STAFF REPORT
On December 16, 1985, the Community Development Commission directed staff to
research different levels of criteria for the board to consider that would be
beneficial to the Beautification Program, and request the More Attractive
Community (MAC) to research these concerns and to return with recommendations on
the criteria pertaining to the Beautification Program.
In December, staff met with Mr. Greg Garcia, Coordinator of the MAC Force, to
discuss the above mentioned concerns and to work on revising the Beautification
Program.
As a result of the meeting with Mr. Garcia, staff recommends that two forms of
assistance be considered, which are as follows:
Grants:
If the project cost $2,000 or less, the Agency will pay 50% of the
total cost not to exceed $999.
Loans:
If the project exceeds $2,000, the Agency will grant up to $999 and
loan the applicant the cost above $999, not to exceed $10,000 at an
interest rate of 5% per year.
With the additional expense of having to pay prevailing wages for any
beautification project costing over $1,000, which would add 20%-30% to the cost of
each project, and having spent most of our beautification funds, staff feels that
the only vi'8ble way to continue the beautification program would be to have ;a
"Grant/Loan" program.
On March 6, 1986, staff presented the revised Beautification Program to the
Redevelopment Committee and the ,Redevelopment Committee recommended approval.
Attached, for your review and recommendation, is our revised Beautification
Program and a update of our current beautification activities.

BEAUTIFICATION PROGRAM
I. ADMINISTRATION
The Beautification Program shall be administered by the Redevelopment
Agency.
II. FORMS OF ASSISTANCE
a) Grants
For applications wherein the total project cost is $2,000 or less,
the Agency shall consider granting 50% of the total project cost,
not to exceed $999.
Grant funds will not be approved for reroofing or for resurfacing
of parking lots/driveways. Patching and cutting of parking lots
will be considered.
b) Loans

For applications wherein the total project cost exceeds $2,000, the
Agency will consider granting up to $999 and lending to the
applicant the cost above $999, not to exceed $10,000.
The interest rate for the loans as follows:

6,001 - 10,000 5% 5 Years
All loans shall be amortized over a 5 year period. If the loan is
repaid on or before it is 2 1/2 years old, the interest rate shall
be reduced 50%; and a credit towards the principal amount will be
given to the applicant for the reduced interest rate.
Loan fees will be charged at the time of origination of the loan in
the amount of 2% of the loan amount. These fees will be used to
pay for appraisal, credit report, preliminary title report and
staff time.
All loans will be secured by property being improved.
Loan funds will not be approved for reroofing or resurfacing of
parking lots/driveways. Patching and cutting of parking lots will
be considered.

III APPLICATION PROCESS
Application will be considered on a first-come, first-serve basis. Priority
shall be given to those who have been put on notice or cited by the More
Attractive Community Committee (MAC) as having violations that must be cured.
All requests for Beautification funds shall be submitted on an application
form and shall include a complete description of the work to be done, an
itemized cost estimate of same and a copy of the notice or citation from MAC,
if applicable.
a} Grants
Staff is authorized administratively to approve all grants of $999 or
under. An information memorandum shall be transmitted to the Commission
on each grant recommended for approval by the staff. If no response is
received by the staff from the Commission in seven days, the grant shall
be considered approved.
b} Loans
Staff is authorized to approve all loans under $5,000. An information
memorandum shall be transmitted to the Commission on each loan
recommended for approval by staff. If no response is received by staff
from the Commission within seven days, the loan shall be considered
approved.
All applications for loans exceeding $5,000 shall be submitted to the
Redevelopment Committee for recommendation. The recommendation of the
Redevelopment Committee shall be submitted to the full Commission for
approval.
IV. DISTRIBUTION OF PROCEEDS
a} Grants
Grant funds shall only be disbursed after the work has been completed
and inspected by staff. If the applicant has paid for the work in full
after receiving approval from staff or the Commission, the check will be
made out to the applicant. If the applicant has only paid his 50%
share, the check shall be made out to the applicant and the
contractor(s) and/or supplier(s).
b} Loans
Loan funds shall only be disbursed after the work has been completed.
The check shall be drawn in favor of the applicant and the contractor(s)

and lor supp1ier(s). The applicant will hold the Agency harmless.

