STAFF REPORT
On October 7, 1985, the Commission adopted Resolution 4804, authorizing staff to
negotiate an agreement with the Data Gathering Center (California State University,
San Bernardino) for the development of a needs assessment study for the Enterprise
Zone.
As a result of aeveral meetings between Agency staff and the Data Gathering Center, a
Marketing Plan outlining objectives and methods was developed. Under the terms of.the
proposed contract, in Phase I of the program, the Center will determine the particular
needa of the Enterprise Zone, identify industries which can meet those needs, target
specific companies likely to move to the Zone, and develop a marketing strategy to
attract those companies. The marketing strategy will also include a plan to sell the
Enterprise Zone concept to Zone residents.
Phase II of the program will entail the monitoring of the marketing strategy as
implemented by the City for its effectiveness in meeting stipulated goals and
recommend any appropriate modifications.
The Center estimates Phase I will cost approximately $50,025. Phase II will be
charged on the basis of time and materials.
Conceptual approval of this contract was given by the Commission on November 18, 1985.

DEVELOPMENT OF A MARKETING STRATEGY FOR THE ENTERPRISE ZONE BY
THE DATA GATHERING CENTER OF CALIFORNIA STATE UNIVERSITY, SAN
BERNARDINO.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor of the City of San Bernardino is
hereby authorized and directed to execute for and on behalf of
the City of San Bernardino an agreement with the Foundation for
California State University, San Bernardino, relating to the
development of a marketing strategy for the Enterprise Zone by
the Data Gathering Center of California State University, San
Bernardino, with such changes thereto as may be approved by the
Mayor and City Attorney. A copy of said agreement is attached
hereto as Exhibit -1- and incorporated herein by reference as
though fully set forth at length.

RELATING TO THE DEVELOPMENT OF A MARKETING STRATEGY FOR THE
ENTERPRISE ZONE BY THE DATA GATHERING CENTER,. CALIFORNIA STATE
UNIVERSITY, SAN BERNARDINO
THIS AGREEMENT, effective the
day of
, 1986, by and between the CITY OF SAN
BERNARDINO, a municipal body corporate, hereinafter referred to
as the .City., and the FOUNDATION POR CALIFORNIA STATE
UNIVERSITY, SAN BERNARDINO, hereinafter referred to as
.Contractor., sets forth the agreement of the parties.
SECTION 1. Recitals.
A. City has established an Enterprise Zone pursuant to
ordinance duly adopted by City, and has requested state

designation of its Enterprise Zone.

B. To maximize the benefit of the Enterprise Zone, City
desires to develop a marketing strategy aimed at accomplishing
15
the following objectives of the City's Enterprise Zone:

1. To reduce unemployment in the Zone;
2. To increase the net growth of locally owned
business in the Zone;

3.
To increase the net growth of business in the Zone;
21
4. To create new housing in the Zone;
5.
To renovate both existing housing and commercial
22
23 establishments in the Zone;

6. To promote outside investment in the area
25 encompassed by the Zone;
26
27
7. To reduce crime in the Zone;
8. To produce a greater feeling of social cohesion,
28 i.e., community, in the Zone;

9. To increase per capita income in the Zone; and

10. To accomplish these objectives within the

perameters of the Environmental Impact Report/Statement so as not

to adversely affect either the Zone or other areas in the City.

C. Contractor represents that it has the knowledge,
5
experience and expertise required to develop a comprehensive
6
marketing plan and strategy to maximize the benefits of the
7
Enterprise Zone, and to meet the following marketing objectives:
8
1. To promote local businesses within the Zone and to
9
encourage community support for such businesses; and
10
2. To attract outside business to the Zone which will
11
have a positive impact on the Zone.

SECTION 2. Implementation. The parties therefore do agree
13
as follows:

15 A. Contractor shall forthwith formulate a plan for
16 successfully marketing the City's Enterprise Zone, including
17 conducting such marketing research as is appropriate. The
parties contemplate that such marketing research shall consist of
18
19 the following:
20 1. Identify existing and potential patterns of
21 consumer behavior, including needs and wants within the Zone, and
22 to obtain information concerning how citizens of the Zone could
23 be encouraged to support local business in the area;
24 2. Identify existing locally owned business to obtain
25 information concerning their .needs and wants. so as to
26 strengthen locally owned business inside the Zone;
27 3. Identify potential entrepreneurs inside the Zone to
28 obtain information concerning how they might be encouraged to
start a business in the Zone.

