The Hayor and Common Counci 1 has authori zed the Publ i c
Works Director/City Engineer and City Clerk to proceed
with this annexation.
09/16/85 -- The Mayor and Common Council passed Resol ution No. 85-
363 making an application to the Local Agency Foundation
Commission for the annexation of 30 acres of
inhabited territory located North of the Redlands
Freeway, West of Tippecanoe Avenue.
Recommended motion:
Adopt Resolution.

STAFF REPORT
The annexation process has been completed up to this point.
The next step to be taken before L.A.F.C. will hear this
annexation is to pass a resolution determining the amount of
property tax revenues to be exchanged between the City and
the County.
The final date for submission of the City's resolution to the
Local Agency Formation Commission is November 11. 1985.
We recommend that the resolution be passed.

RESOLUTION OF THE CITY OF SAN BERNARDINO DETERMINING
3 THE AMOUNT OF PROPERTY TAX REVENUES TO BE EXCHANGED 8ETWEEN THE
CITY OF SAN BERNARDINO AND THE COUNTY OF SAN BERNARDINO
4 RESULTING FROM THE JURISDICTIONAL CHANGE DESCRIBED BY LAFC NO.
2354.

BE IT RESOLVED BY THE ~'AYOR AND COMMON COUNCIL OF THE
6 CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. Recitals. The Mayor and Common Council of
8 the City of San Bernardino hereby find and determine that:

A. Pursuant to Section 99 of the Revenue and Taxation
10 Code', pri or to the issuance of a certifi ca te of fil i n9 by the
11 Local Agency Formation Executive Officer, the governing bodies
12 of all local agencies whose service area or service responsi-
13 bilities will be altered by a proposed juriSdictional change
14 will negotiate and determine by resolution the amount of
15 property tax revenues to be exchanged between and among such
16 local agencies. 41

B. Except as provided in Section 99.1 of the Revenue
18 and Taxation Code, in the event that a juriSdictional change
19 would affect the service area or service responsibili ty of one
20 or more special districts, the Board of Supervisors of the
21 County of San Bernardino shall, on behalf of the district or
22 districts, negotiate any exchange of property tax revenues.

C. The Mayor and Common Council of the City of San
24 Bernardino and the Board of Supervisors of the County of San
25 Bernardino have determined the amount of property tax revenues
26 to be exchanged as a result of the juriSdictional change des-
27 c rib e d by L A F C No. 2 3 5 4 .

SECTION 2. Implementation.
A. The negotiated exchange of property tax revenues
bet wee nth e City 0 f San Be r n a r din 0 and the Co un ty 0 f San
Bernardino attached hereto as Exhibit "A" and incorporated
herein by reference, resulting from the above described
jurisdictional change, is hereby approved and accepted. The
column entitled "Estimated Current Tax Revenuen shall represent
the amount of property tax revenues for the current year to be
paid to the County of San Bernardino and its affected agencies.
B. The annual tax increment generated in the area
sUbject to the jurisdictional change and attributable to the
local Agencies whose service area or service responsibilities
will be altered by the proposed jurisdictional change shall be
allocated in the future years pursuant to the provisions of
Section 9B of the Revenue and Taxation Code.
SECTION 3 . The City Clerk of the C i t Y of San
Bernardino is hereby directed to certify to the passage of this
resolution and to cause a certified copy to be sent to the
Executive Officer of the Local Agency Formation Commission of
the County of San Bernardino.
