STAFF REPORT
Pursuant to the provisions outlined in SB 180 amending
Section 99 of the Revenue and ~axation Code, the City and
County have ,a thirty (30) day period to negotiate a
distribution of ad valorem taxes in the nine-island Highland
. area annexation' (LAFC fio. 2365).
'~he taxes have been negotiated and the final results will be
distributed upon approval by the County Board of Supervisors.

We have placed on the San Bernardino County Board of Supervisors' Agenda fOJ.
. Monday, February 10, 1986, adoption of the resolution relating to tax negotiations for
LAFC NO. 2365, entitled, "Property Tax Transfer to the City of San Bernardino,
LAFC. No. 236.5".
Attached is a copy of our recommendation, the resolution to be adopted, arid the
breakdown of transfers to be made, as submitted to the Board of Supervisors. When
it is approved, the Local Agency Formation Commission Office will send you a copy
showing the action taken by the Board.

Senate Bill 180 requires that your City Council also adopt a resolution relating to the
tax transfer and forward that to the Local Agency Formathm Commission Office.
The final date for submission of your City's resolution to the Local Agency Formation
Commission is February 14, 1986.

PROPERTY TAX TRANSFER TO THE CITY OF SAN BERNARDINO,
LAFC NO. 236'
RECOMMENDATION:
Adopt a resolution transferring $351,362 to the City of San Bernardino as a
result of pending annexation.
BACKGROUND:
State law requires that agreement on distribution of property tax relating to
proposed boundary changes be reached before the Local Agency Formation
Commission issues a Certifcate of Filing. On May 19, 1980, the Board approved
the formula for property tax transfers which had been agreed upon by county
staff and a committee of city managers. The subject tax transfer includes the
amount derived by formula plus an additional amount recognizing that this
annexation consists of developed areas with significant population and that the
annexation provides for more efficient delivery of municipal services.

This action will determine the share of property tax revenue to be allocated as a
result of this jurisdictional change and shall only be effective upon satisfactory
completion of annexation proceedings.
The amount is transferred fridtn County General Operations, Library, CSA 38,
CSA 38 Improvement Zone G, CSA 70, CSA 70 Improvement Zone A and CSA
SL-I.

RESULTING FROM THE JURISDICTIONAL CHANGE DESCRIBED BY LAFC NO.
2365. ".
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Recitals. The Mayor and COllmon Council of
the City of San Bernardino hereby find and determine that:
A; Pursuant to Section 99 of the Revenue and Taxation
Code, prior to the issuance of a certificate of filing by the '.

of all local agencies whose service area or service responsi-
bilities will be altered by a proposed jurisdictional change

herein by reference, resulting froll the aboYe'ducrJbed
jurisdictional change, is hereby approved and accepted. The
column entitled WEstimated Current Tax Revenuew shall represent
the amount of property tax revenues for the current year to be
pa i d to the Coun ty of San Bernardino and Hs affected agenci I' s.
B. The annual tax increment generated in the area
subject to the jurisdictional chan~e and attributable to the
Local Agencies whose service area or service responsibili ties
will be altered by the proposed jurisdictional change shall be
allocated in the future years pursuant to the provisions 0("
Section 98 of the Revenue and Taxation Code.
SECTION 3.
The City Clerk of the City of San
