CI. r OF SAN BERNARD..40 - REQUlo.ST FOR COUNCIL At, .ION STAFF REPORT The attached ordinance relating to replacement signs is an amendment of Section 19.60.2.50 of the San Bernardino Municipal Code. This section has been amended to clarify the provisions of the Municipal Code relating to replacement signs. A replacement sign is an off-premise sign which the City permits to be built in return for the removal of another off-premise sign by the sign company. Subsection B. Paragraph 1. of this ordinance provides that a sign company may replace an off-premise sign from anywhere in the City with another off-premise sign placed in certain designated zones, upon the approval of the Planning Commission. The Planning Commission may require the removal of more than one off-premise sign before granting the right to erect the replacement sign. There is a limitation placed on the amount of square footage per face of the replacement sign. Under no circumstances shall the surface area of the face of the replacement sign be greater than the square footage of the face of the sign or signs removed. Subsection B. Paragraph 2. of the ordinance relates to the specific circumstance where the original sign is to be removed from a major artery or the Downtown Business District and replaced with one within 660 feet of the right-of-way of interstate or primary highways or other freeways. Such placement is prohibited except under limited circumstances set forth in the State Business and Professions Code. This ordinance adopts regulations for the placement of such signs in the City of San Bernardino which are consistent with said State Code provisions. The ordinance provides that an agreement may be executed between the sign company and the City of San Bernardino through the Mayor and Common Council for the placement of such a replacement sign. The agreement shall permit such placement for a period of no longer than ten years from date of issuance of the building permit for the replacement sign. In addition, the Mayor and Common Council may require the removal of more than one sign for the right to erect the replacement sign. The replacement sign under this provision is sUbject to the same square footage per face limitations as set forth in. Subsection B. Paragraph 1. The ordinance specifically sets forth that all other provisions of the San Bernardino City Sign Code apply to replacement signs. 75-0264 1 ORDINANCE NO. 2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTION 1S.60.250 SUBSECTION B OF THE SAN BERNARDINO MUNICIPAL CODE TO 3 PERMIT THE REPLACEMENT OF OFF-PREMISE SIGNS WITH OFF-PREMISE SIGNS TO BE ERECTED IN C-3, C-3A, C-M, M-1 AND M-2 ZONING 4 DISTRICTS, AND SUBJECT TO THE TERMS AND CONDITIONS OF A WRITTEN AGREEMENT p~D THE APPROVAL OF THE MAYOR AND COMMON COUNCIL, 5 WITHIN 660 FEET OF FREEWAY AND PRIMARY STREETS. 6 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: 7 8 SECTION 1. Section 19.60.250 Subsection B of the San 9 Bernardino Municipal Code is hereby amended to read: 10 "B. Replacen:ent signs. 11 1. Any company owning an off-premise sign may replace such 12 sign with another off-premise sign to be placed in a C-3, C-3A, 13 C-M, M-1, or M-2 zoning district within the City subject to 14 conditions and after review and approval of a plot plan by the 15 Planning Commission. The decision of the Planning Commission 16 shall be subject to appEal to the Common Council pursuant to 17 Chapters 19.81 and 2.64 of the San Bernardino Municipal Code. 18 The replaced sign or signs shall be rerroved or demolished prior , 19 to the use of the replacement sign. The Planning Commission may 20 require the removal of more than one billboard or painted 21 bulletin by the company in exchange for the right to locate one 22 new replacement sign. Under no circumstances shall more than one 23 new sign be erected to replace one sign removed. A conditional 24 use permit shall not be required. Each new replacement sign 25 shall conform to all other provisions of the San Bernardino 26 Municipal Code relating to off-premise signs, provided that the 27 advertising display of the replacement sign shall not exceed the 28 display area of the off-premise sign or signs to be replaced, and 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 in no event shall it be greater than six hundred seventy-two square feet per face with a maximum of two faces. Display area does not include decor or pole covers. 2. Subject to the approval of the Mayor and Common Council and pursuant to the applicable provisions of paragraph 1 above, a written agreement may permit the replacement of one or more off- premise signs located near major streets or in the downtown business district with an off-premise sign to be placed in one of said zoning districts within six hundred sixty feet of the edge of the right-of-way of interstate or primary highways or freeways for a period not to exceed ten years from date of issuance of the building permit. The new replacement sign placed within six hundred sixty feet of such interstate or primary highway shall comply with state display area limitations and other applicable state laws and regulations, including the Outdoor Advertising Act and Section 5408 and related provisions of the Business and Professions Code."
