Any license issued under this chapter shall expire at the end of the fiscal year in which license is issued. The procedure for the renewal of such license is subject to the same conditions as are applicable to the original license. The Animal and Parking Control Officer may revoke his special authorization and any license issued pursuant to this chapter whenever he determines that any licensee has failed to meet the conditions prescribed in this title. Such revocation shall be effective until the licensee has complied with the provisions of this'title to the satisfaction of the Animal and Parking Control Officer whereupon said officer shall issue a notice of compliance and the licensee shall be deemed reinstated for the remainder of the original term for which it was issued. The Animal and Parking Control Officer is privileged to make reasonable entry upon any premises to enforce the pro- visions of this title. It is unlawful for any person, firm or corporation to own, harbor or keep on or at any lot, premises or place more than three dogs which are four or more months of age, except as may be permitted by the provisions of Title 19. It is unlawful for any person to own or harbor any dog within the City, except as provided in this chapter, without securing a license therefor, and maintaining a tag thereon, as specified in this chapter. Each person owning, harboring or having custody or control of a dog of the age of four months or more, within the City, shall obtain annually a license and tag for the dog on or before the first day of July of each year. The license and tag fee for each fiscal year shall be five dollars for a neutered dog and fifteen dollars for a dog which has not been 391 (San Bernardino 9.85) . If the appropriate fee is not paid prior to August first, a delin- quency penalty of ten dollars shall be added to the fee. A fee of one dollar shall be charged for any additional tag issued to replace a lost, stolen misplaced or damaged tag. A fee of one dollar shall be charged for the transfer of owner- ship of a licensed dog to a new owner in lieu of a fee for a new license for the remainder of the year in which the transfer occurs. B. If any person acquires the ownership, custody or control of a dog on or after August first of any year, the delin- quency penalty shall not be applicable, provideCl the- owner obtains the license required by this title within one month after acquiring the ownership, custody or control of such dog, if the dog is then of the age of four months, or within one month after such dog attains the age of four months. In all cases, the full license fee and any applicable penalty shall be payable for any fraction of a fiscal year. C. Moneys received during the current fiscal year for a license shall be first applied to the payment of delinquent fees, sums and penalties due during the preceding fiscal year, and any balance remaining thereafter shall be applied to the payment of the current license fees and penalties. A license issued during any prior fiscal year to the same owner for the same dog as shown in an application for a current license shall be prima facie evidence in any court or admin- istrative proceeding that the dog was continuously owned by the same owner from the prior year to the current fiscal year. No license to own or harbor a dog, as provided in this chapter, shall be issued except upon an application to autho- rized employees of the City setting forth the name and address of the owner or possessor of the dog and a brief description of the dog. I , ".., '...., ....1-.....'. -_....~...__.-"'_._--- '.' c DOGS payment of the license fee, and setting forth the name and address of the applicant and a brief description of the dog, and the number allotted to such dog, and upon receipt of the requisite fees, shall deliver to the applicant a tag which shall set forth the date of the license, and the number allotted to such dog, which tag shall at all times be affixed to the collar, harness or other article worn by such dog; provided, how- ever, that no license for a dog shall be issued unless the owner shall have paid the license fee required therewnmd shall have exhibited to authorized employees of the city a certificate of the vaccination of the dog signed by a duly licensed veterinarian. Every dog found running at large for which a license has not been issued, or which does not bear a tag as provided in this chapter, shall be impounded by au thorized employees of the city for a period of seventy-two hours, and in the event the owner or possessor of such dog does not, on or before the expiration of said period, call for and claim said dog, and pay the license fee therefor, obtain a tag therefor, and pay the sum required by the schedule set forth in Section 6.24.140, said dog shall be disposed of by authorized employees of the city. The animal control officer shall have the right to seize any dog or animal within the city having or suspected to have rabies or hydrophobia, and, in the event he determines that such dog or animal is afflicted with rabies or hydrophobia, the dog or animal shall be forthwith killed by said officer; provided, that if such dog or animal is suspected of having rabies or hydro. phobia, it may be confined by said officer for such time as is necessary, and if said officer then determines that the dog or animal does not have rabies or hydrophobia, it shall be returned to the owner upon payment by the owner of the sum of three dollars per day for each day that the dog or animal is confined. Authorized employees of the city, the county health officer and all peace officers shall have the right to enter upon any private property for the purpose of ascertaining whether any dog or dogs are kept or harbored in violation of the provisions of this chapter. or whether any dog is afflicted with rabies or hydrophobia. This chapter shall not be applicable to dogs under tile age. of four months, and which are kept within enclosures and are not permitted to run at large. (Ord. 2561 (part), 1964; Ord. 821 ~ 526, 1921.) 