Synopsis of Previous Council action:
12/16/85 -- This office was authorized and directed to initiate
proceedi ngs for the improvement of abandoned dri veways on
206 parcels within the City under the provisions of Chapter
27 of the Improvement Act of 1911 and Chapter 12.92 of the
San Bernardino Municipal Code.
Recommended motion:
That any objections or protests be overruled, the hearing be closed, and
find and determine that the public convenience and necessity require the
improvement of abandoned driveways in front of those parcels of land
described on Exhibit "A" attached to the memo from Roger G. Hardgrave,
Director of Public Works/City Engineer, dated December 2,1985, and
order the work done (excepting parcels No. ) and that the
Director of Public Works/City Engineer is hereby directed to cause the
improvement of said abandoned driveways if the property owners have not
commenced such improvement by Apri 1 22, 1986. (4/5th vote requi red)

STAFF REPORT
On February 21, 1986, notices were sent to the owners of the
properties listed on Exhibit "A" attached hereto, and the
p'roperties were posted as required by Chapter 27 and Chapter
12.92. The notices set a hearing date of March 17, 1986, which
is no sooner than 10 days after giving notice.
Upon your actions at this meeting, the owners must commence
construction by April 22, 1986, which is 6D days from the date
of giving notice, otherwise the City will cause the
improvements to be installed and the owners will be assessed
for the costs therefor over a three (3) year period at 7%
interest per annum on the unpaid balance.
Section 5878.1 of Chapter 27 which provides for this hearing
does not provide for any continuance of the hearing and the
pertinent code is silent relative to removing any parcels
from the list.

estate to which the Central City business Park has been granted a 120-day
Exclusive Right to Negotiate. We anticipate reaching an agreement with this
partnershlp within three (3) months. It would not appear to make economic
sense to construct cement concrete curbs and gutters at this time only to have
them torn up when the antlclpated development begins, in a relatively short
tlme.
We request you wlthdraw the attached notlces until the Exclusive Right to
Negotlate expires on May 21, 1986.

We have just been informed that a new city ordinance has been
approved requiring owners of vacant lots with driveways to
replace the driveways with standard curbs and we wish to
present to you our position on this issue.
When a vacant lot is finally developed, the developers install
the driveways in the appropriate locations to conform to the
lay-out of the project. To make any change in the curbs or
driveways prior to development would, most likely, be a
wasted expense because it would have to be changed again
at the time of the development.
We understand that there will be a public meeting on March 17th
at 9:00 a.m. during which this issue will be discussed. If it is
possible, we will have a representative of our company attend.
However, in the event that we can not have a representative
attend, we want you to be aware of our position.
We strongly urge that you reconsider and take action to rdpea~

Gentlemen:
In response to your letter of February 21, 1986, regarding re-
moval of my driveway on Arrowhead Avenue, two factors I believe
warrant further review of the matter.
First, the volume of traffic on Arrowhead Avenue will within
the foreseeable future warrant a left-turn lane onto Fifth
Street. This will necessitate removal of the curb from my
property. I think it would be an unnecessary expense for me
to remove the driveway and install a curb, gutter, and side-
walk at this time when it will be required to be removed in a
year or two.
Secondly, I have offered use of my vacant lot to the County of
San Bernardino for a rent-free auxiliary parking lot for the
County complex. If my proposal is accepted, the existing drive-
way will be needed.
Therefore, based on these two factors, I hereby request the -0
existing driveway remain for the present time.

Your letter from the Public Works Department to Mr. and Mrs.
Edward E. Reinsch regarding subject reference matter has been refer-
red to the writer. The Public Works Department suggested I contact
you due to Mr. Reinsch and the writers inability to appear before the
Mayor and Council. Unfortunately a prior arrangement made by us
several months ago will not allow us to attend.
We are asking you to reconsider your request to "Remove existing
driveway approach and construct portland cement concrete curb gutter
and sidewalk to match existing". Mr. Reinsch purchased this proper-
ty, which had been vacant for a number of years, approximately six
years ago with the existing driveways. The first thing he did was to
improve the property by fencing the four plus acres, with gates at
three of the driveways.
At the present time Reintel employs 60 people. For sometime, we
have been considering doubling the size of our operation. Although
we have no definite plans, we feel this will be done in the future.
When this is accomplished we will increase employment considerably
and will need the driveway for parking. We are also planning a
commercial operation on the corner requiring entrance with the
additional driveway. This will necessitate a gate at that point.
If after you have h~d an opportunity to examine our request
allowing us to keep the existing driveway, and you would like further
discussion, we will be happy to meet with you.