V. BUDGET
Staff recommends a budget in the amount of $100,000. $20,000 of this amount
shall be set aside for grants. The balance of $80,000 shall be used for
loans. Monthly repayments of loans shall be used for the grant program.
The balance of the $26,710 current budget set aside for projects outside of
redevelopment project areas shall be used for grants and/or loans for
property approved outside of project areas. These funds, when added to the
new budget of $100,000, produces a total budget of $126,710 -- $100,000 for
applicants within redevelopment project areas and $26,710 for applicants
outside of redevelopment project areas.
VI. BOUNDARIES
The boundaries of the Beautification Program shall be those boundaries
established by the MAC Committee, which boundaries may be extended from time
to time by MAC. A copy of the MAC boundaries is attached.
VII. CURRENT APPLICATIONS IN FILE
To date, 12 applications are currently in file pending approval of a revised
program. Staff recommends advising applicants of the new policy and sending
copies of the application to MAC for their review.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS: '

SECTION 1. The Beautification Program heretofore
7 established by the City of San Bernardino is hereby revised, and
8 shall from this date be administered in accordance with the
9 procedures established herein.
SECTION 2. ADMINISTRATION. The Beautification Program of
the City of San Bernardino shall be administered by the
,
Redevelopment Agency of the City of San Bernardino.
SECTION 3. FORMS OF ASSISTANCE. The Program shall be a
14 combination of grants and loans, which shall be administered
15 under the following principles:
16 A. Grants. For applications wherein the total project cost
17 is two thousand dollars or less, the Agency may grant fifty
18 percent of the total project cost, not to exceed nine hundred
19 ninety-nine dollars.
20 Grant funds will not be approved for reroofing or for
21 resurfacing of parking lots or driveways, but patching and
22 cutting of parking lots may be considered.

B. ~oans. For applications wherein the total project cost
exceeds two thousand dollars, the Agency will consider granting
up to nine hundred ninety-nine dollars, and lending to the
applicant any or all of the project cost in excesstof nine

8 an applicant requests a shorter period. In the event full
S payment of all amounts due on the loan is made within thirty
10 months from the date of execution, Agency shall grant as a credit
11 against the amount due thereunder fifty percent of the accrued
12 interest on said loan.
13 Loan origination fees shall be charged at the time of
14 origination of the loan in the amount of two percent of the loan
15 amount. These fees shall be paid by the applicant from the loan
16 proceeds and shall be used by the Agency to offset part of the
17 costs of appraisals, credit reports, preliminary title reports
18 and staff administrative time and expenses.
19 All loans shall be secured by a trust deed on the property
20 being improved, or other security instrument approved by Agency
21 Counsel, with the promissory note and trust deed or other
22 approved security instrument to be executed by the property owner
23 prior to the release of any loan funds by the Agency. The
24 promissory note and deed of trust or other approved security
~ instrument shall be in form approved by Agency Counsel.
26 Loan funds will not be approved for reroofing tor resurfacing
27 of parking lots or driveways, although patching and cutting of

