SYNOPSIS OF PREVIOUS COUNCIL ACTION CONTINUED...
In December, 1984, the Mayor and Common Council authorized staff to submit a
program application to the U.S. Department of Housing and Urban Development
for a second year funding for the Rental Rehabilitation Program.
In June, 1985, the Mayor and Common Council received and filed the Rental
Rehabilitation status report.
On February 17th, 1986, the Mayor and Common Council considered this matter
and continued the item to March 3, 1986.

STAFF REPORT
During fiscal year 1984/1985, West Side Community Development Corporation
(West Side CDC) met with Agency staff regarding the administration and
implementation of the newly-enacted Rental Rehabilitation Program (RRP).
Funds to administer the program were not included as an eligible cost of the
program. However, West Side CDC staff informed Agency staff that they were
seeking foundation funding and, if successful, felt this program could <greatly
assist their agency in becoming financially self-sufficient. West Side CDC
eventually obtained foundation funding, and after a number of meetings with
Agency staff, a letter of agreement was entered into in November, 1984. Said
agreement is attached to the staff report and shown as Exhibit "1".
It should be noted that during the meetings with West Side CDC staff and the
Council when this and related matters were discussed, Agency staff supported
the transfer of administrative responsibilities primarily for the reasons set
forth below:
a) The statutory prohibition against recovering administrative
costs from the grant or from program income. Local
agencies were expected to support the RRP' s administrative
costs from the Community Development Block Grant (CDBG).

b) West Side CDC's successful endeavor to acquire foundation
funding to administer the Rental Rehabilitation Program.
c) West Side CDC's experience in rehabilitating single and
multifamily structures throughout the city.
During the first several months~ of the program, West Side CDC staff was able
to accomplish the initial goals of the program. A HUD monitoring report that
was previously provided to the Mayor and Common Council reflected good
progress in meeting with the program goals and commended the city for it' s
early start in the program, especially when compared to the progress of other
localities. The HUD monitoring report further recommended changes on a number
of RRP forms. These changes were accomplished, submitted to HUD and approved.
Subsequent to the initial monitoring visit by HUD staff, a number of
administrative matters came to the attention of staff relating to the
processing of RRP loan requests. These concerns were evidenced by the
submission of incomplete loan packages for consideration by the RRP Loan
Review Committee, basic arithmetic errors on the evaluation forms used by West
Side CDC staff to rank applications and a number of RRP Loan Review Committee
meetings that were scheduled and 'subsequently canceled during the period of
October 18, 1985 to January 21, 1986 because of incomplete information.

Agency staff and the Agency Housing Consultant spent a great deal of time and
effort in attempting to resolve some of the concerns noted above. However,
the same or similar problems surfaced when a number of individuals spoke to
Agency staff in connection with the move-on houses located on Arizona Street.

concerning this subject is attached as Exhibit "2". A subsequent memorandum
from Ken Henderson to Glenda Saul dated February 6, 1986 (Exhibit "3")
provided additional information on a meeting held with Roland Corrales, a
partner in the company rehabilitating the move-on homes. It was as a result
of this meeting that staff requisitioned the RRP move-on files developed and
maintained by West Side CDC.
In reviewing the case files, staff noted inconsistencies in the information
submitted on the RRP application forms. The RRP Loan Review Committee had
previously approved loans for the first two (2) move-on homes with, two, (2)
additional applications pending. In attempting to verify the information
contained on the relevant application forms, staff determined that the
financial data listed as permanent financing had not been acquired even though
the application represented in fact, that permanent financing was in place.
There remains a difference of opinion between Mr. Corrales and West Side CDC
as to whether West Side CDC had been informed by Mr. Corrales that the
financial information was "projected" information, rather than actual.
Potential' audit liability was avoided when Agency staff received two (2)
requests to subordinate from Mr. Corrales who had subsequently obtained
permanent financing from Great Western FinanciaL Agency staff denied the
request to subordinate, forcing Great Western Financial to "take out" the
Agency assistance of $5,000 per home.

