STAFF REPORT
This proposed annexation has been before the Mayor and Common
Council for various reasons, and the time has now been officially
set to hear protests.
Because there are not a sufficient number of protests in regard
to assessed valuations opposing this annexation, we recommend
that the annexation be approved.
We remind you that the present boundaries were the "compromised"
boundaries approved by L.A.F.C.

1 RESOLUTION NO.
2 RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING THE
3 ANNEXATION OF DISTRICT NO. 337 (LAFC 2353) AND LOCATED GENERALLY
4 SOUTHWEST OF CAJON BOULEVARD, NORTH OF JUNE STREET, AND DETACHMENT
5 FROM THE CENTRAL VALLEY FIRE PROTECTION DISTRICT.
6 WHEREAS, pursuant to the provisions of the District
7 Reorganization Act (Gov. Code Section 56000, et seq.), proceedings
8 were initiated by the Common Council of the City of San
9 Bernardino, to annex to the City of San Bernardino certain
10 contiguous uninhabited territory hereinafter described; and
11 WHEREAS, a Negative Declaration was issued in connection
12 with said uninhabited territory and said information is on file in
13 the office of the Clerk of the Board of Supervisors of the County
14 of San Bernardino; and
15 WHEREAS, at its meeting of November 20, 1985, the Local
16 Agency Formation Commission of the County of San Bernardino duly
17 adopted its Resolution No. 2021, granting approval to proceed,
18 subject to conditions; established the City of San Bernardino as
19 the conducting authority, and set forth that the distinctive short
20 form designation to be used throughout this proceeding shall be:
21 LAFC 2353; and
22 WHEREAS, on the 16th day of December, 1985, a resol ution
23 was adopted by the aforesaid Common Council of the City of San
24 Bernardino, Cal ifornia, declaring that proceedings had 'been
25 initiated by said Council, and proposing the annexation of the
26 hereinafter described uninhabited territory to the City of'San
27 Bernardino, and that said resolution provided that the proposed

1 annexation should be generally known and identified as Annexation
2 Di stri ct No. 337, and
3 WHEREAS, said reso.lution set forth therein that all the
4 property included in the aforesaid territory should be taxed
5 equally with the other property within the City to pay the bonded
6 indebtedness and any and all general indebtedness of the Ci ty of
7 San Bernardino contracted prior to or existing or outstanding at
8 the time of the aforesaid proposed annexation of said described
9 property as provided in said Act; and
10 WHEREAS, said resolution did fix, determine and declare
11 that a hearing be held on the 6th day of January, 1986, at the
12 hour of 9:00 o'clock a.m., in the Council Chambers of the City
13 Hall, 300 North "0" Street, San Bernardino, California, and the
14 same was the day, hour and place designated where any person
15 owning real estate within such territory so proposed to be annexed
16 and having any objections to the proposed annexation might file a
17 wri tten protest, appear before the Common Council of the Ci ty of
18 San Bernardino and present evidence or objections why such
19 uninhabited territory should not be so annexed to the City of San
20 Bernardino; furthermore, said resolution provided that such
21 w r i t te n pro te s t s h 0 u 1 d be f i 1 e d with the City C 1 e r kat any t i me
22 before the conclusion of said hearing: and
23 WHEREAS, there were no written protests filed with the
24 City Clerk of the City of San Bernardino prior to the conclusion
25 of said hearing on January 6,1986: and thereafter, at this date,
26 said Resol ution No. was adopted by the Mayor. and

1 Common Counci 1 declaring that a majori ty protest has not been
2 presented; and
3 WHEREAS. it appears to the Common Counci 1 of the Ci ty of
4 San Bernardino that the aforesaid annexation proceedings have
5 been completed and all acts performed in accordance with said
6 Government Code. conditions of LAFC Resolution No. 2021. adopted
7 November 20. 1985. and any and all other laws in any way connected
8 with the said annexation procedurej'and

WHEREAS. the Common Council of the City of San
10 Bernardino desires to approve at this time the annexation of the
11 a foresa i d terri tory.
12 NOW. THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
13 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION ONE: That said territory herein described as
15 Annexation District No. 337 is hereby annexed and incorporated in
16 and made a part of the City of San Bernardino.

SECTION TWO: The territory herein referred to as being
18 annexed to the City of San Bernardino is particularly described as
19 follows. to wit:

All that portion of the Rancho Muscupiabe as per
plat recorded in Book 7 of Maps. page 23 records
of the County Recorder. San Bernardino County.
State of California. being a portion of Section
18. Township 1 North, Range 4 West and a portion
of 13. Township 1 North. Range 5 West San
Bernardino Base Meridian. if said Section lines
were extended across said Rancho and those
portions of the adjoining street. described as
follows:
Beginning at the intersectio~ of the Northeasterly
prolongation of the center line of June Street a~d
the Northeasterly right-of-way line of the

Atchison, Topeka & Santa Fe Rallroad, said point
being on the City limit Line of the City of San
Bernardino; thence' Southwesterly and Westerly
along the Northeasterly prolongation and said
center line of Jane Street a distance of 1150
feet, more or less, to the center line of San
Benito Street; thence North along said center line
a distance of 100 feet, more or less, to the
termination of said San Benito Street; thence West
30 feet, more or less, to an angle point; thence
South 19.60 feet, more or less, to an angle point;
thence West 142 feet, more or less, to an angle

of the San Bernardino County Flood Control right-
of-way; thence Northeasterly along said
Southeasterly line, a di,stance of 3850 feet, more
or less, to the Southwesterly ri ght-of-way of
Cajon Boulevard; thence Northwesterly along said
Cajon Boulevard right-of-way a distance of 500
feet, more or less, to a point on said City limit
line; thence Northerly along said City limit line
a distance of 250 feet, more or less, to an angle
point therein; thence Southeasterly along said
Ci ty 1i mi t 1 i ne a di stance of 2635 feet, more or
less, to The Point of Beginning.
Approximately 123 acres
SECTION THREE: That the above described property will
be subject to taxation equally with the property within such
municipal corporation.
SECTION FOUR: The property herein annexed is declared
to be a part of Ward 6 and the boundaries of Ward 6 are hereby

altered to include said annexed territory.

the present county zoning on an interim basis.