parking lots may be considered as appropriate uses of loan funds.
SECTION 4. APPLICATION PROCESS. Agency shall give priority
consideration in the allocation of Beautification funds to those
businesses in an area which has been targeted by the More
Attractive Community (MAC) Committee, and particular preference
and priority shall be given to alleviating violations of building
codes or other provisions of the San Bernardino Municipal Code
relating to the condition of buildings or property.
All requests for allocation of Beautification funds, either
loans, grants, or any combination thereof, shall be submitted on
an application form available from the Agency; the completed
application shall include a complete description of the work to
be performed, an itemized cost estimate of each element of the
work to be performed, and, if applicable, a copy of any notice or
citation from the More Attractive Community (MAC) Committee, or
any building or zoning inspector.
SECTION 5. APPROVAL PROCESS.
A. Grants. The Executive Director of the Redevelopment
Agency is authorized to administratively approve all grants of
nine hundred ninety-nine dollars or less. An information
memorandum shall be transmitted to each member of the Common
Council on each grant which the Executive Director intends to
approve. If no objection is received by the Executive Director
from any member of the Common Council within seven days, the
grant shall be deemed approved and the Executive Director shall

proceed to make the grant. If any objection is ex~ressed by any
member of the Common Council, the application shall be submitted

first to the Redevelopment Committee for review, and then to the
entire Common Council for final action.
B. Loans. The Executive Director of the Redevelopment
Agency is authorized to approve all loans for ,f;ve thousand
dollars or less. Upon a determination that a loan should be
made, an information memorandum shall be transmitted to each
member of the Commission as to any loan recommended for approval
by the Executive Director. If no objection is received by the
Executive Director from any member of the Common Council within
seven days, the loan shall be considered approved, and the
Executive Director shall proceed to complete the loan. If any
objection is expressed by any member of the Common Council, the
application shall be submitted first to the Redevelopment
Committee for review, and then to the entire Common Council for
final action. For any loan exceeding five thousand dollars which
is recommended for approval, the application shall be submitted
to the Redevelopment Committee for recommendation. The
Redevelopment Committee shall submit its recommendation to the
full Common Council for appropriate action. Loans in excess of
five thousand dollars shall be made only upon approval of the
entire Council.
SECTION 6. DISTRIBUTION OF PROCEEDS.

work covered by the proposed grant has been completed, inspected
by Agency staff, and approved by the Executive Director. If the
applicant has paid for the work in full, and presedts evidence of
such payment satisfactory to the Executive Director, the Agency

shall issue its check made payable to the applicant. If the
applicant fails to submit satisfactory proofs or has paid only
that portion to be paid directly by applicant/and the Agency's
share has not yet been paid, the Agency's check shall be made
payable to the applicant and to any contractor or supplier of
labor, materials or equipment who remains unpaid.
B. Loans. Loan funds shall be disbursed only after the
work has been completed, inspected by Agency staff, and approved
by the Executive Director. If the applicant has paid for the
work in full, and presents evidence satisfactory to the Executive
Director of that fact, the Agency's check shall be made payable
12 to the applicant. If the applicant fails to submit satisfactory
13 evidence of payment, or in the event that one or more contractors
14 or suppliers of material, equipment or labor remains unpaid, the
15 Agency's check shall be made payable to applicant and to any
16 contractor or supplier of labor, materials or equipment who
17 remains unpaid.

C. For any loan or grant funds paid directly to the
applicant, the applicant shall execute a document covenanting
that all suppliers of labor, materials or equipment have been
paid in full and agreeing to hold the Agency harmless from any
claims of suppliers of labor, materials or equipment arising from
the beautification project.
SECTION 7. ADMINISTRATION OF PROGRAM. In administering the
Beautification Program, staff shall be authorized to expend, in
accordance with the procedures specified hereih, stich funds as

Commission of the City of San Bernardino for such purpose. For
purposes of this resolution, the twenty-six thousand seven
hundred ten dollars remaining in the current budget which has

