Re: Sunpointe Village - Appeal the decision of the meeting of
November 12, 1985.
Attention: Mayor Wilcox and Honorable Members of the Common Council
Landtech Inc. herein requests with respect to the above entitled matter,
reconsideration to the decision made to deny exemption of the school
facilities fees.
Again it cannot be over stressed, that the loan commitment letter
presented and dated on September 13, 1985 is sufficient documentation
to justify the commitment for financing the construction of Sunpointe
Village.
The failure of requested guidance, lack of cummunication to the School
District, interpetation of the resolution and the intent, inconsistencies
of answers to many questions and much more, constitutes evidence for
this request.
The substantial amount of time and money lost because of this is
impractical and difficult to fix.
Therefore, Landtech Inc. is requesting this matter before you to be
reconsidered, and or appealed due to the inadequate opportunity
received in the development of this project.

Dear Mr, Scolastico:
The hearing on the appeal filed by Parker and Covert on behalf
of the San 8ernardino City Unified School District relative to the
Legislative Review Committee's decision granting a school impaction
fee exemption to Landtech, Inc" was held November 12, 1985, by the
Mayor and Common Counc.il,
A motion to grant your appeal and deny the exemption carried
by a four-three vote, The Mayor later vetoed that motion. However.
in effect, the exemption stands denied.
The Council later made a motion clarifying the procedure on
future requests for exemption. The City Attorney will be responsible
for administering Section 9J (Exemption). Appeals to the decision of
the City Attorney's Office in regard to Section 9J will be referred
to the Legislative Review Committee for review and recommendation to
the full Council,

Reference: Loan Committment
Dear Mr. Saab:
This letter shall serve as a loan committment for the development of
Sunpoint Village, a 72-Unit Apartment Building, located at the North
East corner of Wabash and Parkside, in the city of San Bernardino,
County of San Bernardino, State of California, based upon the
following terms and conditions:
a) Loan Amount: $2,350,000,00;
b) Interest Rate: 11th District Cost of Funds plus Three
Hundred Points;
c) Amortization: Thirty (30) Years;
d) Loan Fees: One and one-half (construction) plus Three points
(permanent);
e) Construction Loan: Twelve months, Borrower may extend this loan
for six (6) additional months by paying ,5 points,
f) Construction loan to rollover into a permanent loan provided
that either of the two shall occur;
1) Upon 70% of lease-up or
2) Borrower to provide for a letter of credit for the
balance of the debt service less rental receipt for a
period of six (6) months,
We expect to receive your final city approved drawing within ten (10)
days from above date.

plans are submitted and accepted by the City Engineer.
3, All fees are paid to the Engineering Department for grading and
street improvements,
