Monday, June 17, 1985, the Mayor and Common Council allocated $295,000 for resurfacing and/or reconstructing major arteries throughout the City. At- tached is a list agreed upon. In compiling the actual schedule, it was found that the east side of Waterman Avenue, from Highland Avenue to 27th Street was within the jurisdiction of County of San Bernardino since 1923. The County. has tentatively agreed to compensate the City for resurfacing their portion. They have also included the County portions of Del Rosa Avenue, from Date Street to Eureka Street in their proposal. The City of San Bernardino will serve as lead agency. . The City and County have joined efforts in the past to complete necessary work in similar situations. Some areas recently resurfaced are Arden Avenue, north of High)and Avenue and Lynwood Drive, from Del Rosa Avenue to Cedar. The Director of Public Services recommends that joint agreement resolutions .be adopted to resurface Waterman Avenue, from Highland Avenue to 29th Street 'and Del Rosa Avenue, from Date Street to Eureka Street. City Attorney day . 1985.' ~ayor of the City of San Bernardino - 2 - , / COOPERATIVE AGREEMENT This Agreement, entered into on_ this _day of , 1985, by and between the County of San Bernardino, hereinafter referred to as "County," and the City of San Bernardino, a muni- cipal corporation; hereinafter referred to as "City," WITNESSETH: WHEREAS, Del Rosa Avenue between Date Street and Eureka Street, is in need of being resurfaced to prevent further deterioration of the existing pavement and to improve riding quality; and WHEREAS, jurisdiction for operation and maintenance of Del Rosa Avenue is split between COUNTY and CITY; and WHEREAS, COUNTY and CITY mutually desire to cooperate and jointly participate in the proposed resurfacing of the above noted section of Del Rosa Avenue; and WHEREAS, COUNTY and CITY desire to set forth the responsibilities and obligations of each agency in relation to the performance of the proposed resurfacing. NOW, THEREFORE, IT IS MUTUAllY AGREED AS FOllOWS: CITY SHALL: 1. Act as lead agency for the resurfacing of Del Rosa Avenue. 2. Perform the full w.id'th resurfacing of Del Rosa Avenue, between Date Street and Eureka Street, with an average one (1) in~h thickness of asphalt concrete, and replace traffic striping and pavement markings. 1 3. Require its contractors to maintain Worker's Compensation Insurance on all employees and a Public and Property Liability Insurance policy of not less than $1,000,000 combined single limit liability coverage for bodily injury and/or property damage which shall name the City of San Bernardino and the county of San Bernardino as additional insured parties. COUNTY SHALL: 1. Reimburse the CITY for the cost incurred for resurfacing the port_ion of Del Rosa Avenue that is under jurisdiction of the COUNTY, within thJ~~L31U_~_ days after receipt of a billing from the CITY. The COUNTY'S share shall be the cost of resurfacing the portion of Del Rosa Avenue under the COUNTY'S jurisdiction, including the cost of replacing traffic striping and pavement markings, and is estimated to be $9,551 and shall in no event exceed $10,500 unless approved in writing by the COUNTY. BE IT FURTHER AGREED THAT: 1. Neither party to this Agreement nor officers nor employees thereof shall be responsible for any damage or liability occurring by reason of anything done or omitted to be done by the other party to the Agreement under or in connection with any work, \ / authority or jurisdiction not delegated to the parties under this Agreement. It is also agreed that, pur- e; suant to Government Code Section 895.4, each party shall fully indemnify and hold the other party harmless from any liability imposed for injury (as defined by Government Code Section 810.8) occur- ring by reason of anything done or omitted to be done under or in connection with any work authority of jurisdiction under this Agreement. 2. Upon completion of the resurfacing, the CITY and ~OUNTY will maintain the portion of the work within their respective areas of jurisdiction. 3. This Agreement may be amended or modified at any time upon mutual agreement of the parties hereto.