Over the last 2-3 months, West Side CDC staff discussed with Agency staff the
possibility of acquiring additional funding to continue administering the
Rental Rehabilitation Program. Agency staff indicated that in discussing this
matter with the Redevelopment Committee, the Committee did not look favorably
upon providing additional funding for the Rental Rehabilitation Program,
(West Side CDC had previously exhausted the foundation funding originally
received to administer the program.)
In view of the above noted concerns, the Redevelopment Committee recommended
that the Mayor and Common Council consider terminating the administrative
agreement with West Side CDC. Staff concurs with the Committee
recommendations for the reasons set forth below:
a) Administrative and management concerns that call into
question the ultimate use of program funds and potentially
exposes the city general fund if possible audit exceptions
remained unresolved.
b) Lack of additional funding to provide for West Side CDC's
continued operation of the Rental Rehabilitation Program.
c) Agency staff has expended an extraordinary amount of time
in attempting to resolve various problems, especially in
light of the fact We~t Side CDC is responsible for
virtually all of the administrative functions associated
with the program.
d) The reduction in overall productivity from October 1985, to
January 1986.

e) The fact that the Reagan Administration has requested that
third year funding for the RRP be rescinded.
Staff recommends the Mayor and Common Council consider termination of the
administrative agreement with West Side CDC for the reasons noted above.

This letter will constitute an understanding between the City of San
BernarcU.no Redevelopment Agency, hereinafter referred to as "the City", and
West Side Community Development Corporation, hereinafter referred to as
"WSCDC" , with regard to the administration by WSCDC of the City of San
Bernardino's Rental Rehabilitation Program, an entitlement program funded by
the U.S. Department of Housing and Urban Development. An Agreement between.
the City and WSCDC will be developed based upon the tasks and functions set
forth below.

WSCDC agrees to undertake the following tasks in support of the City's Rental
Rehabi1it1on Program:
(a) Conduct marketing and outreach activites to attract inveat/owners
to apply for the program;
(b)
Provide pre-application and full application

(g) Sublll1t full applications to United States Escrow for loan packaging.
(h) At owner's request, perform progress inspections of rehabilitation
work and submit these inspections to U.S. Escrow together with
requests for contractor payments; and
(i) cUpon completion of rehabilitation, perform a final insPec~iou" to
determine compliance with Housing Quality Standards, and inform
City in order to clear deficiencies on the property.
The City agrees to support the Rental Rehabilitation Program by undertaking
the following tasks:
{a}' Adopt the draft Tenant Assistance Policy and provide WSCDC with
copies for distribution to investor/owners and tenants and anyone
else upon request.
(b) Negotiate a contract for escrow services to support the program,
and have the escrow company train WSCDC in the completion of
necessary forms and documents.
(c) Establish the Loan Review Board to review, prioritize and select
proposals for funding which have been submitted as a result of
WSCDC's marketing efforts.
(d) Assist WSCDC in publicizing the program through press releases,
outreach to lenders, and other activities.
(e) Provide other City services to support the program, including
arranging for environmental reviews, and conducting inspections and
cost-reasonable reviews of properties submitted Which are presently
owned by WSCDC.
(f) Provide City oversight of any temporary or permanent relocation
necessitated by the program, in accord with the provisions of the
Tenant Assistance Policy adopted by the City.
(g) Provide consulting assistance to WSCDC in establishment of Rental
Rehabilitation Program systems and procedures, design of forms,
initial training of staff, and preparation of program brochures in
accordance with BUD requirements, perform periodic monitoring of
WSCDC's activities and; ensure that the program is being run in
compliance with BUD rules and regulations.

Background
'1'he Mayor and Common Council approved the transfer of the Rental
Rehabilitation Program (RRP) admini.trative responsibilities to San Bernardino
West Side Community Development Corporation (WSCDC) on October 8. 1984. The
lUI.P Loan Review Committee is composed of .even (7) individuals, appointed by
Mayor Holcomb, who are profesaiona18 in the lending, housing or development
industries. Thi. Committee provides final approval/denial of all RRP loans
recOBmended by WSCDC.
On December 27, 1984, the Department of Building and Safety issued permit
15993S (the first of eight) for a house move-on to an existing lot at Arizona
AVellUe. On May 8, 1985, permit 161254 and 161255 were issued. Then on June
14, 1985, permits 161660 through 161664 were i.sued for moving tbe remaining
five (S) houses onto uisting Iota on Arizona Avenue (copies of referenced
perait8 are attached).
All permits show Barbara J. Swindal and Roland Corrales as property owners,
ucept for permit 161664 which shows Peter D. Brandon and Roland Corrales as
owners. All eight (8) permita were issued under an owner-builder declaration.
B.DA staff's discussion with Planning Department staff on December S,198S,
revealed that the original Building Move-<ln Application 85-7, for property

10cated.'it; 1701 Arizona Avenue, was approved by the Planning Commission on
April 16, 1985. Building Move-<ln Applications 85-9 through 85-14, for the
remaining seven (7) houses, were '. approved by the Planning Commisaion on May
21. 1985.
Before the eight (8) Building Move-<ln Applications were approved by the
Planning Commission, Planning Department staff ..iled out letters to
approximately 95 property owners within a 500 foot radius of subject
properties. notifying them of the action pending. A public hearing was also
held on the nights of the respective Planning Commission meetings, before the
Building Move-<ln Applications could be approved.

