I respectfully request your careful review of California Senate Resolution 30 which petitions the President and Congress to retain the deductibility of state and local taxes in any revision of federal income tax law which is enacted. I urge you to consider sending a letter or resolution on this issue which will ultimately affect all citizens and all levels of government services. We are in firm support of tax reform which creates fairness and simplifies the codes. However, our opposition to the elimination of deductibility for state and local taxes is of such urgency that it required a formal resolution to demonstrate our commitment to this long-standing principle of federalism. We are opposed to a "tax upon a tax" which will inequitably burden middle income taxpayers and perhaps fuel a taxpayer revolt to reduce state and local taxes if no longer deductible from the taxpayer's federal tax bill. The Senate passed SJR 30 on a strong bi-partisan vote (25 to 3). The Assembly took action on SJR 30 on September 11, 1985, passing it by a vote of 46 to 19. The Members of the California State Legislature are prepared to work with the Administration and Congress on tax reform which broadens the tax base without eliminating the deductibility of state and local taxes. ~~ DAVID ROBERTI . " , ......' -~...... 1 RESOLUTION NO. 2 RESOLUTION OF THE CITY OF SAN BERNARDINO SUPPORTING STATE SENATE JOINT RESOLUTION #30, OPPOSING ELIMINATION OF DEDUCTION 3 IN INCOME TAX FOR STATE AND LOCAL TAXES. 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 5 6 SECTION 1. Recitals. 7 A. The President of the United States has proposed a 8 federal income tax reform plan to promote "fairness, simplicity, 9 and growth". 10 B. The President's plan for tax reform would eliminate the 11 deduction for state and local taxes paid by individuals. 12 C. The elimination of the deduction for state and local 13 taxes would be an unfair tax upon a tax and, therefore, would 14 constitute double taxation. 15 D. The elimination of the deduction for state and local 16 taxes would impose a disproportionate tax burden on middle-income 17 taxpayers. 18 E. The federal government in recent years has shifted major 19 responsibility to state and local governments in the spirit of 20 federalism, in some cases without providing adequate funding. 2] F. The abolition of the deduction for state and local taxes 22 will seriously impair the ability of state and local governments 23 to discharge these new responsibilities. 24 SECTION 2. Implementation. 25 A. The Mayor and Common Council of the City of San 26 Bernardino support State Senate Joint Resolution No. 30 27 relative to federal income taxation and support the Legislature 28 of the State of California in encouraging the President and the \.. I - '... 1 Congress of the United States to retain the deductibility of 2 state and local taxes in any revision of federal income tax law 3 which is enacted. 4 B. The City Clerk is directed to transmit copies of this 5 resolution to the President of the United States, Ronald Reagan, 6 Senator Alan Cranston, Senator Pete Wilson, and Representative 7 George Brown. 8 I HEREBY CERTIFY that the foregoing resolution was duly 9 adopted by the Mayor and Common Council of the City of San 10 Bernardino at a meeting thereof, held 11 on the day of , 1985, by the following 12 vote, to wit: 13 14 15 16 17 ]8 19 AYES: Council Members NAYS: ABSENT: City Clerk The foregoing resolution is hereby approved this 20 day of 21 22 23 , 1985.
