described
Jurisdictional change. is hereby approved and accepted. The
column entitled "Estimated Current Tax Revenue" shall represent
the amount of property tax revenues for the current year to be
paid to the County of San Bernardino and its affected agencies.
B. The annual tax increment generated in the area
subject to the Jurisdictional change and attributable to the
Local Agencies whose service area or service responsibilities
will be altered by the proposed Jurisdictional change shall be
allocated in the future years pursuant to the provisions of
Section 98 of the Revenue and Taxation Code.
SECTION 3.
The City Clerk of the City of San
Bernardino is hereby directed to certify to the passage of this
resolution and to cause a certified copy to be sent to the
Executive Officer of the Local Agency Formation Commission of
the County of San Bernardino.
