CITOOF SAN BERNARDIIC) - REQUEQ FOR COUNCIL AC-Q)N STAFF REPORT Attorney Richard R. Terzian of Burke, Williams & Sorensen has requested that the City and County appropriate an additional $2500 each for attorneys' fees incurred in the Indian Bingo lawsuit. Additional time has been expended by the law firm in resisting a motion before the preliminary injunction hearing and will be expended in opposing a motion to dismiss filed by Western Entertainment. Attorney fees already exceed $12,000, but in accordance with our prior agreement such fees have been reduced to $10,000. Mr. Terzian will represent the City and County in regard to the motion to dismiss, but that motion was not anticipated and comes after the preliminary injunction set for December 2, 1985. Therefore, an adjustment should be made in the prior agreement to approve additional fees up to $5,000 ($2,500 from the City and $2,500 from the County) for work performed through the scheduled December 9 hearing on the motion to dismiss. , 75-0264