4. Target businesses outside the Zone, i.e., greater
San Bernardino, Inland Empire, and outside the area, to obtain
information for marketing the Zone to such organizations;
5. Identify key Zone opinion leaders in order to use
their interpersonal contacts as natural conduits for marketing
the Zone to residents of the area.
B. To carry out the development of such marketing strategy,
Contractor shall follow the procedures outlined in its -Proposal
for a Marketing Plan and an Evaluation Design- providing for
research design for both a marketing plan for the City's
Enterprise Zone and an evaluation plan for determining the
success (or lack thereof) of the Enterprise Zone in accomplishing
its stipulated objectives. A copy of the proposal is attached
hereto as Exhibit -1-, and is incorporated herein by reference.
C. Contractor shall develop the marketing plan as proposed,
including all requisite research and studies, and present to the
City within one hundred twenty (120) days from the date of
execution of this agreement, a marketing plan.
SECTION 3. Payment. City agrees to pay, and Contractor
agrees to accept as full payment therefor, the sum of $50,025,
for the preparation of the marketing plan in accordance with the
proposal, annexed as Exhibit -A-. This fee shall cover all costs
and expenses incurred by Contractor for Phase I, preparation of
the Marketing Plan, and shall be paid as follows: 1/3 ($16,675)
upon execution of this agreement; 1/3 ($16,675) at the midpoint
of the project (on or before March 1, 1986); and 1/3 ($16,675)
upon delivery of the completed report by Contractor.

1 SECTION 4. In addition, once the marketing plan has been
2 accepted by City and implemented by the City, the Contractor
3 shall move to Phase II, the evaluation plan, which shall entail
4 an ongoing monitoring of the marketing plan as implemented by the
5 City for its effectiveness in meeting its specified objective.
6 The ongoing monitoring shall include an evaluation to the
7 undertaking upon completion of the first full year of the
8 implementation of the marketing plan, and a further evaluation
9 each succeeding year through the first three years of the City's
10 implementation of such marketing plan. At the end of the three
11 years of implementation by the City, a final evaluation of the
12 Enterprise Zone will be conducted and an evaluation report,
13 including recommendations, will be submitted to the City.
14 Services for the Phase II, the ongoing monitoring and evaluation
15 of the marketing plan, shall be based upon cost and expense
16 factors agreed upon by the Contractor and City, at such time as
17 the monitoring is to be implemented, and amendments to this
18 agreement is contemplated setting forth the method by which such
19 factors shall be determined.
20 SECTION 5. Independent Contractor. At all times during the
21 term of this agreement, Contractor shall be an independent
22 contractor and shall not be considered an officer, agent, servant
23 or employee of City. City shall have the right to control
24 Contractor only insofar as the results of Contractor's services
25 rendered pursuant to this agreement, however, City shall not have
26 the right to control the means by which Contractor accomplishes
27 services rendered pursuant to this agreement.

1 SECTION 6. Non-Assignable. Contractor may not assign,
2 ither voluntarily or involuntarily, this agreement or any
3 ights, benefits or obligations hereunder, to any other party
4 ithout first obtaining the approval of the City.in writing.
5 SECTION 7. Equal E~loyment Opportunity. During the
6 erformance of this agreement, the Contractor agrees as follows:
7 he Contractor will not discriminate against any employee or
8 pplicant for employment because of race, color, religion, sex or
9 ational origin. The Contractor will take affirmative action to
10 nsure that applicants are employed, and that employees are
11 reated during employment, without regard to their race, color,
12 religion, sex or national origin. Such action shall include, but
13 ot be limited to the following: employment, upgrading,
14 emotion, transfer, recruitment, recruitment advertising, layoff
15 r termination, rates of payor other forms of compensation, and
16 selection for training, including apprenticeship. The Contractor
17 agrees to post in conspicuous places, available to employees and
18 applicants for employment, notices setting forth the provisions
19 f this non-discrimination clause. Consultant will, in all
20 solicitations or advertisements for employees placed by or on
21 behalf of Contractor, state that all qualified applicants will
22 receive consideration for employment without regard to race,
23 color, religion, sex, or national origin.
24 SECTION 8. Notices. Notices to the parties, unless
25 otherwise requested in writing, shall be sent as follows
