Synopsis of Previous Council action:
02-03-53 -- Resolution No. 2589 adopted authorizing execution of an Agreement
with the National Orange Show relating to the installation and
maintenance of an electric fountain.
Recommen<led motion:
That the City Clerk be directed to give notice to the National
Orange Show that the Agreement dated 1-16-53, relating to
installation and maintenance of an electrically illuminated
water fountain in the lagoon east of the Swing Auditorium
Building, will terminate 90 days from the date of said notice.

STAFF REPORT
This Agreement provides, in general, that the City would install an
electric fountain, and perform necessary maintenance during the annual Orange
Show exhibition. Also, that the National Orange Show could operate the foun-
tain during all other times.
The National Orange Show agreed to install a concrete vault and
electrical service, and bear costs for electricity and water.
Another feature of this Agreement was that the City received per-
mission to erect a sign to the effect that the fountain is an exhibit of the
City of San Bernardino. No such sign has been in place within anyone's
recollection.
A representative from the National Orange Show has requested that
the City perform needed repairs before the annual exhibition. The cost of
these repairs by the Public Buildings Division is $2,020. In addition, the
Park Division will have to clean and fill the lagoon after the repairs have
been completed, at an estimated cost of $1,500.
Either party can terminate this Agreement by giving a written 90-day
notice.
In view of the limited benefits to the City and substantial costs
that will be incurred to perform the maintenance, we recommend the Agreement
be terminated.
