Synopsis of Previous Council action:
At the regular meeting of the Hayor and Common Council, held
January 6, 1986, Resolution No. 86-10 was adopted authorizing
submission of an application to the Local Agency Ftmation
Commission of the County of San Bernardin for the nexation
of inhabited and uninhabited territory located gen rally north
of Highland Avenue, between Waterman Avenue and Boulder Avenue.
Recommended motion:
Adopt resolution.

STAFF REPORT
Pursuant to
Section 99 of
County have a
distribution of
area annexation
the provisions outlined in SB 180 amending
the Revenue and Taxation Code, the City and
thirty (30) day period to negotiate a
ad valorem taxes in the nine-island Highland
(LAFC No. 2365).
The taxes have been negotiated and the final results will be
distributed upon approval by the County Board of Supervisors.
The resolution must be received by LAFCO by February 14,
1986.

RESULTING FROM THE JURISDICTIONAL CHANGE DESCRIBED BY LAFC NO.
2365. y
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Reci ta 1 s. The Mayor and Common Counci 1 of
the City of San Bernardino hereby find and determine that:
A. Pursuant to Section 99 of the Revenue and Taxation
Code, pri or to the issuance of a certifi ca te of fi 1 i ng by the
Local Agency Formation Executive Officer, the governing bodies
of all local agencies whose service area or service responsi-
bilities will be altered by a proposed jurisdictional change
will negotiate and determine by resolution the amount of
property tax revenues to be exchanged between and among such
local agencies.
B. Except as provided in Section 99.1 of the Revenue
and Taxation Code, in the event that a jurisdictional change
would affect the service area or service responsibility of one
or more special districts, the Board of Supervisors of the
County of San Bernardino shall, on behalf of the district or
districts, negotiate any exchange of property tax revenues.
C. The Mayor and Common Council of the City of San
Bernardino and the Board of Supervisors of the County of San
Bernardino have determined the amount of property tax revenues
to be exchanged as a result of the jurisdictional change de's-
cribed by LAFC No. 2365.

SECTION 2. Implementation.
A. The negotiated exchange of property tax revenues

Bernardino attached hereto as Exhibit "A" and incorporated
herei n by reference, resul ti ng from the above descri bed
jurisdictional change, is hereby approved and accepted. The
column entitled "Estimated Current Tax Revenue" shall represent
the amount of property tax revenues for the current year to be
paid to the County of San Bernardino and its affected agencies.
B. The annual tax increment generated in the area
sUbject to the jurisdictional change and attributable to the
Local Agencies whose service area or service responsibilities
will be altered by the proposed jurisdictional change shall be
allocated in the future years pursuant to the provisions of
Section 98 of the Revenue and Taxation Code.
SECTION 3. The City Clerk of the City of San
Bernardino is hereby directed to certify to the passage of this
resol ution and to cause a certified copy to be sent to the
Executive Officer of the Local Agency Formation Commission of.
the County of San Bernardino.
