This item was continued from the Planning Commission meetings of
January 7, and February 4, 1986, in order to permit the Chambers
of Commerce an opportunity to review and comment on the proposed
ordinance amendment. Copies of the proposed ordinance amendment
have been circulated to the San Bernardino Area Chambers of
Commerce, Highland Area Chamber of Commerce, and the Inland
Empire Hispanic Chamber of Commerce for their review.
To date no comments have been forwarded to the Planning Department
from the respective Chambers of Commerce.
The Planning Department, therefore, recommends that this item
be considered by the Planning Commission for a recommendation
to the Mayor and Common Council

The proposed revision to Municipal Code Section 19.60.040 has been
amended to include a provision to permit City employees to remove
unauthorized signage from City property. The type of signage
which is most prevalent are the tract sales signs which are posted
within City parkways.
The proposed ordinance regulating parking lot and sidewalk sales
is intended to ] iroit the number and length of time of outdoor
sales events and restrict their use to existing on-site businesses.
The Planning Department routinely receives requests for sidewalk
or parking lot sales, however, there are currently no code provisions
which permit outdoor display and sales.
The proposed ordinance will help to insure a more uniform approach
toward the use and enforcement of parking lot and sidewalk sales
by providing guidelines ~nd a monitoring procedure from which a
retai] business may plan its outdoor sales events.

SECTION 1.
SectIon 19.60.040 of the San Bernardino
Municipal Cud~ is amended to read as follows:
"19.60.040 Prohihition.

SECTION 3.
Section 19.24.020 subsection F is added to the
San Bernardino Nllnicipal Code to read as follows:
"F. Parking lot sales or sidewalk sales - Parking lot sales
or sidewalk sales rondl1cted under the provisions of Section
5.04.365."
SECTION 4.
Section 19.04.457 is added to the San Bernardino
Municipal Code to read as follows:
" 19. 04 . 457
Parking lot sale.
'Parking lot salp' means a promotional sales event sponsored
by one or more bllsinesses, which is held outside the confines of
the c()mmer('ial or manufactllring building or buildings in which
stIch busil,ess is normally conducted, and which sale involves the
olltdoor display, within an area on the same lot as the b11ilding,
of merchandise which is normally displayed within the building."

Section 19.04.487 is added to the San Bernardino
Ml1nlctpal Code tu read as follows:

RESOLUTION OF THE CITY OF SAN BERNARDINO ESTABLISHING A FEE
FOR PERMITS FOR PARKING LOT SALES AND SIDEWALK SALES.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Pursuant to Section 5.04.365 A of the San
Bernardino Municipal Code, the fee to be paid to the City Clerk
for the cost of a permit to conduct a parking lot sale or
sidewalk sale is established at $25.00. This fee shall not be
refundable.