On June 28, 1985, the Lolm Review COIIIIIIittee approved a $5,000 ~, equslly

9, 1985. the Lolm Review Committee approved a $5,000 ~, equally aatched by
llWDer'a funda, for a cOlllbined $10,000 to be uaed for code rehabilitation of
aove-on housea located atl 1773 Arizona Avenue, 1795 Arizona Avenue, and 1805
Arizona Avenue. ' -
Sometime in late Auguat. 1985, Dwane Burless of WSCDC, aentioned, to. Maurice
Oliva, IDA Rehabilitation Coordinator, that hia bon, Valerie Pope Ludlam and
aeveral othera in the eo_unity had uprened aerious concerna" over the
apparent a10w prolreas and poor quality of worklllanahip on the reb&bilitation
of the eight (8) aove-ons at Arizona Avenue. Dwane'a concern included a
auspicion that the ownera Barbara Swindal and Roland Corra1ea aight not have
enoulh funda to cOlllp1ete each aove-on house funded under the RllP. Dwane felt
that each houae would take ~ than the combined $10,000 ($5,000 RllP loan and
$5,OPO . owner utch) to complete. Maurice indicated that WSCDC ataff ahould
have prepared for thia problem up-front, by eDlllining a total cost breakdown
for each house. Maurice alao commented that WSCDC ahould have required the
owner to depoait any funds exceeding the committed $10,000 into the same
escrow account that vaa opened for the RllP. This would have assured adequate
reservation of funds by the owner, before the project vaa committed. Dwane
atated that WSCDC staff had not required this on the two (2) loans already
funded with construction underway. Maurice and Dwane mutually alreed that
documents should not be executed for the next two (2) aove-on 10ana (already
approved). until Dwane aeets with the property llWDera to resolve the concerns.
We underatand that WSCDC Ilet with property llWDer Barbara Swindal aometime
during the aonth of September. Dwane informed Maurice tbat Ms. Swindal was
aecuring s BUD Section 203K insured loan as permanent financing for the
move-on housea and would provide him with a letter of commitment from her
lender. Dwane further stated that WSCDC offered to provide her with a list of
local construction workers that could provide better workmanahip. At that
'point, Maurice and Dwane decided to hold off executing the Rental
Rehabilitation documents for the next two (2) move-on loans (approved Auguat
9, 1985) until they provided information verifyinl a commitment of additional
funds to complete the move-on houses under the B.RP. 70 date the letter of
commitment has not been submitted to WSCDC.
It is our understanding tbat WSCDC ataff has been instructed m to execute
loan docUlllents 011 the two (2) approved loans and m to process any of the
other B.RP app1icationa subaitted by Barbara Swinda1, Roland Corrales or Peter
Brandon. To date, WSCDC has received B.RP Pre-Appl1catione for the following
properties, that have not been processed:

Mr. Corrales aaid that WSCDC ataff later informed hill that ~he imP vas no

there IIUst be a msunderstanding because staff had been informed that there
mght even be a third year of IllU' funding by BIlD. Mr. Corralea was very upset
and felt that they (property owners) were being treated unfairly by WSCDC and
.C1ty:officia1a. Be atated ~hat Peter Brandon (one of his partners) vas also
under IIUch criticiam by the Community and Press at a Northwest PAC meeting he
attended (aee attached newspaper article).
Mr. Corrales inforaed ataff that he vants the remaining four (4) IllU'
applicati01l8 to be processed and approved but that he refused ~o: 1) work
nth WSCDC, 2) deposit more than $5,000 per house in escrow, and 3) provide
verification to WSCDC that ~heY have a commitment for their (owners) permanent
financing to complete the project. Mr. Corrales has since then atated that he
would provide a letter of commitlllent on the financing to IlDA, but not to WSCDC.
Based 011 all of the preceding, Mr. Corrales requeated that IlDA administer his
IllU' loans. Aa an alternstive to depositing any money into Escrow, yet assure
the City that they have enough money to complete all the projects, he proposed
that lUlA aimp1y reimburse them the maximum B.R.P loan amount of $5,000 for each
house, after the rehabilitation was completed and passed final inspection by
the Department of Building and Safety.
SiDce Mr. Corrales propoaal was not In accord nth the 1UU' procedural manual,
Maurice contacted Frank Talaska of BIlD to request an opinion. Mr. Talaska
aaid that the City is correct in it's position requiring verification of the
owner's financial ability to complete each move-on house before funding the
1UU' loans. Be stated that requiring a deposit into Escrow seemed liked a good
protective measure and if the owners could not comply, then that was their
problem. However, if the City decides to go forward as propo.ed by the owner,
it (the City) must place very specific conditions 011 how the rehabilitation
monitoring inspections will be made and define the procedure for verification
of material and labor expenditures, before payment can be reimbursed.
Finally, Mr. Tala.ka advised thAt if the owners are experiencing delays in
getting permanent financing, or are unable to deposit the additional funds in
Escrow due to lack of cash flow, the City could offer them a CDBG "interim
loan", with deferred payment due and payable as aoon as their permanent
financing vas in place. This would enable the applications to go forward as
B.R.P projects now, and the CDBG loan funds to be placed in Escrow to guarantee
completion of all the move-on houses. Under the above acenario, the owner
would still have to match the City's $5,000, with $5,000 of private funds for
each houae.

of letter attached). During the week of December 2 through December 6, 1985,
the rumor 10 the CoIlmunity and information ghen by Valerie to the Presa
(about a "grant") was ailDp1y aidnformation. !ten Benderaon attempted to clear
up the. aidnformation during hia phone conversationa with Valerie on December
~ 5 ana December 9, 1985. DuriD& thoae phone converaationa Valerie informed !ten
that ahe becUle oyer)' upset about the aituation and had lone to the Press. !ten
advised her that Larry Hicks, of the SlID, had contacted hiID. lCen told Valerie
that if ahe would have contacted hiID regardiDg her concerns before goiDg to
the Preas, he could have cleared up the II1sunderatandtDg.
We finally received the ease files pertaining to the eight (8) aubject
properties on December 10, 1985. Staff has contacted United Statea Eacrow and
upecta to hear from them by Friday. December 20, 1985. regarding the
mechanical feasibility of escrowing the projects as proposed by Mr. Corrales.
Staff is currently reviewing the ease filea, inc1udiDg the four (4) UP
Pre-Applications that WSCDC had not procesaed, to determine if the loans
requeated are financially feadb1e. Once these taska have been completed, a
determination can be made regardiDg future status of the four (4) loans
approved, as well aa the four (4) UP applications pencU.Dg.

RENTAL REHABILITATION PROGRAM-EIGHT (8) MOVE-ON HOMES
During the past several weeks, problems have surfaced with respect ot San
Bernardino Hestslde CDC's administration of the Rental Rehabilitation
Program (RRP) on behalf of the City.
Four of nine RRP loan applications submitted by Roland Corrales on behalf
of property ownerBarbara Swindall, for the Rehabilitation of move-on
houses were approved by the Loan Revl ew Comml ttee on June 28th and August
9, 1985.
Soon thereafter, controversy was brought to the attention of various City
Officials and Departments by the complaints from Hestslde Community
leaders and residents regarding the apparent slow progress and poor
quallty of workmanship on the eight move-on houses on Arizona Avenue.
Th15 resulted In Hestslde COC's suspicion that the owners mIght not have
enough funds to complete each project approved under the RRP. RDA staff
advIsed HSCDC that they should have safe guarded agaInst this problem to
begin wIth, by requiring the owners deposit all funds needed to complete
each house, Into the same escrow account that was opened for the RRP funds.
Numerous meetings between the owners, Valerie, Pope Ludlam and the
Northwest Project Area Committee, were held, Roland Corrales, one of the
owners partners, met with RDA staff to complain that he was not sat15fled
with HSDC's handllng of h15 RRP applications, Valarle had refused to
process their approved loans and remaining five appllcatlons, Apparently
HSCDC staff had told him that there was a "FREEZE" on RRP funding. There
was no such freeze In effect. In fact, RDA staff had heard that HUD had
allocated a third year's funding,
RDA staff requisitioned the subject files from HSCDC on November 26, 1985,
so we could InvestIgate the complaints. He fInally received the case
fIles on December 10, 1985.
Staff's review of the subject flIes has revealed apparent InconsIstencies
wi th the RRP Processing Procedures Manual. There 15 also ml slnformatlon
contained In loan appllcatlons that should have been verified by HSCDC
staff, before recommending 'approval to the RRP Loan Review CommIttee.