In response to your letter of February 21, 1986, a copy of
which I have attached hereto, I am responding on behalf of
the property owner, Seymour H. Levin. Said property is
identified as Assessor's Parcel No. 0135-242-16, which
fronts on Second Street.
Your February 21, 1986, transmittal reflects that you are
requesting that the property owner remove existing driveway
approach and construct Portland cement concrete curb, gutter
and sidewalk to match the existing.
It is the position of the property owner, Mr. Seymour H.
Levin, that the same is an unnecessary and wasteful expense
which does not in any way improve either the city of San
Bernardino or the conditions at the property site.
At present, there are curbs and gutters and sidewalks, and
the request of the city is that the existing driveway be
removed and replaced with continued gutter and additional
curbing.
Within the near future, it is the intention of the property
owner to develop the subject property, and to incur a
needless and unnecessary expense, possibly running into the
thousands of dollars, in no way benefits either the City of
San Bernardino nor the property owner.
Mr. Levin has continually kept the property in a clean and
graded (semi-annually) condition, and as recently as 1985,
completed gutter, curb and sidewalks on the South end of
said parcel.
The portions that are now being requested to have the
driveways removed, would only cause the expensive removal of
said driveway, and t~en subsequently replacing the driveway
when the improvements are made on the subject property.

Dear Sirs:
The request by the City of San Bernardino to construct
by April 22, 1986, a Portland cement concrete curb and gutter
to match the existing curb and to remove an existing driveway
approach on the above-referenced parcel (hereinafter the "Pro-
perty") will cause an undue hardship and expense to the owner,
the Zaferis Family Trust, (hereafter "Applicant"), being the
cost of constructing a curb which would be subsequently des-
troyed and replaced with a new driveway entrance similar to
the one presently existing.
Applicant is a trust whose primary asset is the property
in question. Recently, the primary beneficiaries sold several
assets to achieve liquidity. The new liquidity of the trust
and the beneficiary has enabled them to plan the development
of the Property. Applicant contemplates development of the
Property in approximately 12 to 14 months. Such development
would require the use of heavy equipment which would require
or result in knocking down any curb constructed pursuant to
this Notice. Also, a cut would have to be made in the curb
to allow entrance to the permanent paved driveway on the Pro-
perty.
Rather than engage in a costly endeavor of constructing
a curb which would be in place for only a year, Applicant re-
spectfully requests relief from the requirement to build the
curb at this time.
Beautification of the City of San Bernardino is a desir-
able goal, but not if it requires an expense that will quickly

2. After discussions of our plans (Drawing 12-6-85) with Engineering Dept. and
Building & Safety Dept. staff, the front 45 feet of subject lot is being
paved for public parking in connection with our adjacent business building at
175 E. Baseline Street. The primary reason is that this is the only area
where we could provide vehicle parking that would be safe for the physically
handicapped. This is expecially true for wheel chair users, because then,
there is both close and, safe access to the entrance of the print work bUilding.
Also, no longer are they forced to wheel themselves on the "one ~'ay" driveway
in opposition t<l vehicle entry flow (see attached drawing of 12-16-85). This
parking improvement also avoids the need for a wheel chair user to wheel be-
hind any vehicle; therefore, more than meeting the State of California parking
provisions required for physically handicapped people.
3. Please note that in order to continue these safety features, we must continue
using the existing driveway (on the East frontage of parcel 140-082-04) for
proper flow and safe exit onto the heavily traveled Baseline Street. Note
also, we are making these safer parking improvements voluntarily (and of Course
at our own expense). For these "good" reasons, we respectfully request that
this parcel (140-082-04) be removed from the Chapter 27 California State pro-
gram (Chapter 12.92 of the San Bernardino Municipal Code) so that the exist-
ing driveway may be retained for the parking needs of physically handicapped
people.
