No. 85-41 700.1 Mayor and Common Council Re: Zoning Regulations, Off-Site Sale of Alcoholic Beverage QUESTION 1. May the City require a conditional use permit for the location of establishments engaging in the off-site sale of alcoholic beverages? 2. May the City promulgate special conditions for the location of establishments engaging in off-site sale of alcoholic beverages, in a zone permitting the location of such establishments? ANALYSIS The City has the power, under its zoning authority, to regulate the location of establishments engaging in the on- site or off-site sale of alcoholic beverages. Under the conditional use permit (CUP) approach, the use would be permitted in certain specified zones sUbject to the requirements of the zone and sUbject to the Planning Commission making the required findings. (San Bernardino Municipal Code Section 19.78.050.) If these findings are not made, the use cannot be established. Additionally, under a CUP, the use can be approved subject to conditions imposed on the project to mitigate the impact of such a use on the surrounding community. (San Bernardino Municipal Code Section 19.78.060.) b1 The other approach, as indicated by question number two, is to permit the establishment of the use in a zone as a matter of right. If the use conforms to the statutory conditions for its operation in the zone, it would be permitted. Under Q-'1, c ~. o o ( ~ Mayor and Common Council December 2, 1985 Page 2 ~ either approach, the conditions imposed cannot conflict with Department of Alcoholic Beverage Control's regulation of the operation. It should be noted that any new regulation cannot be made applicable to an existing business unless there is a change in the type of liquor license, or there is a substantial change in the mode or character of operation, California Business and Professions Code Section 23790 states the following: -No retail license shall be issued for any premises which are located in any territory where the exercise of the rights and privileges conferred by the license is contrary to a valid zoning ordinance of any county or city. . . .- In interpreting this section, the courts have stated that: -It is clear that the Legislature did confer upon counties and cities the right to control the districts in which various types of liquor business could be carried on by the enactment of valid zoning ordinances.- Floresta. Inc.. etc. v. Citv Council of the Citv of San Leandro (1961) 190 Cal.App.2d 599, 12 Cal.Rptr. 182, 186. There are limits on the City's right to regulate such uses. Business and Professions Code Section 23790 prohibits the application of new zonina regulations to existing businesses. -. . . Premises which had been used in the exercise of such rights and privileges at a time prior to the effective date of the zoning ordinance may continue operations under the following conditions: (a) The premises retain the same type of retail liquor license within a license classification. (b) The licensed premises are operated continuously without substantial change in mode or character of operation.- (Business and Professions Code Section 23790.) In addition, the City cannot regulate any aspect of the - . . . manufacture, sale, purchase, possession and transportation of .C , . c o r :) Mayor and Common Council December 2, 1985 Page 3 alcoholic beverages within the state . . . .. Article XX Section 22 of the California Constitution grants exclusive authority for such regulation to the Department of Alcoholic Beverage Control (ABC). The City is not prohibited by the Alcoholic Beverage Control Act from regulating the geographic location of the place of sale and use of liquor (Ploresta. Inc. v. San Leandro. Id.) for uses established after the effective date of the zoning ordinance (Business and Professions Code Section 23971). Also, the City may make such other regulations as are not in conflict with ABC regulation of the .. . . sale, purchase, possession and transportation of alcoholic beverages. (Pipolv v. Benson (1942) 20 Cal.2d 366, 371, 125 P.2d 482). There are a number of approaches to the regulation of off-site liquor sale establishments under the zoning law. The CUP approach has been approved by the courts (See Ploresta v. San Leandro. Id.), and has recently been adopted by the City of Los Angeles. A copy of the Los Angeles ordinance is attached for your review. Under this method, a use may be subject to three different sets of conditions. There are ordinance conditions which must be met for the grant of any conditional use permit. These are set forth at San Bernardino Municipal Code Section 19.78.050. In addition, there may be other ordinance conditions which must be met before a specific use can be established. An example of such a condition is the minimum distance between adult entertainment establishments set forth at San Bernardino Municipal Code Section 19.46.030. A third set of conditions may be imposed on a project as requirements for the approval of the specific use being considered. This is permitted under San Bernardino Municipal Code Section 19.78.060. If any of the conditions for its approval are violated, the City could take action to revoke the CUP. (See San Bernardino Municipal Code Section 19.78.110.) An alternative type of regulation is to establish that the off- site sale of alcoholic beverages shall be a permitted use in specified zones, subject to specific conditions. Once the conditions are established anyone complying with those conditions would be able to engage in the off-site sale of alcoholic beverages in the specified zone as a matter of right. If such an establishment violated said ordinance conditions, nuisance abatement procedures would apply. . . .- I - o o ( ') Mayor and Common Council December 2, 1985 Page 4 CONCLUSION Under the zoning laws, the City may establish conditions for the location of businesses engaging in the off-site sale of alcoholic beverages.