The Issue surfaced on January 9, 1986. Mr, Corrales requested that the
Ctty subordtnate our $5,000,00 RRP ftrst trust deed to Great Western
.~tnanctal so they could record ftrst posttton loans for $45,000.00 on 2 of
the properttes. Mr, Corrales stated that Wesley Nave, Rehabtlttatton
Spectaltst for WSCDC had tnformed htm that subordtnatton would be posstble
after the permanent loans were approved. There Is nothtng tn the case
ftle however that documents thts statement.
The ctty could not subordtnate tts trust deeds because dotng so would not
meet the 90t loan to value ratto requtred by the RRP procedures to secure
the ctty's loans,
On January 17, 1986, RDA sent a letter to Valarte Pope Ludlam requesttng
the submtttal of RRP loan ftles that are tnacttve due to project
completton, appltcant wtthdrawl, or closed for vartous reasons, On
January 19, 1986 RDA sent a letter to Dwane 8urgess documenttng hts phone
conversatton wtth Maurtce Oltva that the ftles would be ready to ptckup on
January 31, 1986 at 3:00 p.m. Wesley Nave called Maurtce that day to
tnform htm that coptes had not been made. Therefore the fnes would not
be available, Mr. Nave agreed to have the fUes ready for ptckup on
February 5, 1986, When RDA staff arrtved to ptck them up, they were told
that the ftles had sttll not been copted,
Dwane Burgess called Maurtce that eventng to tnform htm that they would
call us as soon as the ftles were ready to be ptcked up the next day,
Although Agency staff has not been able to revtew the other closed RRP
fUes, we felt that tt would be approprtate to advise the Redevelopment
Commtttee of our concerns based on the ftndtngs to date,

_oranda detaU problems that have surfaced with respect to West Side CDC's
administration of the Rental Rehabilitation Program.

Also attached is a letter sent to West Side CDC confirming the pick up of
Rental Rehabilitation files that have been closed for whatever reasons. At
the Committee meeting scheduled for February 6, 1986, staff will provide
additional information regarding the status of this program.

1) Purauant to my telephone converaations with Roland Corrales on
.January 9 and .January 14, 1986, the mortgage information (including
balance IIJld IIOnthly payments) contained in the IlRP pre-applications
for all nine properties were estimated by the applicant based on
proposed loan. to be taken out as permanent financing.
2) The IlRP Final Application Swumary Sheet, prepared by San Bernardino
West Side CDC ataff IIJld presented to the Loan Review Committee (LB.C)
reflects the estimated IIOrtgage information, rather than actual fact.
3) Four of the Dine IlRP loan applications have been approved for funding
by the LB.C, based on this estimated, rather than factual,
information. The four approved loans (for $5,000 each) are for
properties located at 1705, 1805, 1773 and 1795 Arizona ",venue. Only
the loans for 1705 IIJld 1805 Arizona have been executed. AI' of this
date, UDited States Escrow reports the following activity:' ,

. Of the $5,489.50 deposited by the owner, $1,066.66 balance remains
undisbuned.
. Of the $5,000 IlRP loan funds, $2,266.68 balance remains

4) I'IRT Title Reports ordered from SAFECO for the four approved IB.P
properties show 110 liens or aortaaaea 011 the subject propertj,ea,.
However, the report reflects an assessed valuation for lsn~ but none
for iaprovBmellts. .
5) The appraised value for three of the four subject properties was
performed with houaes 111 aove-on condition with 110 connection to
foundation or utilities, but value liven was for houses ill habitable
condition as per City requirements. The appra18ed value for these
,three subject properties was $50,000. 1705 Arizona Avellue was
appraised at $63,000 111 -as is" condition.

6) On .Janusry 9, 1986. Mr. Corrales requeated that the City subordinate
our $5,000 B.B.P first trust deeds to Great Western Financial so they
can record first position loans for $45,000, ss permanent finallcing
011 1705 and 1805 Arizona Avenue. Mr. Corrales stated that Wesley
Nave had informed him that this would be possible after the permanent
loans were approved. There 18 1I0thing 111 the ease file that
documents this commit1llent.
If the City subordinates its position to Great Western for $45,000,
O11ly 1705 Arizona Avenue would meet the 90% loan to value ratio
required by the B.B.P procedures to secure the City'. loan. See