been set aside for projects outside of Redevelopm~nt Project
areas shall be available for use by Agency as grants and/or loans
for Beautification projects as to property outside Redevelopment
Project areas. Any additional funds which may hereafter be
budgeted by the Mayor and Common Council for Beautification
purposes shall likewise be administered by the Agency in
accordance with the procedures specified herein. All funds
realized from repayments of loans shall be deposited into the
Agency's Beautification Program budget, and shall be used for the
grant program.
SECTION 8. BOUNDARIES. The Beautification Program shall be
limited to those areas outside a Redevelopment Project Area but
within an area bounded by Mt. Vernon Avenue on the west, Waterman
Avenue on the east, Highland Avenue on the north and Rialto
Avenue on the south. Project funds may be used for
beautification on either side of any of the boundary streets.
SECTION 9. CURRENT APPLICATIONS IN FILE. Agency shall
evaluate those pending applications which have previously been
filed but not yet approved, in light of the criteria established
herein. Priorities shall be given to projects in the More
Attractive Community (MAC) Committee's targeted areas, as
specified herein, but, if an application lies within the
boundaries established hereby, but is not within slch targeted
area, the Executive Director shall determine whether other

factors exist justifying immediate or eventual approval of a
grant or loan for such business. The Executive Director shall
consider all relevant factors, including whet~er the building or
property is currently in violation of building, codes or other
provisions of the San Bernardino Municipal Code~ and such other
factors which may be appropriate. The applicant who submitted
any pending application falling within the boundaries as
designated herein may be invited to submit a new application
under this revised policy. All applications for grants or loans
lying outside the boundary areas shall be returned to the
applicant, and the applicant shall be advised that this policy
makes a grant or loan hereunder impossible at this time.

RESOLUTION OF THE COMMUNITY DEVELOPMENT COMMISSION REVISING
THE BEAUTIFICATION PROGRAM OF THE REDEVELOPMENT AGENCY OF THE
CITY OF SAN BERNARDINO, AND DESIGNATING THE REDEVELOPMENT AGENCY
TO ADMINISTER THE PROGRAM. ' .,

BE IT RESOLVED BY THE COMMUNITY DEVELOPMENT COMMISSION OF
THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Beautification Program heretofore
established by the Community Development Commission of the City
of San Bernardino (hereinafter -Commission-) is hereby revised,
and shall from this date be administered in accordance with the
procedures established herein.
SECTION 2. ADMINISTRATION. The Beautification Program of
the Commission shall be administered by the Redevelopment Agency
of the City of San Bernardino (hereinafter -Agency-).
SECTION 3. PORMS OF ASSISTANCE. The Program shall be a
combination of grants and loans, which shall be administered
under the following principles:
A. Grants. For applications wherein the total project cost
is two thousand dollars or less, the Agency may grant fifty
percent of the total project cost, not to exceed nine hundred
ninety-nine dollars.
Grant funds will not be approved for reroofing or for
resurfacing of parking lots or driveways, but patching and
cutting of parking lots may be considered.
B. Loans. For applications wherein the total project cost

exceeds two thousand dollars, the Agency will consider granting
up to nine hundred ninety-nine dollars, and lending to the
applicant any or all of the project cost in excess of nine

8 All loans shall be amortized over a five year period, unless
S an applicant requests a shorter period. In the event full
10 payment of all amounts due on the loan is made within thirty
11 months from the date of execution, Agency shall grant as a credit
12 against the amount due thereunder fifty percent of the accrued
13 interest on said loan.
14 Loan origination fees shall be charged at the time of
15 origination of the loan in the amount of two percent of the loan
16 amount. These fees shall be paid by the applicant from the loan
17 proceeds and shall be used by the Agency to offset part of the
18 costs of appraisals, credit reports, preliminary title reports
19 and staff administrative time and expenses.
20 All loans shall be secured by a trust deed on the property
21 being improved, or other security instrument approved by Agency
22 Counsel, with the promissory note and trust deed or other
23 approved security instrument to be executed by the applicant
24 and/or property owner prior to the release of any loan funds by
25 the Agency. The promissory note and deed of trust or other

26, approved security instrument shall be in form approved by Agency
27 Counsel.