6.24.110 Vicious or dangerous dogs - Leash requirement. A. It is unlawful for a person owning or having charge, cus- tody, control, or possession of any vicious or dangerous dog or animal to permit it to run at large, or to run loose or unrest,rained in the City. The fact that the dog or animal has bitten any person shall be prima facie evidence that it is a vicious or dangerous animal. B. It is unlawful for a person who owns or has charge, custody, control, or possession of a vicious or dangerous dog or animal to fail to cause it at all times to be leashed, tied securely to a stationary object, or confined within a fenced or enclosed area; provided, that notice in writing to that effect has first been mailed to said person by an authorized employee of the City. Each vicious or dangerous animal found running at large or unrestrained shall be impounded by authorized employees of the City for a period of seventy-two hours. ANIMALS second offense thirty dollars, plus three dollars per day pound fee third and subsequent offenses fifteen dollars times the total num- ber of offenses which have occurred, plus three dollars per day pound fee. If the owner or possessor of the animal does not claim the animal and pay any sums due or owing during the seventy- two hours, the animal shall be disposed of by authorized employees of the City. It is unlawful for any person owning or having charge, custody, control or possession of any dog to permit it to run at large or to run loose and unrestrained in the City. (Ord. The reclaiming fee for such impounded dog shall be as follows: first offense fifteen dollars, plus three dollars per day pound fee thirty dollars, plus three dollars per day pound fee fifteen dollars times the total num- ber of offenses which have occurred, plus three dollars per day pound fee. second offense third and subsequent offenses If the owner or possessor of the dog does not claim the dog and pay any sums due or owing during the seventy-two hours, the dog shall be disposed of by authorized employees of the City. Adoption service fee: twelve dollars for each adult dog six dollars for each cat, kitten or puppy (For this fee, City will assure former owner that the animal will be held for adoption not less than four days.) 2. Disposal service fee: five dollars for each adult dog two dollars for each cat, kitten, or puppy B. Pick-up service charge. six dollars C. Veterinarian pick-up service charge: five dollars for one animal one dollar for each additional animal D. Adoption fees (to new owners): fifteen dollars for each dog or puppy ten dollars for each cat or kitten 397 (San Bernardino 7.,113) '." Research animal sales: fifty dollars for each dog or puppy thirty dollars for each cat or kitten F. If two or more persons are interested in the purchase of a particular dog, puppy, cat or kitten, the animal control officer shall conduct a public sale by sealed bids. The dog, puppy, cat or kitten shall be sold to the highest bidder, except if one bidder desires to provided a home for such animal and another wants the animal for research. In such event, a dog, puppy, cat or kitten shall be sold to an indi- vidual desiring to provide a home for such animal rather than for research purposes. All bids must exceed the sale price of fifteen dollars for each dog or puppy, or of ten dollars for each cat or kitten. G. Vaccination fee: five dollars for each dog or cat reclaimed by its owner five dollars for each dog or cat adopted to a new home five dollars for each dog or cat sold for research purposes (Ord. City shall not sell, for research purposes, any animal to any person or organization not accreditated by the American Association for Accreditation of Laboratory Animal Care. (Ord. Each person who owns or harbors any dog over the age of four months in the City shall have such dog vaccinated against rabies by a duly licensed veterinarian of his choice or at a vaccination clinic approved by the health officer. Such vaccination shall be by injection of canine chick embryo modified live virus rabies vaccine or other method which has been approved in writing by the health officer and at intervals of every twenty-four months thereafter. Upon vaccinating any dog pursuant to this chapter, the veterinarian shall issue a certifica te of vaccination, which shall show the expiration date. It is unlawful for any person to own or harbor any dog which has not been vaccinated as required by and in the manner set forth in Section 6.24.170 within the next preceding two- . year period. (Ord. Any person, firm, corporation or other business enterprise seeking special authorization from the Animal and Parking Control Officer pursuant to the provision of Chapter 6.20 shall cause such wild, exotic, dangerous or nondomestic animal to be vaccinated against any disease peculiar to its species by a veterinarian duly licensed by the state.
