Synopsis of Previous Council action:
The Mayor and Council considered a similar request at a meeting in
November, 1983. The item was referred to the Legislative Review
Committee with no further action taken by the Mayor and Council.
The Mayor and Council also considered a similar request on
October 15, 1984 and indicated to the Planning Director that
he was authorized to instruct the Rialto U.S.D. that they were
at liberty to discuss fees for each development on a case by case
basis.
Recommended motion:
That the Mayor and Council refer the Declaration of Impaction from
the Rialto Unified School District to the Legislative Review
Committee for further review.

SUBJECT: Rialto Unified School District
Declaration of Impaction
November 4, 1985
The Rialto Unified School District has submitted a Declara-
tion of Impaction. The impact ordinance is in compliance
with Government Code Section 65971 and a report has been
submitted which summarizes existing facilities impact within
the District. The Mayor and Council of the City of San
Bernardino have, in the past, honored the Declaration of
Impaction, although on an informal basis.
In as much as the Council has adopted a formal procedure for
the San Bernardino City Unified School District, we would
recommend that this item be referred to the Legislative
Review Committee for further review and deliberation.

STAFF REPORT

Council adopt an ordinance for interior facilities financing. The item was
scheduled before the Mayor and Common Council on November 21, 1983 and was
referred to the legislative Review Committee. The Committee then reviewed
the item at their meeting of December 2, 1983 and concluded that since the
City had no jurisdiction over the Rialto Unified School District, the
school district should continue to negotiate with the builders and developers
and that the City should remain a neutral party. It was the conclusion of
the Committee that this request be denied.
The City has again received a request to adopt an Interim School Facilities
Financing Ordinance from the Rialto Unified School District in the amount
of $1,566 per unit. The District has also supplied supporting data for the
establishment of said fee as well as a copy of an ordinance adopted by the
City of Rialto.

In compliance with the City Ordinance and Government
Code Section 65971. this report summarizes the existing
facility impaction in th~ Rialto Unified School District.
Every effort has been made to validate the construction
data with your planning department. and to clarify
procedures and methodology used in projecting enroll-
ment. state and federal law. school board policy relating
to classroom utilization. and the computation of devel-
oper fees.
All reasonable methods of mitigating conditions of
overcrowding have been evaluated by the district.
With the rapid growth we will need additional classrooms
in order to house the students.

DECLARATION OF CONTINUING IMPACTION
OCTOBER 15, 1985
Pursuant to Government Code Sect ion 65971, the Board of Educat Ion of the
Rialto Unified School District submits to the City of Rialto, City of Fontana,
City of Colton, City of San Bernardino, and the County' of San Bernardino
this Notification of Condition of Overcrowding as determined following a
public hearing held October 9, 1985.
The decision to refi Ie this Notification of Conditions of Overcrowding is
based on the following:
1. Overcrowding exists due to the occupation of newly constructed homes
creating enrollment in excess of the capacity of the majori ty of the
schools.

1. Total capacity includes the classrooms utilized for district regular
and special education students and excludes those classrooms that belong
to San Bernardino County Schools (Bemis - 6, Kolb - 3), 1 classroom
(Henry) for the elementary Gifted and Talented program, 3 classrooms
(Henry, Myers and Preston) used as labs for math, reading, computers
and science, and" classrooms (Bemis, Boyd, Casey and Kelley) that belong
to the Federal Government (Title I, now Chapter I).
2. Within the boundaries of Rialto Unified School District there are currently
858 single family dwellings and 698 multiple family dwellings under con-
struction, and 2839 single family dwellings and 1092 multiple family
dwell ings which have received tentative or final map approvals from the
various cities or the county.

In attempting to alleviate this problem. 'we have considered the following
reasonable methods for mitigating conditions of overcrowding:
I,. Agreements between a developer and the affected, school district whereby
temporary-use buildings will be leased to the school for an interim period,
or whereby temporary-use buildings owned by the school district will
be used.
No agreements currently exist between developers and the district for
bui Idings to be leased' to the district and the district does not have
temporary buildings that are not currently in use.
2. The avai labi I ity of funds. the use of which would not impair the normal
functioning of educational programs.
There are no district funds avai lable which would not impair the normal
functioning of educational programs. .
3. The use of funds which could be made avai lable from sale of surplus
property.

have surplus 'personal' property available for sale.
4. The use of school district property for temporary-use buildings.

5. The use of other schools in the district not having overcrowded conditions.
Elementary and secondary student transfers have been accomplished to

enrollment indicates 553 more elementary and secondary students than
there wi II be space avai lable for in October 1985. and 1.343 by October
1986.
6. Double or staggered sessions.
Double sessions require a reduction in the amount of time the student
spends in class and teachers are unable to prepare special instructional
materials before class because of the dai Iy move. These circumstances
cause the education level provided students to be greatly reduced. Also
a reduction of instructional time now results In loss of funds.
Students are on the streets during pre-dawn and after dark hours in order
to attend double or staggered sessions. Funds are not available to provide
additional transportation.
Double and staggered sessions additionally overload existing facilities.

Rialto Unif)ed School District currently operates 3 co~tinuous (year
round) school programs at the elementary ,level and one continuous (year
round) school at the junior high level.' Approximately 435 additional
students could be housed by multitracking the elementary schools, and
206 students could be housed by multitracking the junior high school.
I n order to mandate add it i ona I year round schoo I s or mu I t i track i ng, the
district must comply with all legal requirements which can delay the
availability of classroo~s until the process is complete. In the meantime
students would be unhoused.
8. Use of available bond revenues to the extent authorized by law.
There are no bond revenues avai lable at this time. Proposition 13 has
removed bonding ability from school districts.
9. The possible use of facilities in other districts.

Faci lities are not avai lable in two districts bordering Rialto Unified
School District boundaries. One school was avai lable at one district,

Funds are not available for the purchase of additional buses.
10. Use of interdistrict attendance agreements.

The Rialto Unified School District had interdistrict attendance agreements
affecting 110 students during the 1984-85 school year. We anticipate
a similar number for the current year; however, these agreements are
generally for specific reasons and would not be practical for most
students.

2. In considering reasonable methods of mitigating conditions of overcrowding,
the district concludes that there is no feasible method for reducing
the conditions of overcrowding. The Rialto Unified School District hereby
requests the County of San Ber'nardino, City of Rialto, City of Fontana,
City of Colton, and the City of San Bernardino to concur with district
findings of impaction and require the collection of fees from bui lders/
developers. Said fees would be used for the purpose of placing interim
classroom and restroom facilities on existing school sites determined
to be overcrowded by the district and listed above. In addition we are
requesting that an ordinance be adopted that would allow mitigation fees
'in I ieu of SB201 fees.
It is further requested that fees be based upon costs submitted (as attach-
ments to impact i on package) and us i ng the formu 1 a st i pu I ated by County
Ordinance 2429.
3. In the opinion of the Board of Education of the Rlalto Unified School
District, and based upon current data, each new single dwelling unit
produces .74 students, and multiple family dwellings produce .45 students
per unit..