2 of parking lots or driveways, although patching and cutting of
3 parking lots may be considered as appropriate uses of loan funds.
4 SECTION 4. APPLICATION PROCESS. Agency shall give priority
5 consideration in the allocation of Beautification funds to those
6 businesses in an area which has been targeted by the More
- Attracive Community (MAC) Committee, and particular preference

8 and priority shall be given to alleviating violations of building
9 codes or other provisions of the San Bernardino Municipal Code
10 relating to the condition of buidings or property.
All requests for allocation of Beautification funds, either

12 loans, grants, or any combination thereof, shall be submitted on
13 an application form available from the Agency; the completed
14 application shall include a complete description of the work to
15 be performed, an itemized cost estimate of each element of the
16 work to be performed, and, if applicable, a copy of any notice or
17 citation from the More Attractive Community (MAC) Committee, or
18 any building or zoning inspector.
SECTION 5. APPROVAL PROCESS.

20 A. Grants. The Executive Director of the Redevelopment
21 Agency is authorized to administratively approve all grants of
22 nine hundred ninety-nine dollars or less. An information
23 memorandum shall be transmitted to each member of the Commission
24 on each grant which the Executive Director intends to approve.
25 If no objection is received by the Executive Director from any

26 member of the Commission within seven days, the grant shall be
27 considered approved and the Executive Director shall proceed to

make the grant. If any objection is expressed by any member of
the Commission, the application shall be submitted first to the
Redevelopment Committee for review, and then to the entire
Commission for final action.

B. Loans. The Executive Director of the Redevelopment
Agency is authorized to approve all loans for five thousand
dollars or less. Upon a determination that a loan should be
made, an information memorandum shall be transmitted to each
member of the Commission as to any loan recommended for approval
10 by the Eecutive Director. If no objection is received by the
11 Executive Director from any member of the Commission within seven
12 days, the loan shall be considered approved, and the Executive
13
Director shall proceed to complete the loan. If any objection is
14 expressed by any member of the Commission, the application shall
15 be submitted first to the Redevelopment Committee for review, and
16 then to the entire Commission for final action. For any loan
17 exceeding five thousand dollars which is recommended for
18 approval, the application shall be submitted to the Redevelopment
19 Committee for recommendation. The Redevelopment Committee shall

submit its recommendation to the entire Commission for
appropriate action. Loans in excess of five thousand dollars
shall be made only upon approval of the entire Commission.
SECTION 6. DISTRIBUTION OF PROCEEDS.
A. Grants. Grant funds shall be disbursed only after the
work covered by the proposed grant has been completed, inspected

applicant has paid for the work in full, and presents evidence of

such payment satisfactory to the Executive Director, the Agency
shall issue its check made payable to the applicant. If the
applicant fails to submit satisfactory proofs or has paid only
that portion to be paid directly by applicant'- and the Agency's
share has not yet been paid, the Agency's check shall be made
payable to the applicant and to any contractor or supplier of
labor, materials or equipment who remains unpaid.
B. Loans. Loan funds shall be disbursed only after the
work has been completed, inspected by Agency staff, and approved
by the Executive Director. If the applicant has paid for the
work in full, and presents documentary evidence satisfactory to
the Executive Director of that fact, the Agency's check shall be
made payable to the applicant. In the event that one or more
contractors or suppliers of material, equipment or labor remains
unpaid, the Agency's check shall be made payable to applicant and
to any such contractor or supplier who remains unpaid.
C. For any loan or grant funds paid directly to the
applicant, the applicant shall execute a document covenanting
that all suppliers of labor, materials or equipment have been
paid in full, and agreeing to hold the Agency harmless from any
claims of suppliers of labor, materials or equipment arising from
the beautification project.

increment funds and such other funds as may be available within
each project area. Of the one hundred thousand dollars budgeted
herein, twenty thousand dollars shall be allocated for grants,
and the remaining eighty thousand dollars shall be allocated for
loans. All funds realized from repayments of loans shall be
deposited into the Agency's Beautification Program budget, and
shall be used for the grant program.
