the underltanding that the City could pay the bill but would be reimbursed
by the Redevelopment Agency.

STAFF REPORT
In December the Council directed the City Administrator to request that the Agency
place an item on its December 16th agenda recommending methods for reimbursing the
City pumping costs in the amount of $36,370.25. These costs were incurred by the
City as its ahare (50/50) of pumping of high groundwater over a five-month period
of time.
Staff recommended that this sum ($36,370.25) be reimbursed to the City from tax
increment funds, as they flow, from the Tri City Project, from both Sub Areas A
and B, after prior Tri City obligations are paid.
The Commission approved the reimbursement. The resolution not only approves the
execution of the agreement for reimbursement, but also authorizes the borrowing of
the funds from a lending institution in order that the City can be paid within the
month rather than waiting for tax increments to flow.

RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING AND
DIRECTING EXECUTION OF AGREEMENT WITH THE COMMUNITY DEVELOPMENT
COMMISSION OF THE CITY OF SAN BERNARDINO FOR COSTS OF HIGH GROUND
WATER PUMPING PROGRAM.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor of the City of San Bernardino is
hereby authorized and directed to execute for and on behalf of
the City an agreement with the Community Development Commission
of the City of San Bernardino relative to the reimbursement of
costs of a high ground water pumping program, a copy of which
agreement is attached hereto as Exhibit PI" and incorporated
herein by reference.

authorized and directed to borrow, from the First Interstate Bank f
California or from any other bank or lending institution with whic
the Agency regularly conducts business, funds necessary to pay
accrued pumping charges pursuant to the agreement referred to

needed for paying forthwith to the City of San Bernardino the cost
incurred by the City for high ground water pumping to date. The
Chairman and Secretary are authorized to execute any and all
documents necessary to complete the borrowing of such sums, and to
pledge therefor such revenues or securities as may be appropriate
and necessary to effect such borrowing.

AGREEMENT BETWEEN THE CITY OF SAN BERNARDINO AND THE COMMUNITY
DEVELOPMENT COMMISSION OF THE CITY OF SAN BERNARDINO RELATING TO
REIMBURSEMENT FOR HIGH GROUND WATER PUMPING EXPENSES.
THIS AGREEMENT, effective this
day of
, 1986, by and between the CITY OF SAN
BERNARDINO, a municipal body corporate, hereinafter .City., and
the COMMUNITY DEVELOPMENT COMMISSION OF THE CITY OF SAN
BERNARDINO, a public body corporate, hereinafter .Commission.,
establishes the agreement of the parties relative to the expenses
of dealing with the high ground water pumping program approved by
City.
SECTION 1. Recitals.
A. City and Agency both benefit from reduction in the level
of ground water which afflicts much of the southern area of the
City of San Bernardino and has particularly adverse effect upon
the Southeast Industrial Park Redevelopment Project, the Tri-City
Redevelopment Project, the South Valle Redevelopment Project, and
the proposed Uptown Redevelopment Project. Each of these
projects is being conducted the aegis of the Commission.
B. City has previously incurred, for itself and for the

Commission, a pumping expense of $36,370.23, for pumping required
to alleviate the condition of high ground water, and additional
expense of up to $200,000 may be incurred in the future.
C. The parties hereto desire to provide for the payment of
the costs of required pumping to alleviate the problems caused by
high ground water, and for that purpose have entered into this
agreement.

SECTION 2. Implementation. Commission agrees to forthwith
pay to City the sum of $36,370.23, to reimburse City for the

3 pumping costs heretofore incurred by the City for the reduction
of the threat posed by the high ground water level existing in
4
the project areas referred to above. In addition, Commission
5
agrees that future expenses incurred by the City, up to $200,000,
6
shall be reimbursed by Commission to City from excess tax
7
8 increment funds received by CommissiQn from the Tri-City Project
Area, such excess funds being determined only after the 20% set-
9

aside for low and moderate income housing and sums agreed to be
paid to the various taxing districts are deducted.
