To permit so-called "pull-tab" bingo as authorized by state law since 1981, and to authorize so-called "you pick'em" bingo cards playable only during a game at an established location, provided that such "you pick'em" cards are now authorized by state law. That determination will be left to the District Attorney. 2. To increase the maximum limitation on prizes which may be awarded at anyone session from $3,000 to $5,000. Pursuant to the direction of the Legislative Review Committee, an ordinance amending Chapter 5.36 of the San Bernardino Municipal Code to accomplish these purposes has been prepared, and is submitted for your consideration herewith. By changing the definition of "bingo" to permit any bingo authorized by state law, the City does away with its prohibition against "pull-tab" bingo and its prohibition against "you pick'em" type bingo, if the latter is now authorized by state law. The Chief of Police will contact the San Bernardino County District Attorney's Office for guidance as to whether the "you pick'em" type bingo cards are now authorized. The District Attorney in 1981 indicated that such cards were not then authorized, but the state law has been amended since that opinion. .. ~ The second goal set by the Legislative Review Committee, to permit up to $5,000 in total prizes in anyone session, is accomplished by the amendment to Section 5.36.060, Subsection D, of the San Bernardino Municipal Code. If the Council desires to change the City's regulations in accordance with the recommendations of the Legislative Review Committee, I am satisfied the attached ordinance will accomplish that purpose. 75-0264 .......,.'f "'...-' 1 ORDINANCE NO. ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING CHAPTER 2 5.36 OF THE SAN BERNARDINO MUNICIPAL CODE TO INCREASE THE LIMIT 3 ON PRIZES IN ANY PARTICULAR SESSION, AND TO ELIMINATE PROHIBITION AGAINST "PULL-TAB" BINGO CARDS. 4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 5 DO ORDAIN AS FOLLOWS: 6 SECTION 1. Section 5.36.010 Subsection A of the San 7 Bernardino Municipal Code is amended to read as follows: 8 "A. 'Bingo' means a game of chance in which prizes are 9 awarded on the basis of designated numbers or symbols on a card 10 which conform to numbers or symbols selected at random. Bingo 11 shall be conducted in accordance with the applicable statutes of 12 the State of California." 13 SECTION 2. Section 5.36.060 Subsection D of the San 14 Bernardino Municipal Code is amended to read as follows: 15 "D.
