STAFF REPORT
The proposed annexation is the final product of an annexation
that originally consisted of 75 acres.
The Local Agency Formation Commi ssion expanded thi s area to
include a much larger area that consists of 325 acres with 18
registered voters. A protest meeting was scheduled by the
Mayor and Common Council. The voters voted the annexation
down; therefore, by law, the annexation was terminated.
The annexation was renewed for consideration by L.A.F.C., based
on the fact that the Commission, and not the City, expanded
the original annexation, and we (the City) requested that a
compromised boundary be approved. This compromise was done by
the L.A.F.C. and was approved.
8ecause there is less than a 100% request for annexation, a
hearing must be held. This is the next step in the annexation
procedure.
We recommend that this resolution be passed.

RESOLUTION OF THE CITY OF SAN BERNARDINO INITIATING
PROCEEDINGS AND SETTING A HEARING FOR AN ANNEXATION DESIGNATED
LAFC NO. 2353.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Recitals.
(a)

(b) No city other than the City of San Bernardino is
affected by this annexation.
(c) The proposal is for annexation of the territory
described below to the City of San Bernardino. The area is

Landowners in the proposed annexation have
requested annexation to the City of San Bernardino to receive
extended urban services.
(e) The Local Agency Formation Commission has set
forth the following terms and conditions in its Resolution No.
2021:

The conducting authority for this
proceeding shall be the City Council of the Ci ty of San
Bernardino.

The following distinctive short form
designation shall be used throughout this proceeding: LAFC

Condition No.4. Included in the City's resolution
depicting final action shall be the detachment of County
Service Area 38, Improvement Zone G of CSA 38, County Service
Area 70, Improvement Zone A of CSA 70, and Improvement Zone P-2
of SCA 70 without split of assets or liabilities.

The date of issuance of the
Certificate of Completion shall be the effective date of this
reorganization.
(f) A general description of the boundaries for the
proposed annexation is as follows:
Proposed Annexation:
North of June Street, West of Cajon Boulevard
All that portion of the Rancho Muscupiabe as per plat
recorded in Book 7 of Maps, page 23 records of the
County Recorder, San Bernardino County, State of
California, being a portion of Section 18, Township 1
North, Range 4 West and a portion of 13, Township 1
North, Range 5 West San Bernardino Base Meridian, .if
said section lines were extended across said Rancho
and those portions of the adjoining street, described
as follows:
Beginning at the intersection of the Northeasterly
prolongation of the center line of June Street and
the Northeasterly right-of-way line of the Atchison,
Topeka & Santa Fe Railroad, said point being on the
City Limit Line of the City of San Bernardino; thence
Southwesterly and We~terly along the Northeasterly
prolongation and said center line of June Street a
distance of 1150 feet, more or less, to the center
line of San Benito Street; thence North along saitl

the termination of said San Benito Street; thence

Approximately 123 acres.
SECTION 2. Hearing.
(al A public hearing will be conducted on Monday,
January 6, 1986, to be held in the Council Chambers, City Hall,
300 North "D" Street, San Bernardino, Cal ifornia, at the hour
of g:OO a.m., or as soon after that time as the matter may be
heard, to receive, consider and rule upon written protests to
the annexation designated LAFC No. 2353.
(bl Any interested person may fi le a wri tten protest
against the annexation with the City Clerk not later than the
hour set for hearing.
